  1. thanks for the responses, also in my denail letter it stated I get SSDI because I no longer want to work, HUH!!?? lol that's not how SSDI works!

The VFW is going to help me with the NOD tomorrow he wants me to being in my original claim from jan 07 denied in dec 07stating a personality dx, mimicked bipolar and PTSD, I appealed jan 08 and in July 12 was awarded bipolar and PTSD %70 PTSD, so he wants also that award letter showing there was never personality disorder, it was ruled out and over ruled to bipolar and PTSD, which now they blame ssdi says I have personality disorder and bipolar on top of all my other service connected disabilities and that only bipolar and personality disorder make me unable to work, ssdi only noted I have personality disorder because of that old claim where they tried to say I have it, it doesn't even exist! And bipolar is in fact part of my %70 for mental! They went on to say in my denial I have only ever been treated by the va for the past 10 years for bipolar alone! I am treated for anxiety with agrophobia (PtSD) and depression (bipolar) BoTH! Anyhow, is noD a thing that takes years and goes into appeal no matter what???? Or is it something that can be won and never go to appeal, if we word the NOD well enough to show they overlooked what I am treated for and that in fact it's part of my last appeal I just won and that in fact ssdi only put in my disability for personality disorder on top of everything else because they were the ones who originally said I had it and I don't!

Please read my 4th and 5th entry posted today 8/28/13 In this topic :( :( If I didn't have SSDI they would have just looked solely at my employment history Instead they looked at ssdi found two things listed they say aren't service connected, (which one is and part of my PTSD) the other was appeal and ruled out already, but said those two things are the only factors to me being unemployable Yet saying I am unemployable just not service connected All my ssdi is from just my medical records from va and military and all service connected, the personality was mentioned once by a therapist, and it's haunted me for years, going into yet another appeal for it, I won before when they tried to say my PTSD was only personality disorder, and I'll win again cause it has never existed! And how can they say they can distinguish which mental disorder effects me working or not, they will take something as small as a migraine on ssdi claims if it isn't service connected and say you are only unemployable for the non service connected stuff just to deny you! Yet everything I got ssdi for was service connected stuff except personality dx, and only ssdi added that, I never claimed it, and my award letter states they only found it in my military record, I don't have it! Personality disorder will haunt you for life if it's mentioned once in a military record!

Does a NOD go into BVA for appeals, or can they find the flaw and it just take a few short months and skip appeals, or do all NOD go into an appeal, if no further evidence is needed, they just overlooked something and we bring it to their attention, is it settled fast Please check out my thread for my information on what is going on with my DENIED IU claim
  5. OH and to boot they said I am only being treated for BIPOLAR alone by the va and NO records show I am being treated for PTSD, I am being treated for PTSD, ANXIETY with AGORAPHBIA, Bipolar II, and depression, and sleep dx's, I am in therapy biweekly have a med doc, and on meds

I was found unemployable but they say it is because of bipolar and personailty dx, and not my arthritis and PTSD my %70 PTSD is for anxiety with agorphobia, depression, PTSD from MST, and Bipolar they are saying SSDI shows I have personality dx and bipolar, and they can distinguish that only those two things which they are saying are not service connected, cause my unemployability bipolar IS part of my %70, and personailty dx was ruled out in my appeal for PTSD in 2012 after it lost to personailty dx,in 08 so what I am trying to say is SSDI only soley used my military and va medical records and stated I aslo had personality dx, cause once it was mentioned in therapy in 03 during service since service not once have I got a dx of personailty dx, I had to appeal that and was awarded for bipolar and ptsd as %70 PTSD SO I DO NOT TO THIS DAY HAVE PERSONALITY DISORDER< but again they are denying a claim based on one document from 03 while I was in therapy! and now cause it is in my SSDI award, they are playing games and trying to use it against me again they said I am unemployable soley for BIPOLAR which is service connected and they are now saying NOT, and personality DX, which I never ever had I had a 5 year appeal because of this dang glitch before, now about to have another LONG APPEAL ANYHOW went to the VFW today and the guy wants me to come back tomorrow with my award letter from last year stating I have anxiety, depression and bipolar, all rated as PTSD, won from a denail because of a one page paper saying once PERSONALITY DX they are trying to say I am unemployable and can distingish all my service connections dont hold me back, just soely the FAKE personailty dx, and bipolar which IS SERVICE CONNECTED! why do I have to go thru so many appeals, here goes another 4 year plus wait, after I had a total of a almost 6 year wait after a denail then long APPEAL! OH QUESTION does all NOD go to appeals, or will we file NOD, and they can look back at the fact they overlooked bipolar was service connected and won over a faulty personailty dx they are again trying to bring up when it has already been overruled and ruled out so will this possible take a few short months, or do all NODs go into appeal and to BVA???????

