Claim Returned, Migraines at 0%?

Question

Hey All,

New to this, so appreciate the help. My migraines were granted service connected, but at 0%. The only info they asked for was how often I had them and if they made me lay down. I said they did, and that they are apx 1x/mo. I was surprised to see a 0% rating.

What do I do now? Do i need to see a neurologist, or should I just keep journals. What is the best way to appeal?

Appreciate the help!

My husband just won an appeal at BVA for an increased rating from 30% to 50% on migraines.  He sent in Medical records dating back to 2002.  He had a DBQ from his neurologist as well. His are completely prostrating and debilitating and occur 3-4 days a week.  His records showed all the medications the private and VA doctors have tried and all his prophylactic medicines he has tried to prevent onset.  His first hearing was in 2009 (for which he received a 30% rating in 2011) and his second hearing was in 2017, for which he was granted the increase to 50%.  He is no longer able to work because of them.  That's the evidence we had.  I would definitely get a neurologist statement or DBQ.  Good Luck!

You should be looking at 30% by what you stated.

8100 Migraine:

  With very frequent completely prostrating and prolonged             50

   attacks productive of severe economic inadaptability.........

  With characteristic prostrating attacks occurring on an             30

   average once a month over last several months................

  With characteristic prostrating attacks averaging one in 2          10

   months over last several months..............................

  With less frequent attacks....................................       0
