BVA Direct Review Timeline

Question

Submitted a BVA direct review 1-11-22. They advertise "average wait time" of one year. In about 2 weeks, I'll be at two years. It has said waiting for a judge to review this whole time. Recently I was told by a VSO that they are just starting 09-2019 appeals. Any one have any insight or personal experience? Thanks.

Unfortunately, there is no “average wait time.” There are a few of us and maybe even more in a similar situation with even longer wait times. I myself am in the same boat but I filed a simple EED (Earlier Effective Date), and the VARO sent me to an updated C & P exam and the examiner included my onset diagnosed date and my VAMC treatment progress notes which were way earlier than my assigned effective date, but the VARO still denied my claim. I then filed a supplemental claim pointing out the error, but the VARO still denied my supplemental claim.

My appeal is past the two-year mark going on the three-year mark with no insight of actually getting to be reviewed. It says that it is on the Direct Review Docket waiting to be assigned to a judge for review.

Within past four years I had two BVA appeals with a favorable outcomes.  One was a direct review and after one year in waiting I turned 75 and the BVA by their own rules then expedited my appeal and an award decision was issued within a few months.  There are other reasons the BVA will expedite your appeal besides the age factor. Check into it by visiting the BVA website.

I filed in 10/2020 and mine was just assigned to a judge last week. My attorney told me that once assigned to a judge it is any day now for results.