My SSDI is for Back injury, carpal tunnel, degenerative joint disease, tendinitis, bipolar II disorder, PTSD, anxiety disorder with agoraphobia, depression, and personality disorder my SC is 70% PTSD (bipolar, depression, anxiety and PTSD) 10% Back injury 10% left wrist 10% left ankle 10% Left knee Combined %80 the only diff is personality DX on SSDI, and that because when I was discharged from the service I was dx with PD to try to not let me ever get any disability, I was never really diagnosis by a doc, a doc put in Depression to not rule out, and a social worker, deemed me only PD, and had me discharge, she was prob paid a bonus to do so. Yet to this day not a single doc, VA nor Military said I was PD but SSDI said I was, so whatever, but all my SSDI is for SC conditions dating back to 03, but paid me back to 09 since I made too much money that year at a NISH job for people with disabilities, that I wasnt able to even hold onto, it was my last decent job but it was 20 hours a week and I couldn't handle it, and it was too much mental strain and physical, I also have Delayed sleep syndrom and Hypersomnia both DX from the military I am not rated at yet, makes it hard to ever wake up, you can call me 50 times and place 2 blazing alarm clocks near me and I wont wake up, that was the real and main reason I was supposed to be discharged but they put code JFK and Personaility DX on my DD214, so I could try not to get any Disability, it took 10 years fighting and still am!

So my claim went from Preparation for Decision on 8/09/13 to Pending Decision Approval on 8/21/13 to complete on 8/22/13, seemed OH so fast, very worried, my AB8 was not updated, but I have read from others it can happen in up to two weeks or more, some if it closed on a Friday their AB8 wasn't on the site or updated til Monday. Anyhow it is only Sunday and it closed Friday, but my "Download Letters" changed completely, not showing anything for ID or commissary thou here is what it looks like, the second one down is my AB8, the first one lets you kind of generate an AB8, both still showing I am currently paid $1503 @ %80, but waiting for BBE, and hoping for a change come Monday. This claim was deferred from a claim started 01/27/07 My retro was nice as I didn't get it til after my appeal because I was initially denied, I got approved 7/27/12, 7 days after I was approved for SSDI for all my service connected disabilities dating back to my EOS being May 2003, my original claim to may 2003 I waited to long to appeal and had to open the new claim in 07, went from %30 to %40 then later %80, and really hoping for IU since I have not held down a steady job ever since Discharge, and I last worked in 2012 for one month, 2010 for one month and 2009 for just a few short months. And being on SSDI I no longer work at all.

Well It went from prep for decision to pending approval to closed all in one day I see no change in my AB8, and I see a section for appeals I really think they are mass denying people to get rid of the backlog then making the appeals back log bigger and bigger and bigger But no ones bitching about the backlog of appeals being 4-7 years
  12. also if your disability that is causing you to no longer work as said doctor, is new and not connected to service, look into SSDI, but it will probably not get you IU. but maybe SSDI and why would you want to live on next to nothing a month, when in fact you can tak said job for $100k a year I would take $100k a year job I was a diesel mechanic and Air conditioning and refrigeration mechanic in the Navy, I know with my licenses and training and job experience, and even education I could be making $100k a year, but in fact I struggle to take care of my self and can NOT work and am having a hard time proving that to the VA, it took 10 years to get my approval and that was only after waiting 10 years to try to apply for SSDI and got it in a couple short months, that the VA saw it was all for my service connected disabilities I was recieving and finally closed my appeal at %80 from %30 and deffered IU, I have now been waiting over a year for a decision on my IU, if I could at all work in my field or even a new field and make $60k or more I would take it, cause it's way way way more then I get now on SSDi plus %80 and even more then I would get on IU plus SSDI

I started my claim in jan 2007 (over a year after my very first claim filed in 2003 and awarded in 2005), was denied in december 2007, filed for NOD, but after a year the VA said they never got a NOD, but the VFW showed proofed they faxed it out, and so it went int appeal, was awarded an increase from %30 to %80 in July 2012, 7 days after being awarded SSDI (which I was awarded in 3 months flat all for my service connection dating back to 2003, with no representation and no exams, just my va and military records) I was deffered IU and sent in the forms, I didn't recieve the BE til late september and mail it in and they recieved it in oct 2012, but says the claim start date is July 2007, it is also VBMS I looked at my SSA records, and saw that I earned 230$ in 2010, and $900 in 2012 other then that since I been out of the service 10 years, I have never had a full time job, tried doing vocrehab, and they never let me start, they were the ones who sent me for a physc eval in 2006, after being in the program 1 year and never starting school, that led to my claim in 2007 I again tried vocrehab in 2010 in another region, and they let me go to school, and I managed after about a year to start, but never hardly went, missed so much failed classes mulitple times... yet I was a straight A student my whole life... I can't even do voc rehab, so I was pulled last year, havent been to school since feb of last year, and I failed every class that term

  15. Day 3, phc hasn't filled out form, little ceasers no manager was available, round table gave me a number for HR and then HR wants me to just drop it off at a round table.... Gosh I'm gonna physically in person deliver these 21-4192 forms and then sounds like these managers are still gonna just sit on them, and no one ever received these from the VA to begin with! Now I have to waste time, gas and paitence I had to get a payday loan to get gas, I'm going even broker by the day :( the VA should reimburse me for time and gas and my sanity

