TDIU Vs Combined Ratings

Rate this question

Ikey

Question

I was awarded 80% combined rating in Oct 2018.

I was awarded TDIU P&T on Nov 17, 2021 granted by the Veterans Board of Appeals. The San Diego Regional Office said nI am not 100% but 80% but the VA is paying me at the 100% ratings.

They keep my ratings listed at 80% when I log on and on E-Benefits there is no mentioning of the TDIU ratings. They keep showing my 80% combined ratings that is hurting me from getting what a 100% veteran is entitled to get like free vehicle registration and property tax exemption for totally disabled veterans. I wrote the IG on two occasions and he told me to take it to the regional office and let them correct it, and the second time I wrote him he provided me a 800 number to call. I called the 800 and filled out a case request. I was contacted by a veteran advocate and the first thing out of his mouth was what do I want? He said I was only 80% and he was not going to change it because he do claims everyday and the judge at the board of appeals do not know what he is doing. When I showed him the paperwork that says I am 100% he said that the judge do not mean that. We go into a heated exchange and he hung up in my face. What he didn't know is I had met him at a veteran support group in Santa Ana at an attorney office. He came riding his bicycle. I showed him a comprehensive report that I had obtained from the EPA detailing the various chemicals that I was exposed while stationed at the base. He said that is a good report then he said it is too much information and no claim adjudicator will take the time to read through it. I asked him for a business card and he took one of his cards and scratch off some numbers and rewrote some phone numbers on it. When I returned home I tried calling the numbers he wrote down and all of them were out of service. How can my ratings be fixed and this employee disciplined?

Also adjudicator or claim analyst needs to read raining Letter 07-01 Total Disability Ratings Based on Individual Unemployability (IU)

100% UI 53122.pdf

You're aren't 100%, and your state and county, even, can make their own rules about whether they accept TDIU the same as a 100% schedular rating. My state, for example, does not. If you aren't 100% schedular you don't get property tax exemptions, etc. You are not going to see 100% reflected when you log into the computer because you aren't rated 100%. They're isn't anything for the RO to correct.

Have you tried va.gov and to print out a benefit letter? You can customize this letter where you can omit (not check) your rating percentage and check that you are being paid at the 100% rate because you are unemployable. Check it out. States are different and some do, and some do not take unemployable benefit letters.

Where are you living?

va.gov also shows 80% and not 100% that the board of veterans affairs granted me. I live in California and went trough hell to get the VA exemption and get my VA disable license plate after talking to the DMV supervisor. I have friends who are TDIU and are rated at 100%

CalVet Veteran Services Property Tax Exemptions

The Disabled Veterans' Exemption reduces the property tax liability on the principal place of residence of qualified veterans who, due to a service-connected injury or disease, have been rated 100% disabled or are being compensated at the 100% rate due to unemployability. An unmarried surviving spouse of a qualified veteran may also claim the exemption.

va.gov benefit letters, when you click on the checkmark where it says your combined service-connected evaluation is, it will remove this line and will not appear on your letter. That is what I mean that you can customize this letter to show what you want. There are agencies and or places that don't need to see all your information to assist you.

Wyoming does by combined rating for most things.  There are some things that TDIU apply. Depends on what you are applying for.  Auto license plates are free for 70%.  Reduction of property tax the same.  Hunting you have to be able to shoot the game yourself but you can do it from a vehicle.  Kind of a reverse.  Fishing free.

Depended on the mood of the legislature.

Its time for the "teenager method" that rarely fails me.  Always remember:

Quote

The VA is NOT a unified Body.

If you dont know what the teenager method is, here it is:  If you want someting ask dad.  If he says No, Ask Mom.  If Mom and Dad, say NO, Ask Grandma.  If Mom, Dad, and Grandma say no, ask your teacher, then tell Mom and Dad, "the teacher says we have to _________" Teens have used this for a very long time.

Eventually, you get to someone who says yes.

If employee A says NO, call on another day, another time and ask employee B.  Remember, PEOPLE are DIFFERENT, and their views, including opinions about Veterans vary widely.  Just because "they all work at VA" does not mean they all treat Vets the same way.

Persistence works when giving up and quitting almost never does.

This should work for VA, and it should work for your local government also.

REMEMBER< THO:

Quote

It works best when you remember to Always be nice and polite;  Dont try to get "revenge".  Your revenge is getting what you want.  That should be enough.   People like to help people who are nice and polite.  Not so much the mean, nasty, and revengeful.

EXTRA CREDIT:

Instead of being revengeful, be THANKFUL.  People will remember you when you "show appreciation" and they will want to help you next time, too.  Thank them, and show appreciation.  Do something nice for them, such as tell their boss they are doing a good job (if they are, dont lie, it messes everything up).
