Go With Cue Or Review?
I'm needing some help in deciding what to do next. Apparently my claim has been at the DVA, apparently sent their by my local VARO for their input on my claim. They inturn have kicked it back, asking for either clarifcation of the CUE claim or whether I would prefer a review of my records for a reconsideration of their previous findings. My DAV SO is only here temporarily and today is his last day, A new SO will be taking over at the end of the Month, so the Temp SO has requested my records so that when the new SO gets here we can pour over everything and dicide which path would be most probative to me at this time. I have a good CUE claim for violating VA Law …

Va Coverage After Bankruptcy
Question! I am wondering if the VA can stop supplying you with medical help, including prescription medicine, if you file bankruptcy, which will cause the VA to have to eliminate some of the cost of prescription medicine you owe?

Suing The Va
I would like to know, what the first step is, in trying to sue the VA for poor medical care, without a lawyer. I know you can't sue VA doctors, so have to sue the va instead, or do you file some kind of a claim for poor medical care.

Over 2 Years For C&p Need Help And Advice
JAN 6th 2006 I need some advice on my C&P. I first filed in Feb 2004. Here is my background data: Active Army officer for 6 years (81-87) and I still am in the Army reserve with a total of 25 years. I have a reserve “20 year letter” and three years left before mandatory retirement. I was called to active duty twice for Operation Enduring Freedom (stateside Service), so I have 3 DD-214’s. My Army reserve job is using computer simulated war exercises to various unit command & staff personnel. I live in Houston, which has a VA hospital and a VARO. I filed in Feb 2004 for the following :Severed ligament on right wrist which was repaired with reduced range of…

Question On P@t
I AM CURRENTLY AT 90% BASED ON THE RATING SCALE (70,50,20,10,10,10). I HAVE FILED AN INCREASE IN ONE OF MY 10% AREAS (migraines)- the CP exam and my PCM report reflect the correct wording to bring that area to 50%- This should bring me to 100% based on the rating scale. I have not worked since Jul 04, when the military medically retired me for depression (after 24 YOS). I have not filed for IU in efforts to get my rating scale to 100 so I can get full concurrent receipt. My question is how does one get the VA to call me 100% P&T so my childern and wife can go to school? Any suggestions and comments are welocme Raven B)

ptsd Va Denied Me
Well the VA denied me again, I just got the word in the mail the other day. the denial letter said that i basically have everything there looking for except the stesser, (ptsd) i have the diagnosis, nexus im on disability for the same thing but, of course they denied me for the stressor telling me that there wasnt enough evidence to support it in my claim. My claim remains open however. Luckily within the last week i was able to contact two key people in my claim. One of the people was there at the time it happened and saw the whole thing and was in the same unit i was in. the other person i finally was able to find after all this time(incident happened in the 80's) calle…

This Weeks Cue Claim Update, Dec. 10, 2005
I made my weekly call to the local VARO and got, what at first was disturbing news on my claim, the way the phone person was relaying the current statis of my CUE Claim, I thought that they had made the same mistake and were looking at it as a new claim for new and material evidence. I called my DAV SO right away to get their view as to what was going on and they were able to alay my fears and explain things so that I could understand what was happening. The Claim is a new claim, but is looked at in light of Clear and Unmistakable Error and not for new and material evidence. It was explained to me that the CUE claim is a new claim submission but until the developtme…

Why Some Imos Are Not Competent Medical Evidence
Thought this might help in our discussions about IMOs that don't seem to be read or considered: Carrie The Board cannot make its own independent medical determination, and it must have plausible reasons, based upon medical evidence in the record, for favoring one medical opinion over another. Evans; Rucker v. Brown, 10 Vet. App. 67, 74 (1997). With regard to medical evidence, an assessment or opinion by a health care provider is never conclusive and is not entitled to absolute deference. Indeed, the courts have provided guidance for weighing medical evidence. They have held, for example, that a postservice reference to injuries sustained in service, withou…
