  1. What about if you already had a condition that got worse when you were called back for active duty can you file a claim for it.

  3. Bound4heaven I noticed that you rated loss of use and use a cane instead of a wheelchair. Do you mine if I ask you are bi-lateral feet problems you have?
  4. This question is for anybody that knows. When I go to my appeal in front of a DRO after is over, is it going to be him you approves or denies my claim or somebody else if going to make that determination?
  5. Thanks for the info. but my biggest witness is my exwife because she knew of my health before and after coming back from the persian gulf. I feel like going to tal;k to her but I am afraid that she will say no. I have been having alot of anxiety over this appeal in person with a DRO. Can anybody that has been to one tell me how they were able to handle it.
  6. Does the va take into consideration if you have statements from love ones and friends that were in the same unit as you?
  7. If the va denied your claim without giving you a c/p exam can you request one or is it up to them if they want to set you up for one?
  8. Berta the one case involving the BVA is Dockett# 00-22 212, citation # 070811 it was decided in 2007 atthe BVA. The same way this vet argued his sleep apnea is the same way I am arguing mines and I have to go to an appeal in Jan. If you find it let me know because ther is something I am confused.
  9. Thanks for the encouregment. Is there a website that you can look up desicions made by the CAVC like the same way you do with the BVA. Any advice will help alot.
  10. Berta I did some more research on BVA cases and found two morw cases that the BVA granted. I am going to have a hearing in Jan. and I going to take copies from these cases just in case I need them. I feel like giving up it is so energy taking and sometimes I wonder if its worth the fight.
  11. I always belieaved that one a case was granted by the BVA it was final.
  12. It was signed by one judge. I wish I was able to post that case on Hadit but I do not know how to do it.
  13. Berta THis case Im talking about the veteran filed his claim using the same wording I used for mines and the BVA granted the service connection because the va could not prove other wise.
  14. If you have a case pending on appeal and you find a case from the BVA and this case is identical as yours and the BVA granted s/c can you use that case as evidence or the va will not allow you to do that.
  15. I did some research about sleep apnea and PTSD and was surprised to know that ther is a connection between both of them. I also cheched the va site for any cases relating to this problem and found to cases in which sleep apnea was granted secondary to PTSD. Has anybody on this forum been s/c sleep apnea sec, to ptsd?
  16. Has anybody been diagnosed with insomnia secondary tp PTSD. Can this be claimed as s/c secondary to ptsd?
  17. Pete53 I also reside in texas and was told by my county that this proposition 9 for tax exemption will not take effect until 2009.
  18. What is the difference between the a&a for r1 and r2 and also what are the requierments to meet the granting of the r1 and r2?

  20. Just a reminder to all texas disabled veterans to go to the polls and vote in favor of proposition 9 for no more property taxes or better tax exemption.

  22. Thanks for the reply and I will file a NOD because even thought they may not reduce my compensation one they my decide to do it and I wiil feel like a fool by having the opportunity to appeal it and did not do it. I will keep you guys in touch of this injustice by the part of the va.
  23. Should I place a NOD or a reopen claim, because it has not been more than 30 days.
  24. Called thVa regional office and asked them that why they were taking my a&a away but not reducing my compensation and they could not give me an answer. It doe not make sense especially when the va is hard to give money. I also told them that I had a note from my doctor saying that I continue to need A&A from another person, she told me to reopen my claim reconsidering A&A but I thought I had to place a NOD for the termination of my A&A. Super Confused on this and not trustworthy of the VA any advice is wecolmed.
