11cvolley
Just wondering why I would be denied IU for granted 100% p&t with no future appointments needed? Would they deny me IU because it doesn't matter or because 100%pt is greater than IU?
0 Gastone
The (SGI age factor 65) definitely comes into play for Earned Income SGI, not the actual IU. VA uses an 'Earned Income Level threshold of $12,400 under 65 as apposed to the 65 & over threshold of 11,400. Is the $1K per yr a big deal, probably could be, even though it's only $19.00 less a week. (2) Vets I know, 72 & 70, just recently got their IU DRO Awards. Both Awards were made possible by the VA Vocational Rehabilitation Denial Letter, specifically indicating that regardless of their advanced education and employment experiences, they were currently unable (due to their PTSD SCs) to do even Sedentary Work, thus taking the original Rater's reason for their Denials, off the table. Awards of IU T & P No future Exams were made in both Vets cases. Highly unlikely that any change in their PTSD SC is probable or even possible. As opposed to a relatively young Vet, that hasn't lived with the PTSD symptoms for 30/40+ yrs. An improvement in a young Vet's MH condition, with treatment is often expected. You'll note, VA Regs stipulate age 55 as the cut off, for Diary Dated SC Re-exams. Young Vets can expect re-exams to be Diary Dated, every 3 - 5 years. However, a Vet filing a New Secondary Claim after 55 could and should expect a C & P for both the new DX and the Claimed causative SC. 11C,the legal term is "Moot." The 100% Scheduler Award makes even an "Inferred IU Claim," Moot. Wolf88, give that a rethink. For a very large number of DAV SC at 80 or 90%, it's almost impossible
