Additional Evidence

Fat

Question

A group member submitted a fully developed claim for right knee secondary to service connected thigh (femur bone).

He submitted two years of doctor notes, a nexus statement, and physical therapy sessions notes.

Recently, he went back to the orthopedic specialist for a recheck and they filled out the DBQ.  In addition, he has four additional therapy session notes.

He wants to submit the DBQ and additional therapy notes.

Myself and another veteran said that would move his claim to the standard claim lane.

Should he submit the additional evidence now or wait to see how the claim is decided.

Does the regional office request additional information for fully developed claims.

One thing we all agree on, if denied, send the matter directly to the BVA with waiver of regional office form (with additional evidence to submit).

I would suggest submitting the additional evidence. Anything that helps his claim to be granted  should be submitted. I don't believe it should slow down his process, but if it does it will be well worth it to have his claim granted. The effective date will be the same.
