  1. @Buck, while I did know the IU will go bye-bye, will my P&T remain after getting 100% Scheduler? Also as far as the fishing is concerned, most of us who live in Palm Beach either live ON or near the ocean, so I can step out on my porch or balcony and throw a line out and catch a few Grouper. Red Snapper requires heading out to the Gulf stream. Allan 2-2-0 HUAH!
  2. @Buck, even nicer would be the 100% Scheduler decision. Brother let me tell you, I've gotten more responses to this thread than on any other subject I've posted. Both here and email responses have been a hodgepodge of opinions ranging from very informative, to comical to downright impossible. I even got an email from someone who must of had their boxers in a wad, and took it out on me! In perspective, I guess I need to find out about all these "signatures" required before a large amount of retro is issued. I'm surprised Berta hasn't tuned into this thread. Allan 2-2-0 HUAH!
  3. Afternoon folks from sunny Palm Beach, it sure doesn't feel Christmas(y) here, but another day in paradise! Got an Email on Ebenefits/va.gov this morning telling me my original decision date for my already SC claim increase has been moved from 12/22/2019 to 03/14/2020. ALL evidence was submitted, including results from C&P exams, and accepted back on 11/18/2019, as per conversation with VA toll free number. Two of the increase claims dated back to 11/20/1990, and one increase claim dates back to 03/18/2010. These we all included in this claim dated above. VA also informed me on Ebenefits that nothing else was needed or required. I've gotten all kinds of opinions on why the delay is taking place; everything from "It's the holidays" to "The VA has cut back on the number of people working on these claims" Got one interesting email this morning here from a seasoned hadit.com member who suggested that "The amount of retro involved is more than likely the reason for delay.." Is there a long drawn-out process that has to happen when paying out retro? More retro=longer decision time? All input welcome. Allan 2-2-0 HUAH!

  6. Buck, the Retro is fine, should that be the case as one lawyer here seems to think the Retro will be "quite substantial" I will take the SMCs also, and the 100% Scheduler.. To make things clear, here are my desires in order: 1. 100% Scheduler 2. SMCs 3. Retro accompanied by 100% Scheduler. Nice Christmas present(s) huh? Allan 2-2-0 HUAH!
  7. Buck, I was denied increases back in 1994. The Retro would be fine, I'm not exactly strapped for cash, but a 50%+ increase in SC is even better, not to mention going from TDIU P&T to 100% Scheduler(I have my reasons), would be the icing on the cake. My case is moving pretty fast considering it's now in the "Evidence and Decision" phase. ALL evidence is in by the way. Will post the end results once I get them. Thanks, Allan 2-2-0 HUAH!
  8. Buck, As far as the hearing and ear problems, the only Retro I have gotten is for Vertigo, rated at 30%, back to 2010, paid in 2016. Obviously, both my hearing loss- 0% and perforated ear drum-0%, bilateral otitis media-10%, all dating back to 11/20/1990, have never been compensated for, or increased. As per bronco's and GBArmy's recommendations, I looked over my C file last night, and I have a DENIED request for those conditions listed above (excluding the Vertigo) dating back to 04/06/1994. Back in those days I was ignorant about filing, gathering evidence..., and screwed myself. Well this time, I had all the medical proof, buddy letters.., to prove my conditions have worsened. As I posted earlier, I finished up my C&P exams for the above conditions, and there is NO doubt what the examiners told me, "Moderate to severe hearing loss(hearing aids issued), perforated ear drum present, bilateral otitis media, present and worsening" Allan 2-2-0 HUAH!
  9. @GBArmy, I may very well have submitted claims for increases after the 1990/2010 dates, and was denied. Would have to take a LONG look-see. One would think that the latest information on Ebenefits would reflect ALL increase requests? Allan 2-2-0 HUAH!
  10. Afternoon folks, hope everything is going well. In June 2016 I was awarded TDIU P&T. I'm 90% Scheduler. Currently, I am asking for an increase for Hearing Loss, Right Ear-0%, Bilateral Otitis Media, and Chronic Right Mastoiditis-10%, and Vertigo-30%. Both the Bilateral Otitis Media and the Hearing Loss date back to 11/20/1990, and the Vertigo dates back to 03/18/2010. Already had my C&P exams for all the above, and have buddy statements, medical statements and records(Both VA and private doctors)..all submitted. The VERBAL results from the 2 C&P exams were given to me the date of the exams, and there is no doubt ALL the conditions I listed have gotten worse. Percentages aside, is there any backpay that would be due, giving the information I provided above? This information is from the latest Rated Disabilities as reported on my Ebenefits page.   12. @Richard, I tend to agree with you, however, here at hadit.com, there are a few "resident" attorneys who care more about us vets than money. Chris Attig comes to mind, and there are a few more. I did have one HORRIBLE experience with one of the sponsor lawyer groups who advertise here, and I let T-Bird know about it. Personally I've found over the years, Moi-Me-I.., am my own best attorney,and all you guys here on hadit have given me the knowledge, know-how, determination and experience to kick the VA's ass and take names! So, thanks T-Bird, bronco, Buck..., and you Richard for all your help with fighting this "monster" we call the VA! Allan 2-2-0 Second Infantry Division, Second To None!
