  1. broncovet, Not having a pension myself, my Rated Disabilities include "Not Service Connected" X2(not related to hearing/ear problems). Monday I got two C&P exams, both related to SC hearing and ear diseases listed below. I'm already SC bilateral otitis media and chronic right mastoiditis-10% and hearing loss right ear-0%, post operative status, perforation of the right tympanic membrane-0%. ALL 3 conditions rated from 11/20/1990. ALL 3 of the above are still present, and have been medically proven to have worsened. I'm TDIU P&T, 90% Scheduler as of now. Allan 2-2-0 HUAH!
  2. Buck, my question is how does one get a non SC of 60%? The VA just ups and tells you that your condition isn't SC, but still assigns you 60+%? I'm missing something here. Allan 2-2-0 HUAH!
  3. Good question Buck. I'm NSC with obstructive sleep apnea, and everyone, lawyers included, keeps telling me "don't bother trying to SC" Allan 2-2-0 HUAH!
  4. @Buck, Careful what you wish for. There are already a few Libtard democrats out there who are advocating that the VA do away with IU, with no replacement. I generally don't do the politics and religion thing here, but I made the exception after seeing your post. Agreed though Buck, if you're SC to a point where you can't work, to hell with IU, award 100% Scheduler, and avoid all the appeals, wasted time and money. Then again, since when does the VA care about saving money EXCEPT taking it out of the pockets of veterans? J.M.O. Allan -2-2-0 HUAH!
  5. @Dustoff 11, So basically TDIU, P&T or not, meets the single 100% for SMC's, then toss in another ONE condition that's separate from the TDIU-60% or more, and you have the makings of SMCs. bronco sees it the same way. Allan 2-2-0 HUAH!
  6. @broncovet, My award letter from 2016 is quite clear in respect to my TDIU P&T, it reads(paraphrasing) " Your combined SC rating renders you TDIU P&T.., with no further examination appointments scheduled.., your combined Scheduler rating is 90%..." Though it's a separate issue, I have 2 C&P exams scheduled for Monday to address my SC 0% for Post Operative Status, Perforation Of The Right Tympanic Membrane, which is still perforated as of today, and my SC 0% for hearing Loss Right Ear, which as of 11/11/2019, was diagnosed as "Moderate to sever hearing loss" Both of the 0% listed above are from 11/20/1990 as listed on my Rated Disabilities. Sorry if these are issues for another discussion, but I listed them to give a better understanding of my case as it applies to possible SMC's Can I assume my two SC 0% disabilities listed above would not be considered "Separate" should SMCs come into play?   7. Bronco, One question I can't seem to get answered concerning your post is: If a veteran with TDIU doesn't have ONE condition rated @100%, eligible for ANY SMC's? Example, my case: I'm TDIU, 90% scheduler, with my highest SINGLE disability rated at 40%. Is the law plain and simple, no 100% SINGLE condition rating, without another NON-connected 60%(or more) rating=NO SMC? Allan 2-2-0 HUAH!

  9. Morning folks, My Dr. called me yesterday afternoon with X-ray and MRI results, and it's not good. In addition to radiculopathy of the lumbar and middle spine, already SC, I know have neuropathy of both feet, and lower left leg. I'm already TDIU P&T,. 90% Scheduler. I can't seem to locate where in Title 38 neuropathy is listed, and the percentages. Anyone with clues? Thanks. Allan 2-2-0 HUAH!
  10. Buck, I have a hodgepodge of conditions leading up to the 90% Scheduler, including SC secondary conditions. Highest condition being 40%-nothing to do with hearing, to the lowest 0% -hearing loss. I took your advice and gathered buddy statements, Audiology reports.., and submitted my claim for increase last night. Sort of went over these discussions with one of the attorneys who visits here, and after looking over my evidence, she agreed with you, 30-60% on the hearing, good little chunk in back pay, but she was skeptical about the SMC.   11. Buck, but the question is.., is TDIU considered one condition? The way Richard1954 explains it, it's not. Allan -2-2-0 HUAH!
  12. Buck, I had this discussion earlier with another vet here. He basically stated that in order for me to be eligible for SMC, I had to have ONE condition rated at 100%, and I got the impression that TDIU P&T in itself, doesn't meet the standards for SMCs. My highest single disability I have is 40%, and I'm now 90% Scheduler. If I'm missing something here, please advise. Allan 2-2-0 HUAH!

