Based on the C&P exam you provided I think the increase is eminent but I can't say for sure.  I am sure others will come along with more expert advice!

I was SC'ed but rated at 0% because I missed my CP exam appointment due to a field ops I was required to go to.

What is your current rating % from 2012?

He takes his glasses off, looks at me and says "son, you're rated at 90%, you could have been rehabbing your knees for the past 4 years free of charge.  Some of those DAV guys are good, but some of them are idiots"

At this point, I was extremely frustrated and may have slipped out a few expletives at a louder than normal tone.  He told me "son, talk to your primary physician about getting seen by a specialist and ask to get an MRI because you're knee looks somewhat okay, but I imagine an MRI might reveal something else that will explain the pain.  Regardless of what happened, we'll take care of you, I know it's been a long journey, but hang in there and have faith.  Also, how's your migraines?  I see you're rated at 30%, but if they've gotten worse, you should file for an increase.  Anyways, hang in there son and I'll make sure I put the info gathered from the exam in today"

He was extremely caring and pro active, which is something that I am NOT used to with the VA.  I don't have as many complaints as some you guys out there, but still, it hasn't been easy.

I just wanted to share this story and hopefully I'll get the rating I deserve - since it's a bilateral diagnose, wouldn't I get a rating for each + 10%?  Lord willing, if that happens, I should be pushed to 100% according to Hutsky's excel spreadsheet.  That will help my family and I out so much!  I am glad I am not in this fight alone and if it wasn't for a bunch of you, I would be in a darker place.  Thanks - you guys don't know how much you've done for me.

    Brothers in arms!

    Gents,

I have lurked around these boards for about a year now. This board has helped me in more ways than I could ever explain. I am forever grateful for the advice that I have gained from you guys. I am currently rated at 90% for PTSD/Anxiety, Migraines, L/R Shoulder surgeries, keloid scars and tinitus. I was recently diagnosed with sleep apnea by the VA and given a CPAP by the VA, however, when I filed my claim for it, I was denied and said it was not SC. In 2011, a year into my contract, I was diagnosed with anxiety. During one of my visits to the hospital, I had complained of sleep issues and it was documented in SMR. I was also prescribed to Xanax by a military doctor to help with my sleep issues that I was having.

I know how it goes with the VA, but I was pretty damn sure this was a shoe in, but to no avail. I have been assisted by a local VSO and he has been great, but before we sent in this claim, I asked him if I should have "Buddy statements" to support this claim and he advised no, that it could actually make the claim take longer than it should. Those buddy statements I have are from 3 buddies, one of them being the doc that was attached to our platoon in Afghanistan. I complained to him multiple times about my sleeping issues.

I don't know what I should do from here, if anyone has any experience or advice, I would really appreciate it.

you need to ask for a reconsideration with the new evidence your buddy statements, and the treatment records,

and the records from the doctor that would vouch for you, ask your mental health provider what she think of it being

related secondary to your meds or anxiety you suffer. Get a medical opinion you will need it if mental health doctor

    cant help with it. jmho

I was able to receive SC for OSA secondary to PTSD with a strong buddy letter describing my OSA symptoms in service. Note that I was diagnosed with OSA 2 years post service via a sleep study, and had my doctor write a letter stating the my OSA likely started while I was onAD.
