So, Hamslice their is no age limit on iu? my huby is retired and gets his full retirement and gets 80% from va. He is or will be 72this yr.

Hume0351, what number did you use to call bva. We sent an iris over two weeks Ago. This is the first iris I have sent.

Thanks Paul. It is just frustrating. I mean I know when they pick up these appeals, it may be like a 100 at a time. Ours is probably at the bottom of that pile. I sent a iris in over two weeks ago, and we did not any thing from it. I worked at Navy kwest naval air station as a civil service employee. When I started that job the desk was piled up. I worked my but off to get caught up and no piles on my desk. I took pride in that too. Got an award for it. But I don’t think it is our civil service any more. It is not like hubby has twenty appeals here. It is two. Increase In diabetes and trying to get diabetic nephrology.. oh well maybe just another month or two or three or ten years.. lol good luck to all you wonderful people that have severed this great country.

Gastone, thanks for answering, all I know is it says veterans law judge. I did ask Vso if they could give info on judge. When hubby filed this claim he stated he wanted them to make the decision. I have no idea what that means exactly. Geuss I will just have to go back to the wait n see group. You ask what his docket number was, well it was 1502319, but the Vso found out it the form nine was was signed on the 12/14instead of 2/15, which is what we had been told by bva. So the Vso went over and made them put it where it was supposed to be. St. Let it set on someone desk I geuss.im just hoping for the best.

I posted a question yesterday, I thought. Ok here it is again. The judge picked up hubbys appeal on the 18th of April. For those of you that has gotten appeal results, how long fro: the time Judge picks it up till they have a decision. On vets.gov?

Thanks, Broncoim not new, just forgetful. My hubby is like his dad. They kinda look at something like th.is as a gov hand out. I’m going to talk to him about filing it after this appeal goes thru. I did put in on ebenefits an intent to file. So maybe we can file sleep apnea,and iu then. I promise I will try to remember to not hijack another post. sorry guys.

Don’t they have people up there ready to figure your retro? Lol. Does anyone have a good number to call bva, other than the 800 number. Would the Vso see anything different than we would?

I’d like to ask a question here. My hubby has an appeal in for increase in diabetes and for third stage kidney failure. He is at 80 present now.
20 present for diabetes 2
10 present for left lower neropathy
20 for right lower side10 present for histoplasmosis of the eye
60 present for ihd I think I listed all of them. On the appeal the doc, our family doctor wrote in his imo, that he is not able to work, and he is not. But my husband has too much pride and thinks it is some kind of hand out. His dad was that way too. But do they ever just look at the statement from the doctor and give the vet iu? Or is there a way to get it added to the appeal if we call them. It is before the judge right now. Could we call the Vso and get him to put it in? Or do we just wait and file another claim after this is taken care of. Thanks for any info you can give me.

Iragvet, have you heard anything else? It says my hubbys appeal is before law judge and his team.

Hume, I just looked vets.gov it says hubbys appeal is with a judge. I hope they make good decision and a quick on. Good luck to you! I needed to see this. I have been stuck doing taxes for three days. A simple simple 1040. First I waited till the last min to do our taxes. There computers went dow n the first day. And when I finally got to file it and they rejected it. So need I say it has been a mess mess mess. They told me our 2016 had been rejected too. How come this is the first we are hearing this. And hey we had to pay them. So it rejected my claim but took our money. Go figure. I’m taking a rest now from it, they can just fine me. And I paid them today too. So it rejected my claim again. We need to go to a flat tax.

Iragvet, May I ask what year and month was your dockett in. I’m still trying to figure my husbands out. They did move it up, because st Pete left it set down there and it got put in as a yr 15 docket they moved it to14. What exactly does a judge do? Just go over it and make sure he agree with what the rate you at? I’m just not sure

Paulcolirain, I thought you had to be75 or homeless, or really terminal to get advancement. Sorry I did not reply earlier, but I did not see your post. We did get a mistake fixed. They hey the wrong docket month. We moved up to dec 14. We should have put in for tdiu along with this claim also. But as soon as this appeal goes thru, unless by some token of luck they put him up to 100%, I’m going to have him to file for tdiu. I so happy for you though. It was a long hard fight wasn’t it?

Now instead of 55,587 we moved up to only 41 thousand something. So some one in st Pete let it set on some desk o4 box before they realized it should have already been in dc at bva.

And I saw on this that hubby had two exams for kidney. But he only had the one. Can someone weigh in here?

Hume0351, does it say that it will go before the judge soon for decision? My hubbys is Jan.15, and that is what his says. So your ahead of us. At 100 a day it still might take a year and half.

Ok went to vets.gov and it says hubbys appeal will soon receive a board decision. Would it be advantages for him to stay there or do the Ramp. Another question when you click on issues it shows he is asking for an increase in diabete. And on the other issue it says service connection for arthersclotic renal. He filed diabetic nephrology secondary to diabetes. The reason I’m concerned here is he was diagnosed with diabetic nephrology before he was diagnosed with cad. I’m afraid they are setting up to deny this already. Should we contact Vso?

I got into vets.gov. It says my husband appeal should be worked soon. And says they are working on feb 15 and older. What does that mean. His docket num is 15 02 319. Does that meant is feb. and number 319?

To me it sounds like he is saying that diabetes is not having that much effect on his kidney function. But the diabetes has accelerated all of his diseases. Which means they were all aggravated each other. Now he was diagnosised with diabetes actually in 99, but the va has it 2001. Diagnosised with aortic valve and mitral val insufficieny in 2008. Then in 2011 diagnosised with ckd. 2013 diagnosised with cad. Aortic valve replacement in 2013. He put in for high blood pressure I think when he got out of coast Guard in 92. They denied. And I believe he has put in for it since then. I looked at sir and he had high blood pressure in 86. They made him get it checked three consecutive days. It was high every day. And actually his sugar was on the high side then. Can someone opinion how this is going to go?

3.309(11-07-02) Disease subject to presumptive service connection
(a) Chronic dis3ases. the following diseases shall be granted service connection although not otherwise established as incurred inor aggravated by service if manifested to a compensable degree within the applicable time limits under3.307 following service in a period of war or following peacetime service on or after Jan. 1, 1947, provided the rebuttable presumption provisions of 3.307 are also satisfied.