  14. Thanks Buck, GBArmy, I have posted the results of my audiology exam a few times here, but I guess nobody, except broncovet can interpret it. The Audiologist did write "Mild to moderately severe hearing loss..", so I can only assume that my now 0% SC for hearing will get some kind of increase. Hell, that 0% was from 1990, so there is no doubt it's worsened. Allan 2-2-0 HUAH! broncovet where are you?((((ECHO)))) One last question Buck/GBArmy.. I'm TDIU P&T, and have had the 0% for the ear since 1990, IF the claim favors me with an increase, will there be any back pay? Thanks.
  15. @Buck52, As I mentioned, I was never SC for my left ear, and the hearing test shows a "moderately severe mixed hearing loss" So do I file for the left ear, and will I need a Nexus? Allan 2-2-0 HUAH!
  16. Buck52, Ironically, the veteran I'm helping has almost identical SC hearing issues as I have. Looking at the Audiology's test results, it reads "Mild to Moderately severe mixed hearing loss, with excellent speech discrimination bilaterally" Let me also say that I was ever SC for my left ear, just the right one. I haven't seen broncovet around for awhile, have you? Thanks, Allan 2-2-0 HUAH!
  17. Vync Know anyone who's good at interpreting hearing test results? I posted the results of my hearing test from 11/11/2019, but nobody seems to be able to translate the test into layman's terms.   19. Vync, The veteran I mentioned has a 0% service connection for hearing loss, however, he also has SC 30% for vertigo, and 10% for otitis media. He also had a recent hearing test that shows "moderate to severe" hearing loss. So is he a good candidate to file for a secondary condition-hearing loss? Allan 2-2-0 HUAH!
  20. @Vync, Yes, he's TDIU. The guy wants to go back to his old job, which from my understanding, isn't on of those "sheltered" jobs you mentioned. Allan 2-2-0 HUAH! UPDATE: Also note that the VA has done away with the Annual Income Statements for veterans who are TDIU. I got my letter from the VA earlier this year stating I no longer needed to provide the statement, and it's my understanding, it's true for ALL TDIU vets.
  21. Morning folks, Got a veteran who's IU P&T, whose conditions are worsening. He would rather have the 100% scheduler because he want's to work. Sadly, somebody has been telling this veteran to not "rock the boat" with the VA, and not file for an increase for his SC vertigo and hearing conditions. It's my understanding that unless there is some evidence of unlawfulness, that P&T means just that, Permanent and Total. The veteran is 62, if that makes any difference. Given the above, are there any reasons why the veteran shouldn't file in order to try for 100% scheduler? Thanks. Allan 2-2-0 HUAH!
  22. Richard, you are correct, my choice of words are wrong. I'm IU P&T, 90% overall scheduler. Now, am I right that in order to be eligible for SMC, one condition HAS to be 100%? Allan 2-2-0 HUAH!
  23. @Richard, as I posted earlier, my IU is based on a combination of conditions, the highest SINGLE condition being 40% I'm IU P&T 100%, with a 90% scheduler. Allan 2-2-0 HUAH!
  24. Buck, I've read mixed opinions on 100% IU P&T being considered ONE condition for the purposes of SMCs. Actually, in my case, I'm more interested in getting the 0% SC hearing up to 10%+, in order to qualify for 100% scheduler. Right now, IU aside, I'm 90% scheduler. Is there something in writing that says 100% IU is considered ONE condition? Allan 2-2-0 HUAH!
  25. @GBArmy, One of many good things about this Forum is the scope and diversity of Q/A. This morning someone emailed me here telling me it's going to be "hard to service connect" my already connected 0% hearing loss, and that I would need a "DBQ/Nexus". I mentioned to her that I'm already SC for hearing loss, as I've posted it all over this conversation. One thing I didn't mention here is my LONG documented(VA) history of ear problems; from 5 tympanoplasties(patching my ear drum), diseased mastoid bones(bone behind the ear), vertigo.., all well documented and in my VA medical records. Yes, I do understand the VA uses scales, charts, regulations, laws.., to determine what's SC and what's not, but if I piled up the well documented records of my ear problems, and weighed them, then I would have me a cheap set of bar bells! And the band played on.. Allan 2-2-0 HUAH!
