VA Proposed Rating Reduction & eBenefits

Hi, all.  

I searched high and low for an answer to this question, and I figured other veterans might be curious if anyone knows the answer, too.  When the VA schedules you for a reevaluation of your already service-connected compensable disability, one of the possibilities is the VA could draw the conclusion that your condition has improved and propose a reduction.  For that process, the VA is required to notify you of the proposal (this will be by mail, most likely) and afford you time to respond.  However, my question is this:  most of us use eBenefits to track the status of our claims.  When our claim moves to "complete," we go to the "disabilities" tab to see the percentage or check out the VA Letters (i.e., VB8) to see percentages, compensation amounts, total and permanent status, etc.  This is usually a week or two ahead of the letter arriving in the mail.  

 

Question: If your claim moves to "complete" in eBenefits, and the VA decision is a -proposed- rating reduction, will the percentages change in eBenefits?  or the Letter Language?  Will a new claim appear that says "proposal for reduction" or something similar?  Just curious what eBenefits looks like when your claim moves to complete and the VA decision is a reduction.

 

eBenefits is unofficial, of course.  :)

I cannot answer that question but I am curious how long your rating has been in effect.  That has a lot to do with what they have to do to reduce you.  I was reduced once many years ago but that was before ebenefits.

The rating the VA is reevaluating has been in effect since 08/2011.  The VA reopened the claim on 09/2017 to do a reevaluation (decided to continue my rating based on medical evidence and did not do a C and P.  Then the VA said "oops, we should have sent you for a CP Exam and re-eopned it haha) and it is now showing as "Pending Decision Approval" in eBenefits for me but my AB8 letter and other VA letters are not showing up anymore.  

I would be surprised if it is reduced but it got me wondering if eBenefits would change at all if the claim "closed" since technically, your rating isn't reduced until you have a chance to respond.

No they can't change your rating % until they prove you have indeed improved with your S.C. Conditions and they will if you fail to appear for your evaluation. or until your claim/case has been fully adjudicated.

if you get a letter proposal to reduce you have 60 days to file an appeal and most cases can be solve at a DRO Hearing, after the DRO Hearing and he can't solve it or still proposes to reduced you can file appeal to the BVA  but most cases won't go that for if you have probative evidence that your condition is the same or worse.

Sometimes these evaluation  for proposal to reduce can turn in the Veterans favor and get an increase and not a reduction...depends on if you get an IMO from a Dr (specialist preferred) that your condition has got worse.

if your s.c. condition is still  the same  then no reduction will take place.