  13. @Buck, bronco.., et al. Just finished up my 2 C&P exams for my ears/hearing. Audiologist said I have "severe bilateral hearing loss", but said she's not allowed to give me the results. Second C&P exam was with a Nurse Practitioner who evaluated me for increase for vertigo. After looking in my ears, she had me do a series of stands, head back, eyes closed, and touching my nose.., which got me dizzy as hell. Also, on 11/11/2019, VA Audiology fitted me for 2 hearing aids. In addition to above, I'm already SC since 11/20/1990, for: 1. Hearing loss, right ear-0% 2. Perforated right tympanic membrane(ear drum)-0%* 3. Vertigo, with dizziness and staggering-30% * Both ENT and Audiology doctors BOTH confirmed the perforation still exists. So there you have it Buck and bronco. Now let's see what happens here in a few months. Allan 2-2-0 HUAH! P.S., Buck, Yes I also submitted buddy letters, and all medical documents from doctors outside of the VA health system.

  15. bronco, given what you just posted, and the applicable laws you made a link to, my effective date of awards for the SC disabilities I listed in these previous posts, will be 11/20/1990. Allan 2-2-0 HUAH!
  16. Buck, I just filed for the increase like 3 weeks ago. Again, you are spot on, attorney thinks retro will be somewhere around 200K, but time will tell. I do want that 100% Scheduler more than anything. Allan 2-2-0 HUAH!
  17. Buck, my 0% SC hearing loss from 1990 has paid me nothing. So, to put this in perspective, I'm 0% hearing loss from 1990, 0 % perforated ear drum from 1990, and 30% Dizziness and staggering from 1990. ALL these ear-related conditions have worsened, and I have the medical evidence to prove it. NO increases from 1990 to today-Zero. Lawyer thinks like you, BIG $$ retro, possible SMCs. Bronco, your opinion? Allan 2-2-0 HUAH!
  18. Buck, I explained earlier how I came to MY 190% figure. I'm not really not sure why the VA is sending me for a C&P exam. On 11/11/2019 THEY sent me to a local Audiologist for a hearing test, which I talked about here. That test result was diagnosed as "Mildly severe hearing loss", and I was fitted for hearing aids by the VA. I'm currently 0% for hearing loss from 1990. I've also developed tinnitus, which isn't included in my 1990 0% for hearing and ear problems. Allan 2-2-0 HUAH!
  19. @Buck, I posted the new law about not having to file the 21-4140 here on hadit sometime earlier this year. You might call the VA 800 number tomorrow and see if you don't have to file anymore, and being TDIU P&T, I'm willing to bet you don't need to file.   20. @Buck, my ratings: 40%, 20%, 10%,10%, 10% 10%,0%, 0%, 30%, 20%,20%, 20% I count 90% total in VA math. How about you?
  21. Buck, I'm 90% Scheduler, as in writing from the VA. I also got a letter from the VA telling me NOT to send in anymore 21-4140s due to my TDIU P&T, as well as my age. P&T means just that, and the VA has done away with my "Protection Rule" as hey stated in the letter, telling me it's no longer needed. Allan 2-2-0 HUAH!
  22. Buck, I only just got my TDIU in 2016. I'm claiming an increase for the ear problems back to 1990. Ascetically, TDIU(in my case) is 100% + 90% Scheduler= 190% in a layman's terms. Of course as we all know, the VA doesn't do math like we do, so I posted my own math. Make sense? The C&P exam for tomorrow, which covers ALL these hearing and ear issues back to 1990, are what's on the table here. The best estimation a lawyer gave me, after looking over my medical records, was: 50% for loss of hearing, 20% for perforated tympanic nerve, 10% for tinnitus. No SMC's, and some sort of back pay from 1990, round out the lawyer's best guess. What's your take? Others feel free to jump in. Allan 2-2-0 HUAH!
  23. Buck, I don't have one rating at 100%. Tomorrow with the C&P exam, I'm expecting to raise my 90% Scheduler to 100% Can someone who is TDIU get back pay on claims back to 1990? My C&P exam tomorrow addresses ear problems back to 1990, which are SC. Allan 2-2-0 HUAH!
  24. @bronco, While the SMCs are nice, I'm more focused on getting 100% Scheduler. I'm 90% now. Now, should I win these ear and hearing loss issues I stated above, which date back to 11/20/1990, and given that I'm TDIU, can I expect back pay? Allan 2-2-0 HUAH!
