I finished with my Brothers 1151 Claim. I made copies- so where do I have to address to- an to whom??

I went talk to Senator & Congressman about my Brothers Claims. VA will not like that. I do not know how much help ,but my phone has not stop ringing,asking for more info. To go ahead and file 1151 Claim- Do I file a seperate 1151 claim for EACH different incident or just put them all togeather? 1. Loss of Sight-both eyes ( they did not treat his glocoma first)when they operated for cataracts. 2. Their failure to tell him or treat him for glocoma ( in records back to 1992) 3. Failure to dinoisis Lung cancer,giving him medicine lung infection when he was spitting up blood,then not following with any kind of treatmment for over 6 months. ( Now too late,sent him home to die. (My guess 3 months at most left) Cancer in lung,kidney, glands. Which way should I go!? Also will need the name of a GOOD TORT LAWYER!! Sorry about my spelling.

Berta, I am sure that you do not remember my post. Been a while,but I had asked your feel about my Brothers Claim. Number of health problems,trying to SC. Heart,glocoma,cararats,loss of sight,etc. He went to the VA today,an the cancer has spread all over his body. Too weak for any treatment. Told to return Monday to put in medi-port-Pain shots. We have never heard from his claim,even thou we called,eMailed,except. Reply!! we are working on it( Claim) They ( Doctors) saying no hope. He wants to see that his wife has money coming in after he dies,but right now he is gettig a VA Pension-A&A. Should I file an 1151 claim for his eyes?( There Fault he is blind) An a tort claim? Or wait an let his wife file after he dies? I have asked that they put his claim on a fast tract,but no response! except they are working on it. My brother has lost 30 pounds,gone Blind,an now the Cancer has spread from his lungs,to being all over his body. All in a few months. Now his heart hurts,(has pacemaker)an they told him to go see his Primary Doctor( None,his Primary Quit last month) I went with him,to see a SO-an he went over his file,an said VA has all the proof they need to service conect him. My brain ,having to fight PTSD every day,is making it impossible for me to see what to do next. CAN ANYONE SHOW ME SOME DAYLIGHT? THE VA WILL<I AM AFRAID> win again. Let him die,an never pay him.

Reason For Decision ------------------------------------------------------------------------------------ recieved April 20-06. VET,who was in New Orleans Hospital for Mental problems,from 07/09/56 to 02/20/57.VAMC,New Orleans,says that attempt to find records at the VMAC New Orleans,was negative and showed no match.Review of Veterans claims file show a record of discharge summary from hospital.No other records were found. Review of the letter of 06/09/56 indicated that the letter from the Chief of Registrar Division sent a letter indicating that under Public Law 230,82th Congress it was determined that his nervous condition "is service connected-for the purpose of hospital care or outpatient treatment" and that he is to retain the letter and present it when applying in the future for hospital care or outpatient. This letter was generated by the hospital,and not the Regional Office.There is no evidence of a Rating Decision which granted service-connection. Review of claims file indicated that he was given a diagnosis of schizophrenic reaction,chronic,indifferentital type,active,competent in the VAMC.N.O. He was not able to get SC for this condition,even thou he went to get treatment,within 1 year of getting out of service. They denied him,saying that it was not service connected,instead was caused from being caused fron being kicked by a nule in his youth. Can not find record of treatment in Clinic. This Vet served his time-but ending up unable to cope with life-mental problems. They can not find his records from when he first got treatment. He came out of service ,filed claim 6-22-56,an denied service connection. He did not appeal. He was put on pension. Is there something that can be filed at this late date? This Vetern NEVER was able to be gainfully employed his entire life.

BERTA, I TALKED TO MY BROTHER ABOUT HIS LAST DR. APPOIMENT,FOR HIS EYES. HE SAID THAT NONE OF THE DR. WANTED TO EVEN CHECK HIS EYES. THEY ADMITTED THAT THEY WERE AFRAID OF TREATING HIM. THE REASON HE WENT TO THE EYE CLINIC- (1) HIS EYE WATERED -NON-STOP! ONE OF HIS EYE LASHES HAD ENTERED HIS EYE BALL-LIKE IF STEEL. (2) HE DID HAVE FOLLOW UP, FROM HOUSTON EYE OPERATION. (3) WHEN THEY DID THE OPERATION FOR HIS CATATIC,THEY SCRACTED THE IMPLANTED LEN-SO THE LITTLE VISION HE HAS-IS" DOUBLE VISION" (4) HE IS ON SSD-BUT NO SUPPLMENTAL INSURANCE . HE IS AFRAID TO ALLOW THE VA TO DO ANY MORE DAMAGE TO HIS EYES,(IF THATS POSSIBLE) BY OPERATIMG TO INSERT A NEW LEN. BUT HE IS GETTING HEADACES BECAUSE OF DOUBLE VISION !! Berta, Sure glad that you are still with us. The local SO wants to file my brothers loss of eye sight(caused by VA Hospital) as a service connected claim. He says that he can get him more,monthly for loss of sight(both eyes),then with an 1151 claim.Now limited to $ 250,000? His words. That we can not file Tort,& 1151 claim. Can I not file ,to service connect loss of eye sight,1151,and Tort? I just want to make sure that everything that is available,including Tort Claim. I yust want to make sure its filed right-the first time

Can you file an 1151 claim? An also file a Tort claim for the same thing? Loss of sight caused by VA. Collect montly comp- plus lump sum?