I am now hand carrying mine up, as for them getting the backlogs done, I believe anyone who had a two + year complicated claim and hadn't even got a C&P exam were all just slapped with a HUGE DENY stamp, my brothers claim after almost 3 years came back denied in April, right when all this started, and he never was sent for a single C&P exam over all of 3 years I would not doubt they just stamp 90% deny, one that were close to being completed they actually finished and I bet a handful of those were still denied But then again, why did it take them only two months to do all those, a little bit of over time and they go thru more claims at a record pace then ever before! CRAZINESS
  17. Update, yup the VA never recieved a single 21-4192 from any of my employers, my claim went orange and says I NEED to follow thru and send in this information... fun times

Hi motherof3, I have a friend who is in the same boat, shoot for me I didn't leave my house for three years, I felt like a prisoner in my own body in my own home... as for hardships, have you asked your debtors for a hardship, last year was rough and I was behind by months, I finally asked for hardships for some of my credit cards, and got them, payments went to like $8 a month minimum instead of $85, it helped a lot and I wish I would have called sooner, I wouldn't have those dings on my credit! and back on topic...I'm still waiting :) 4 more days and it will be 30 days, since the 21-4192's were sent out and the 5103 letter, another letter came about a week after saying if I could get all this in they will maybe make a decision on my claim after the 30 days... I don't trust ebenefits atm, I feel they will be behind on the site.... just gonna sit back and wait
  19. nice your guys was about a year or less, theirs is a little over a year and mine just a year this month... I can wait a little longer but not much, I am going to food banks... even with SSDI and %80, I can't even afford food... sounds sad but times are hard for the fiance, and I am supporting us BOTH, wish we were married... then at least he would be a dependant at like $100 more a month, maybe I could afford not to hit food banks then, or once this TDIU comes in I cant even afford toothpaste, laundry detergent, ect... waiting to go back to the salvation army and hope to score some
  20. my claim was opened in jan 2007, increase from %40 to %80 in july 2012 (yup took 12 months to get denied then took years for the appeal... the almost 6 year retro was nice thou) TDUI deffered as well, also VBMS, and sitting in seattle where I have found others with newer TDIU claims have already got their claims back in SEATTLE that filed after me! A guy on another forum whos claim for TDUI was also in seattle, just got awarded in june and he filed his TDIU 2-3 months after me... and my whole damn claim is over 6 years old... also had I not left a 18 month gap from 2005 to 2007, this claim would be 10 years old! and yes, TDIU deffered... even on an old claim... kinda starts from the date of the award... mine july of 2012, so yours 5/2012, so just a little over a year old sadly, mine only a year old but in the end, the retro for the effective date, will go to the claimed TDIU, possible the beginning of the whole claim, or when the VA felt you became unfit to work, be it me, was in 2009, that was the last year I made too much income so we sit and wait
  21. thanks for the responses, I am gonna call my VFW or email them, I just don't know where the forms went to exactly, not like ebenny shows what address or dept they were sent to, I'd hate to go in and have someone at a near HR fill one out, and have VA receive two from a single employer with different info and be denied solely cause two were filled out and have conflicting info I was discharged in 2003, didnt find work til 2004 and worked for one year at a navy barracks part time, didnt work again til mid 06 for a temp place and just worked a few hours a week for a couple months, then got a job at dominos, yes I was 26 and made pizza, part time... then didnt work from 07 to 09, and got a NISH job thru the va for people with disabilities but worked 20 hours a week, for less then a year and lost the job due to mental health and physical impairments... this was one of the jobs they are sending a letter to, then in 2010 I worked at round table pizza for one month (found out they knew I was disabled the first week, so they were only giving me 10 hours a week) after one month they let me go and I quote they said "we can't pay you to sit on your butt, we can't be liable if you get hurt, why didn't you tell us you were disabled." yet I never sat on my butt! I wanted to sue! they discriminated on me! then in 2012 I worked for one month at Little Cesar's pizza as a supervisor, but mentally too hard and I was crying everyday by the end and had to leave So I just wonder what human resources will say as to why I left round table, and little Cesar's, let alone PHC (Portland habilitation Center (the NISH job the va got me)) but as you can see in the last ten year I hardly worked with years of not working but maybe a month once every few years

Got a 5103, check the box sent it in, that was last week, and I saw on ebenny that 21-4192 were sent to my former employers, reading the fast track letter I saw that "IMPORTANT: Do not deny TDIU evaluations solely because an employer failed to return a completed VA Form 21-4192" but just got another letter that says "Even thou we have asked for this information, it is your responsibility to see that VA recieves it (except for any evidence kept by the VA, military or any other federal government agency)." SO does this mean I should contact my former employees and try to figure out where this letter was sent to and have them send it in, or give it to me to send in, cause this is retarded IT IS my responsibility!
