tdiu Chap 61 Rets With Less Than
the quoted email below is from alamostation at ALLVETS,Inc. The issues of CRSC and CRDP have smoothed out significantly since they first became important veterans issues. This can affect 183,000 retried men and women who are certainly "disenfrancised" as this email states. We recently got a member here who probably falls into the "glitch" that I call it- or disenfrancisement or discriminationation is a more appropriate term. This bill would involve CRDP as well as CRSC consideration for all Chap 61 disabled veterans who served less then 20 years DUE to service disability as well as repeal the 10 year phase out for CRDP and rectifu the unfair situation that those …

Regarding Pemanet And Total Disablity
Hi everyone. If we decided to do an appeal on a earlier effective date, and Cue, because the VA as never admitted to my husbands back ever being broken while in the service. Now in 03 they did say he was able to get paid at like 100% but because I was we were still angrey because he broke his back in 1979 and they still don't want to be held responsible. My question is the letter that was sent is so confusing and I would love to fax or to have someone read it. That way I would know what I should do....I have an appeal 9 and I really don't want to file that because I am afraid that would piss them off more and we won't get nothing. To tell the truth we can't give this …

Good News....i Think....need Help...
Hi All, I received a letter from the DAV saying that they have reviewed the most recent VA decision concerning my claim for benefits. According to them the VA states the following: QUOTE"1) Evaluation of irritable bowel syndrome, which is currently 10 percent disabling, is increased to 30 percent effective February 2, 2006. "UNQUOTE Now, presently I am 50% for Major Depressive Disorder with Psychotic Features and 10% IBS (Irritable Bowel Syndrome). My total disability rating as of now is 60%. At this point do you think the VA will increase my overall rating to 80%, which would include the 30% increase, or will they figure this another way? How long do you…

I am happy to discuss with you, Ranking Member Akaka, the members of the Committee, and your staff, what we believe are the reasons for the increase in the number of appeals to the United States Court of Appeals for Veterans Claims (Court or Veterans Court), whether we can expect that trend to continue, and what measures may be taken to assist the Veterans Court in handling this increased workload. With me today before you is R. Randall Campbell, Assistant General Counsel,…

Now I Am Really Cornfused!
For those that recall I had a IU claim pending since 5 July, 2005 which was deferred by the Tiger Team in Cleveland in Jan '07. (My claim was farmed out by my Chicago, RO to Cleveland Tiger Team). When I inquired about the deferred I/U of the Chicago RO back in early March, they stated they had just received my file back from Cleveland and would look it up. On 16 March, the VA via IRIS stated my claim was pulled and sent to the rating board. On 22 March, I received IRIS response stating that a decision had been made and I would receive the decision by mail in a few weeks. I talked to the VA this morning and was told the decsion was to send my file back to Clevela…

Term: Writ Of Mandamus
Term: Writ of Mandamus Definition: A writ of mandamus is an order issued by a court to compel an agency to act on a decision that has been unreasonably withheld. It is used in the VA context when the VA simply does nothing on a claim after you have asked that it be decided. It cannot be used to compel a particular result -- say, service connection -- only that the VA go up or down on it.

Task Force Deadline And
The deadline for Task Force comments is quickly approaching- I think April 30th? and I am almost done with my letter to them-I had to make comments as a widow and claimant that would be appropriate to consider for the new returning disabled veterans. It took some time to do that. The Fallen Heroes are the main focus of this task force but we were all asked by the VA for input on this and who better knows what these new vets can face in medical care and claims issues than all of us here. It is how Lessons Learned in Battle actually become lessons learned- and the Task force is using this approach. Question- in order to get the Task Force's attention- I am u…
