Dear Honorable Members Of The Veterans Affairs Committee
Dear Honorable Members of the Veterans Affairs Committee, I voluntarily served 28 years of active duty in the United States Navy. My career was not without danger or armed conflicts. In doing so I committed myself to respond the many actions that U.S. Armed Forces responded to such as: 1982 Multinational Force in Lebanon , 1983 -- Grenada Operation Urgent Fury, 1986 Libya. Libyan Patrol Boats On March 26, 1986, US forces, while engaged in freedom of navigation exercises around the Gulf of Sidra, had been attacked by Libyan missiles, On April 16, 1986, U.…

Va Disability Percentage Increase
I have searched less than diligently on this site and cannot find an answer so I hope you don't mind possibly repeating an old answer. I have 60% SC disability and SSDI. I have had both hips replaced and now one knee has been replaced. My surgeon (who was an army surgeon way back) says the need for the replacements was most definately caused by my wartime injuries. I sent a letter off to VA requesting a reevaluation. A few questions...Does being 100% disable from Soc Sec make it easier to get 100% VA disability? How long does it usually take to hear from VA regarding reevaluation? Is there any chance that I would lose the 60%? Does the VA ever consider the opinions of my…

hypertension New Hbp Reg Change
Someone here was denied HBP due ti a change in VA "policy" I think their denial said- In 2004 the HBP regs did change- they had a decision that referred to VA policy as SCing HBP only if it was due to diabetic neuropathy- The change to the reg states: "k. Diabetes Mellitus and Hypertension. When a veteran is service connected for diabetes mellitus and diabetic nephropathy, and has a diagnosis of hypertension, review the medical evidence and determine when the hypertension was diagnosed relative to the diabetic nephropathy. Then: (1) If the medical evidence shows that hypertension was diagnosed after diabetic nephropathy was diagnosed, grant se…

Limited Motion Due To Pain
LIMITATION OF MOTION DUE TO PAIN APPLY 38 C.F.R. § 4.40 § The Court has held that when the VA evaluates a disability which causes limitation of motion due to pain, the additional factors involved in a disability evaluation, as described by 38 C.F.R. § 4.40 (1995), are also required “to be considered and portrayed in the rating examination as to functional loss on use or due to flare-ups.” DeLuca v. Brown, 8 Vet.App. 202 (1995). Does this mean that one should be rated at the flare up level?

ptsd Can You Give Me Some Insight?
I just came home from seeing my psychologist. I gave him the PTSD info someone suggested along with copies of letters from people I knew in the militaryI took in on my first visit. He reviewed it and said, it will entail an 8 hour testing procedure and in his experience, only 5-10% of cases were approved at the VA for compensation. I am trying to be positive about this but he didn't sound positive although he said my depression was from moderate to severe. He said I might check out some VA groups such as DAV or go to some PTSD groups at the VA. I wonder if: (1) I should go ahead with him and take the tests at his office or (2) Find out from him what kind of tests…

tdiu How Does My Family Surive?
I am over all rated at 90% of which 60% for compression fracture of lumbar spine alone and numerous others to include chemical burns at 30%, depression at 30% and 5 minor things at 10% each. Three years ago I was making 80k with a MA degree in HR and my SPHR certification and then my neck started to hurt one day at work. I ended up having to have a neck fusion. I was out of work for a long time so I was let go when the company was sold. I started out at the bottom in federal civil service as a GS-5 in a developmental position to GS-11 because I wanted the job security for my family. Last year 2006 one of the fusion plates came loose from my first fusion and they had …

Original Claim Listed Sc Issues, does That Matter To Sc Issues Now?
A true story, A long time ago, I submitted my disability concerns, however did not properly describe or develop them. During outprocessing the presenter said "list" all major problems that occured during service. Well, I did that and now wonder about a CUE. Maybe I am way off track, I did request compensation for orignal SC issues, got some approved and some not. VSO was ancient, nice guy but merely presented me the forms for Disability Compensation. One of my current claimed issues was listed on the original. Ideas? thanks. cg
