Does the VA pull back or pro-rate disability compensation for the month of death like Social Security does?

They I dont know. I don't ever work with champ VA except personally w/ dependents (my own)

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

A good question-

I received CHAMPVA due to my husband's 10O% SC P & T posthumous award for PTSD.

It went back to a very favorable EED after a battle to get the VARO to read the evidence they had.

It has continued ever since.

Section 1151 DIC (death by VA)does not grant CHAMPVA  but my Section 1151 DIC award became a direct SC award due to subsequent SC death  awards. But my CHAMPVA for the 100% SC P & T never had to be changed. 

It is a GREAT program-I only had one problem (with a non -VA pharmacist) and CHAMPVA immediatey corrected the problem, by contacting him directly. He had told me that a prescribed med I needed would not be paid by CHAMPVA. I knew he was wrong. About 10 minutes after I called CHAMPVA,when I got home,  the pharmacist called me to tell me my cash med  payment less the deductible, the would be refunded.

icon form with checkmarksTo be eligible for CHAMPVA, you cannot be eligible for TRICARE, and you must be in one of these categories:

  1. The spouse or child of a Veteran who has been rated permanently and totally disabled for a service-connected disability by a VA regional office.
  2. The surviving spouse or child of a Veteran who died from a VA-rated service-connected disability.
  3. The surviving spouse or child of a Veteran who was at the time death rated permanently and totally disabled from a service-connected disability.
  4. The surviving spouse or child of a military member who died in the line of duty, not due to misconduct (in most of these cases, these family members are eligible for TRICARE, not CHAMPVA).

An eligible CHAMPVA sponsor may be entitled to receive medical care through the VA health care system based on their own Veteran status. If the eligible CHAMPVA sponsor is the spouse of another eligible CHAMPVA sponsor, both may now be eligible for CHAMPVA benefits. In each instance where the eligible spouse requires medical attention, they may choose the VA health care system or coverage under CHAMPVA for their health care needs."

I cannot stress this enough-please make sure your spouses are up to speed on your VA issues.

And make sure they know how to use your hadit password, or join as a new member ,if they ever need to file for DIC.

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.
