Question

This is response today,  I got when asked Mr. Ted Ebert to help me in my attempt to get my NOD/request for De Novo review moving. It has been over 2 years and still nothing.

 

Good morning XXX -- it's unfortunate that your appeal has taken so long to
address -- that's what limited staffing leads to -- sadly.  I will be sure to
make your Regional Office keenly aware of your concerns -- and your
frustration with the speed at which we're working to resolve for you -- 
please -- although I offer no excuse -- and my request for your patience is
not fair -- I must ask for it, nonetheless -- as we're working on appeals that
are actually older than your's right now.

Right now -- we owe you decisions -- on both of your appeals -- so, the ball
is in our court -- if we find in our De Novo review that additional evidence
is necessary -- we'll delay another decision until we obtain that evidence -- 
if our De Novo review shows that we've got everything -- then we'll make
another decision --

I'm sorry I couldn't bring you more positive news.

Ted Ebert was appointed by Allison Hickey for what was called the "correct a claim project." Basically, if the VA committed an egregious error in processing your claim, you could reach out to him and another guy named Charles Moore I think and they would work the claim from their end.

Ted actually lit a fire under the Nashville VARO and fixed a 14 year old contention for me. I went from 10% to 100% within 20 days of emailing him. Of course the local office gave me an effective date of last month for injuries that got me discharged 14 years ago which is to be expected.

I emailed them about it and they basically said to get bent and file an appeal. When I told this to Ted, he assured me he was already looking at the effective date because it is obviously wrong and that he wants it fixed without another lengthy appeal.

I think he is doing what he can but that is has to be a case of CUE before he can get involved.

My question is why can't we have someone like this in every office to make sure that the claims are processed accurately in the first place?
