Proof That C&p Exam Didn't Match Our Discussion

Question

My lawyer filed a NOD/DRO Review for my initial denial. To make a long story short the c&p examiner wrote down his own answers to the questions he asked me. He also stated he read my file I see a local VA Psych in my town and he does not agree with it either. I recorded my entire c&p because I live in a one party state. My attorney had the recording transcribed and his answers he typed in do not match the recording. Is there anything I can do with this information to help my NOD move quicker. I do have some NM evidence to turn in but I was just wondering about the recording. Thanks for any advice.

It would be best if the VA were required to record video and audio of the exam and retain it as a matter of record.  This would be a simple undertaking for the most part and require very little training for the examiners to accomplish.  It wouild be as effective as a dash cam in a police car, protecting both the examiner and the Vet from any conflicts.

 

It would also force the examiners to complete proper evaluations and report them in full, without omission, so that the whole truth is used in our claims.

Independent Medical Exam..........

In the ideal situation, we all could get IMO/E for our claims.  Unfortunately many vets are not able to afford them, and rely on the VA to conduct these for them.  A large number of those are declined, leaving many vets out in the cold for conditions they acquired in service to fend for themselves, in poverty.
