  1. From what I can find on here I think the answer is NO. However I couldn't find anywhere were a state tax department was the source of the garnishment. also I talked to my bank and said I would have to wait until the garnishment came thru and they would put the funds on hold, meanwhile my car gets repoed...... Really, I think there's another solution. Anybody???

I just went through the same process, the VA letter stating that I was TDUI, they just looked at it and it had a huge bearing on their decision, they didn't even ask any questions other than when was I granted the TDUI. Since I hadn't worked since 11/14 and started VA claim 8/24/14. Well because I had been out of work since Nov 2013, they back paid me from then (minus the whole 6 month waiting period) So really the only questions they will have is when you stopped working and why. If you just plainly state that it was due to blah, blah, and military sees me as TDUI and you stopped working blah blah blah. Like I said, the TDUI wins you the case, the judge decides the back pay.

    Thanks for this input. What state are you in. Did you go in front of an ALJ?

    I haven't been able to worked since 12/6/2012 but because I was in a union I was laid off(a one man layoff) for lack of work. The tryth is I was fired for sitting down trying to get some pain relief. So I collected Unemployment while my application for SSDI festered in the system Thats another reason why I'm a bit worried. I have custody of three kids, I had to do something to feed them so I dont make apologise fot that. Binder is handling the case for me, I think I made a mistake going with them but hindsight is always 20/20

  3. I have been waiting for 2 1/2 years, The VA Granted me TDIU in Feb. 80% SC. I'm a nervous wreck, can't sleep, can't stay awake. How much does the VA's decision help. I wasn't ever able to get an IMO because I was off work, Drs not taking new patients. I just plain scared. $1700 extra a month would help get me out of the enormous debt I have incurred. I've watched all the youtube Vids on the subject but not much on regarding Vets and their experiences. Maybe some words of comfort might help, LoL Thanks Honorable friends,

  4. I filed my claim 0n 09/23/2014. I had my C&P exam on 01/12/2015. I was awarded TDIU 80% SC payable at 100% with an effictive date of Jan 1 2015. When I filed my claim it was a reopen TDIU from 2012 But when I filed my claim in Sept 2014 Nothing changed physically. Its just my exam was in Jan2015. I think my claim should be effective the day I filed it but the VA See's that diffferently. Was there an error. I just thankful I finally received the award, but the difference is 6 grand. Just so thoughts

  5. I'm looking for all and every story How being Declaired Disabled by the VA helps your SSD case. I filed my case for SSD in Febuary 2014. I am expected to have my day in court in May or June. I was enitially denied and went to appeal. I was just approved of TPIU in Jan 2015. It seems from what I have read that The VA Standards for SC TDIU are much higher than anything SSD has to offer. So Can I hear how your stories have panned out for you. Once again I am so grateful for this sight and the knowledge found within the minds of such patriots!

  6. OK I was just granted TDIU thank God!! And now I need to navigate the web of benys that opened up for me. I have 3 kids under 18 and I have a feeling with my new income I will have to insure them for medical. Currently they are on Paramount advantage thru the state. So what is champva Will it insure them will I have to pay a monthly premium? Any links or advice will be appreciated. I filled out the PDF application but it says they could take 8 months how will I insure my kids until then. I take it chp 35 is for educational bennifits but just unclear. Thanks again guys and gals,, you all took the edge off and really helped me get through this mentally.

  8. ping jockey, First I want to thank you for your very detailed and thoughtful mark up.

    A lot of us forget that we are not actually dealling with someone who is championing our cause in these exams. I don't want 1 thing I don't deserve from the VA but just what my service entitled me. I wasn't wounded in combat and sometimes I feel guilty about it, but I know it wasn't in my cards. My life has however been impacted by my conditions and need people like you to help guide me in the right direction. I can only hope the RO looked at my complete record and comes to see the truth about my condition. Once I get my decision I will post it and compare the 2. I wonder what the fastest approach is, NOD new C&P exam or straight appeal. This worrying might be for not but Optimism has left the building and my OCD is relentless.     Yes SC Bronchitis was 10% my last PFT was 62% predicted FEV-1. and my SC DDD was rated at 20% with a new forward flexion of 25 deg. It's a pretty straight forward , Increase to 30% and 40% respectively, If what I learned here is correct. And if all other SC ratings remain the same would combine for 75.556% rounded up to an 80% rating.I re opened my IU claim from 2010 at the same time so I'm hoping it was a no brainer for the rater and thats why it was so fast. Yes I filed for SSD back in Feb, waiting on appeal, should be seeing judge in may. What is an extra scheduler IU vs regular IU? thanks!