Well,I wrote to you about my Brother before. What the VA give him was a Pension,not comp. at all.They gave him 10% for hearing loss,but had to give him hearing aids,so that he could hear his Doctors told him. But he cannot get both,so they give him Pension w A@A, $596.an he gets SSD. He is completly Blind in one eye,because of the Doctors refusing to send him to Houston,instead they continued to put tons of drops in his eyes,causing his eye to turm soft-very painful. When they did allow him to go to Houston,the Doctor over there told him that they(DRS.) should have sent him to see her from the begaining! All she could do,was operate an cut in back of His eye to release the pressure caused by the Glocoma-thereby ending all sight in his eye. In the other eye,he has loss of most of his sight. He had to go to a local eye specialist,to get some glasses.( VA told him that there was No opening)for him to get glasses. THEY KNOW that they SCREWED UP BAD. So I filed a NOD on his CLAIM,sent a statement from the GI who was there,when he had his first Heart problem,signed,@ Seal all proper. He had not seen my Brother,or have any idea where he was. Said in letter,that he though they they had Discharged my brother,medical. My brother had not understood that he was having trouble with his heart then or for 15-20 years latter. He stayed in the Army 9 years. Also letter from his wife,copies of the Armys) refusal to let him re-enlist becauce of his hearing Loss,as he could not do his job. He recieved 0% disability-at that time,an never appealed it at that time.They also said that because he was In light Wepons Infantry. His Service show that he was in the Armord Calvary,while in Germany and stateside.So he got 0 for Tinnutis. They also say that they have no proof of him being treated for frostbit while in Germany,thou we tried to get them,but unable. #11 of the Decision states.( Entitlement to special monthly compensation based on aid and attendance/housebound is denied. ( Under your Entitlement Amount and Payment Start Date) Monthly Entitlement $596.00 for Pension granted with A@A/with one dependent. Now what to do? Do I file an 1151 claim(eye) loss of? and TORT at the same time? He has lung cancer,as I stated earlier,so he is worried about his wife,if he should die soon. I NEED HELP!!! Can I do this by Myself,with your help. He does not want a Lawyer! Tell you the truth,I am scared that I might screw up the works. They also (forgot) to tell him,from 1992,that he even had Glaucoma. I found it in his his C-File.Getting all his records,last one is the one from Houston.

The VA in Alex,La. left my Brother completely blind in one eye,and almost blind in the other. Instead of sending him to Houston,they burned his eye with med,an when he went to Houston,it was too late. I want to file an 1151,an need to download an 1151 Form. Should I file for Comp.,too? He had Lung Cancer,an he is afraid the he won t live to get anything? I will be asking for help for this one. THANKS

Got my VA Form 21-4140 today. No envelope,nothing saying to be sure an sign this form. Or lose your benifits. There goes another $5.00 to mail it, but I want to be SURE they get it.

Well,my brother just called,an said that he had recieved a Check-for $5,460.00 (He CALLED-Said pension A&A)on the Check. No letter yet. It was 10 mo. ago when we filed for Comp.with service heart,hearing,ED, And also filed for unimployabilty ---- So what do you think is going on???? He has been on SSD back to 92

OOPS!! I get 70% for ptsd.

I will answer as much as I am able, . Yes,I am getting paid at 100%.P&T with unemployability. Got free insurance,got I.D. card/W INDEK card for Privages,etc. Even got Complete Computer,printer,Camera-plus having my schooling paid -for independent living.( SOCIAL ISOLATION) I am service connected fot PTSD,feet,& tiniest-Plus -)- % for hearing loss. The shoulder is also Service Connected,part of the PTSD peroid of time. Guess I am only dreaming,about EED for PTSD, but my Shrink is the one who said that it might be considered an implied Claim,becuse I was never told that I has PTSD,just shoved pills by the hand full. I take up to 17 different medications daily,3 times a day. The Neuropathy is as lisely as not was caused by the medication-so secondary condition. Heart,(secondarty to PTSD) Hearing loss,service connected-Will refile at a later date. HBP-Secondary also

I am at a loss because I have over 15 claims now,that I filed after I recieved my Disability. 70% PTSD- 10% Tinitis,and 10% athlet foot, T&P I filed for shoulder- rotator -always in pain. Bilateral Peripheral Neuropathy-loss of feeling/with a lot of pain. HBP Ulcers Migrains Heart Problems Social isolation Sleep Apnea TMJ Agoraphobin Gerd Arthritis (A Clain For EED) Also asked for an effective date for PTSD to the date indicated in my file-1999( When VA Put it down in my medical chart) Diagnostic Status: AXIS 1 309.81 Posttraumatic Stress Disorder,Chronic with Delayed Stress(as likely as not) AXIS 11 None Axis 111. Peripheral Neuropathy,Skin,Hearing,and Heart Problems. The Dr. put this in my records,in 1999, but I never Knew about it until I read it in my medical records YEARS Latter. In one of my C&P s,the C&P report says that (as likely as notthat being chronically stressed or depressed drom PTSD definitely could have affected his heart condition.

I just got a letter for C&P. Have X-Ray plus have to go to C&P PO Clinic! What is that for.

Well,I got to read my vets letter. He got 30% for hearing loss. Was denied for HP-an 6 other items. Its a Start- extra $300.+ per month. Getting his NOD ready right now. He is the one who got a letter,with a Unimployability Form to fill out a few days ago????

We did file for High Blood Presure,Asbestosis,hearing loss,etc, but I asked for Unemployability at time I filed. Did not request Pension. Vet has not been gainfully employed last 20 year. Could not keep a job.

A Vet that I have been helping today reciieved a letter, with a form for him to fill,for unemployability. He only went to one C&P,an that for Hearing loss. So what is this all abot???
