My Dead Husband Just Got A Va Letter In The Mail

My husband just got a letter from the VA.

Although he has been dead for over 20 years, they said they received his January 6, 2012 NOD and asked him for more information for his claim.

He has 30 days in which to reply. and they even attached a I-9.

Any suggestions as to how he should reply to them?????

He is 6 foot under at the Bath NY VA National Cemetery in the cremains section. with no internet service or a PC,or phone.

( YIPPEE ...the one good thing is that the Director of Buffalo (in what is obviously another snafu) gave me another victory today ----Thursday by phone and also in email she sent to me, (documented proof I sent to the IG) she had tried to manipulate my January 6, 2012 NOD date to be established as filed on April 2015.and I contacted the IG Thursday when she hung up, and sent her, Sec MCdonald, ,Allison Hickey , and Jeff Henderson . (VACO) a copy of my IG hotline complaint as to this manipulation of data by a senior VA official)

My dear husband must be spinning in his grave at all this crap.

The Katy Couric show wanted me on after they read my testimony re: Shreddergate (2008)

This interview was set up by the original VA Watchdog, Larry Scott.

But there was no way they could get a camera crew here, or that I could get to a NY TV station to tape the interview ,in time for the show they did on Shreddergate.

However now I could get to a closer TV station and would rather be on Fox News (CH 360 on Directv ) because they always report every VA scandal.

I told that QRT chief in VACO to watch for me on Fox.

Since the VA has acknowledged the proper NOD date in that letter to Rod, I will promptly email the IG with that info, and ask the IG again, who got my money. (GEE maybe Rod did, but the cemetery has no mail boxes for the interred there)

I told the director this past Thursday that I am gathering evidence of every financial error they have made on my claims at this RO since 1995 and every piece of evidence they withheld from the General Counsel for my FTCA case.,and from posthumous C & P doctors. It wasn't just one of them.and will send that info to the IG.
( and to Fox of course if it gets that far)

I think the only reason she even fixed my NOD date so fast was because of what else I told her I would do.

All of above past errors I succeeded in getting corrected and have all of my awards.It took weeks and then years in some cases.

I am sending the IG the 2008 H VAC testimony I gave, as well

The point is, this all proves how incompetent my RO is, and worse yet how they treat claimants.

The VA could have , years ago when I filed this claim, done a simple audit on the 2012 decision to resolve this.The audit would have verified the 6 months payment.

Then the March 2015 CUE award letter I got recently would have awarded the additional 16 months, because I didnt get those months of accrued.from the past 2012 deision. .Simple as that.

The RO told me the claim was with a "specialist" for many months in 2014, yet that "specialist" did nothing with it.They could have done a simple audit.

And the recent 1151 HBP claim VA opiner was, I am sure, one of the raters , and not anyone with any medical background.That too is going to the IG. A Denial and award within one month....that too shows it often takes a battle to get RO thumbs out of butts.

I made it crystal clear to the Director of my VARO Thursday that I do not intend to let this rest and will do all I can to get it corrected, and was again emailing the IG as to what she had just said to me....that is didnt say....she would not answer a simple question....will you (VA) finally read my evidence?


There are plenty of good advocates here and my only focus here lately has been on some legal nuances that cn help others.

Tomorrow I must get back on the VA battleground.

I would love to see you on FoxNews. They have no problem reporting on VA problems such as yours. I could only imagine how Bill O'Reilly would expose this or how Megyn Kelly would talk about this scandal with that perfect disgusted look and tone of voice only she can give to the audience. You should email them your recent VA shenanigans.

Your husband sure hit the wife lottery when he first met you.

I'm sure you are aware, but if not, did you know that the USPS has a "dead letter" office? Maybe the VA can send your husband's mail there? Just a thought.

I'm with Julie1975, I would so love to watch Bill O'Reilly open up a can of "whoop ass" on the VA!

As for your misdirected payment....it sure will be very interesting to learn who got you and your husband's hard fought, and muchly deserved compensation.
