Question

Thanks Broken soldier, I found it and correct me if I'm wrong. The Dr stated that my knee has gotten worse. He said that I have chronic residuals consisting of severe painful motion or weakness. When I look at the rating for that it seems like 60% to me, but will the VA see it that way or make their own determination? Thanks

We’re not doctors, we can’t diagnose. So whatever they doc wrote unless there is more than one source that says otherwise that’s relatively more current current is usually how it’s supposed to work. I’m not a rater, though, so there is probably more to it than I see.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

Once service connected, the Veteran is rated on symptoms.  To get an idea of your rating, you can compare the symptoms YOU have DOCUMENTED BY A DOCTOR, with those in the criteria:

When you get the rating decision, if you feel YOUR knee deserves a higher disability percentage rating, then appeal it by filing a nod.

You also might have to do some digging-there is, unfortunately, rarely a doctor that lists all your symptoms for a condition in 1 place.

I usually open up Capri records and CTRL-F for the body part ("knee", "foot", "headache".....you get it) and then find as many instances as I can, then note the symptoms for each and annotate the record. In the subject line of the PDF I put page numbers, that way the rater can to the CAPRI dump that is 800 pgs over 5 yrs and quickly find whatever contention youre claiming. 

 

You can do the same with your own, just download off of myhealthvet for a date range, download the PDF, and get to searching. Sometimes ya gotta roll up the sleeves! 🙂
