  1. Migraine is listed as a Compensation!! I just don't understand so is the Administratve review which is in Prep for decision on the other 3 contingents...PTSD, Hearing Loss and Tinnuitis?

    If you get the increase for migraines maybe you can ask for an earlier effective date if they don't go back to 2012.

    What is the status of your reconsideration? Have you checked your letters just to see if maybe your rating has changed? Mine did not have a good outcome. I had to submit a NOD and I am still waiting for a decision. I had a C & P for an increase in Sinusitis and that went well but they didn't ask for a any exams for my main contentions!

  3. My claim was filed June 11, 2012....At this time I had 4 contingents (PTSD, Increase Migraines already SC 0%, Bilateral hearing loss, Tinnuitis).

    I failed to report for a C & P I was denied claim Nov 2013. So then I ask for a reconsideration which resulted with 2 C & Ps 1) PTSD 2) Hearing Loss... PTSD C &P very favorable....Hearing Loss not favorable. So my case is still at Regional office in Little Rock. It says it an Administrative claim...What does this mean? Sooo in the mean time they date a new claim for increase of migraine Feb 2, 2014...How can they do this when my first file date was June 2012??? HELP DON'T UNDERSTAND WHAT'S GOING ON!!!!Just typed it in...thank you sooo much!

    An administrative claim or review? ..The reason I asked is because when my claim was finishing up the Administrative review popped up as another claim. I believe that someone besides the rater, like a supervisor reviews the claim for any errors or mistakes. As far as the migraines if you did not specifically ask to reconsider all the contentions they will conveniently over look something.

  5. Those two claims are probably easier than the others to process, only thing that I could think of. Good luck, be patient, and see what comes in the mail. My Lawyer called and said my SSDI was approved 2 weeks ago, and I have not received a Letter or Call from the SSA. So frustrating

    You can call the 800 number to SS and ask for the status of your hearing decision and they will tell you where they are in the process and when your letter should be going out.

  6. I was medically discharged from the military in 1997 due to migraines and upon leaving was given a combination of severance & disability lump sum payment. I filed a VA claim a few years later (2002 or 2003) for migraines and it was denied. I did not appeal that decision.

    I reopened the claim as instructed during 1/2010 the claim was approved at a 50% rating by 3/2010. I was surprised the second time around it was a very speedy process and took less than 3 months. Basically at the appointment in 3/2010 the VA Doctor examining me stated the original claim was denied with a comment stating I said I had migraines upon enlisting during MEPS. I told the VA doctor that was not true the question was do you have headaches and my response was yes and that headaches are very different than migraines. I was essentially approved for disability before walking out of that appointment.

    I recently requested my military records via e-benefits and there is no mention during MEPS of migraines or headaches on any of my enlistment paperwork. There is however substantial medical documentation during service of migraines leading to restricted duty and eventually medical discharge.

    I'm not sure how to get a copy of my original claim denial and what to look for in case there was a possible error during the original claim denial. Can anyone assist?

    Hello Kevin,

    Did you request a copy of your claims folder from your RO? It should have all of your military treatment records and everything related to your past claims including your SOC. Maybe someone else will chime in.

  7. Hello everyone... Thanks for the shout out... Okay so everything is happening sooooo fast which is why I said, NEVER GIVE UP.

    Retro hit the bank this morning!!!! I'm doing the happy dance for less than $6k but hey, when your cable is about to be cut off and the babies need a new pair of shoes, you will too. lol.

    Okay, so the case closed on Friday, Feb. 28th in ebenefits. Got the Award letter on March 4th. Retro in the bank this morning, March 6th. Won't GOD do it!

    Back pay was calculated from the date I put in for the increase. So, keep hope alive, don't give up and please take everything folks say with a grain of salt. Your case is different and unique. You are different. If I would have listened to folks who told me to let it go, I wouldn't be here today doing the happy dance. Soooooo, go be GREAT! You can do it!!!!

  8. MISSION ACCOMPLISHED... Thanks all who responded to me about my claim... Submitting the IMO worked! we filed for an increase from 20% for his knees and ended up getting 70 increase%.... Ain't GOD good!!!!!!!! So, never give up. Keep fighting and keep pushing. Don't get discouraged. Hold on! It's a long wait but when your ship comes in it's going to be worth it.
