Va Dr requested Smc aid and attendance?

Question

Greetings to all, I haven’t posted in awhile and was kind of puzzled when I decided to check vet.gov. this morning. I happened to see a claim was opened and didn’t know why was this open? And who did this? So I clicked under the detail tab and seen SMC. Now I’m 100 percent already and only have a active appeal on file which should be over with soon hopefully but now this. A couple years ago I had file for SMC aid and attendance but was denied. Called the 1800 # and of course of no help, only thing he said was your Dr. requested this and to get in touch with them. I have DAV as my rep but no answers from them as of yet. Any suggestions or advice? Had this happened to anyone? Can their Drs request this on my behalf? Thanks for any input

Not a doctor, but if a claim was re-examined- past or current- and it was found that you qualify for an SMC then you could be. SMC can be inferred or statutory awarded. Depending on what the appeal is this could be related

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

Your Drs notes are always helpful, maybe va found an error from your past claim during an audit…just a guess tho.

Appreciate you guys input as I hurry up and wait. My appeal is regarding my tbi which is not service connected and was remanded. Not sure if it is because of this, I haven’t got any answers from DAV. Maybe my appeal is connected to this some how…

SMC's are often granted with TBI, so they could be doing an SMC opinion only request in conjunction with your appeal for TBI as part of the remand.

I’m sure hoping you’re right lol cuz this been a long journey which seems to be having light at the end of the tunnel. I’ll keep y’all posted on this as it seems to have no deadline to when this claim will be finish.

*Update claim is in preparation for decision already. I don’t know whether that’s a good sign or not but it’s moving fast. Claim was in on the 3rd and now almost a decision.

Due to your previous filings and/or present situation they determined you qualify for SMC-S1 or S2.  Congrats. You should receive details in the mail soon.

My comment not legal advice as I not a lawyer, paralegal or VSO
