TBI claim for SMC-T

Rate this question

scarf

Question

I am 100% P&T for PTSD and I just currently filled a new claim for residuals of TBI for SMC-T. I worked under 100% P&T; however, I stopped working due to dealing with the residuals of my TBI. VA just updated my claim for me to complete a TDIU form. Will this jeopardize my P&T status already for PTSD?

You are right I am wrong does make you feel better lol

The fact of the matter is simply, if I had taken your advice, I would have lost a nice five figure retroactive paycheck above my already monthly payment. As stated, many times before our experiences are different. We are in the same boat as to fighting the VA for our deserved benefits and even though we may disagree, our focus should be on helping veterans and not who is right or wrong. Once an opinion or experience is posted, there is no need to come back multiple times and try to correct another person's post if we disagree, let the veteran ask more questions. If they need but don't try to force our experience on them because it may not work. I have posted that the VA is so screwed up. What one VARO may grant another may not and what one service connect another may not. Let’s give the veteran our best.

My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions.

Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up.

I do not give my consent for anyone to view my personal VA records.

Why do you feel that you have to pull me in everything you post.

I haven't post on this thread in days but you feel the need to keep attacking me.

I didn't and have never give you any advice. I don't give advice.

I give my opinion on things

You so fix on me you can even address the post.

Enjoy your day

Like I said if the VA wouldn't process my claims I apply for smc t and TBI.

Until I apply for tdiu and I am 100% for PTSD

I would withdraw the claim and start new.

But also I feel a writing statement stating that you are applying for smc t and TBI. An not tdiu should do it.

we are all just stating our opinion not give advice.

I don't understand why you keep talking about your win.

8 year tdiu extra schular won with no lawyer based on a cue I did. 6 figure Based on my own knowledge. Not a lawyer.

So I think there is no need to put our winning out there. Smh

Pacman, I was pro se all of the way up to and including R-2. After I won the R-2 I filed for an EED for R-1 and took that all of the way up to the CAVC level pro se. At the Court I won a JMR with EAJA paying the Court $4700.00.

Once I got the JMR from the CAVC I retained a legal team to get a new BVA decision which was remand back to the RO where it was again denied. Next it went for a HLR where it encountered a failure of duty to assist and was finally won in a supplemental claim whereupon I owed the 20% of retro which cost me $36,000.00 plus $500 for the cost of an IMO that was advanced by the law firm.

So, the law firm made more than $40,000.00 because they represented me in filing for an EED. Gross retro was $183,000.00. Was it worth it? Do your own math while I go invest the money.

Mr Cue, If you remain pro se at the Court, I have a lot of respect for you and I wish you luck.

@Mr cue I just wanted to give an update that I took some of your advice. The VA just awarded me 100% TBI.

Nice!  So you have two separate ptsd & tbi claims approved at 100%?  That is crazy rare if so.  Did they put you through the wringer of c&p exams for the TBI?  Did you get SMC-T approved as well? If so, I'd like to know what that entails, if you don't mind sharing.
