  1. I was booted at 18 yrs 9 months with a p4 like you stated. No more drills after that kind of profile. I was discharged to retired reserves with a 15 yr letter. I recently found out that I should have been medically retired. I sent a packet to abcmr last year, and waiting on that descision now. VA rated it service connection to IRAQ, and the advisory opinion from NGB conceded that I should have had a MEB and that it was likely service connected as well.
  2. Wow, that is alot of evidence!! Thank goodness there are other avenues besides the DAV. I had/have an extremely knowledgeable member on here from Had it helping me. Keep up the fight john!! I am in front of the VLJ also,after a remand to AMC. I had DAV to begin with, except they sat on my claim for alittle over 4 years at BVA, then I revoked their POA, and bam....I am in front of a VLJ. When it came back from the AMC, the AMC assigned the DAV again to my appeal. Wow, i didnt think they had the authority to assign poa's. Oh, wait they didnt read the appeal, nor the evidence, nor the POA. So, again, I had to revoke an already revoked POA.. I called the BVA last week to check up on my status, and was told the BVA was confused as to who my POA was. SAD...I am waiting on some type of form from the BVA to clarify this CONfusion. The ombudsmen at BVA said they sent it last wednesday. Today is Tuesday.
  3. Oh my, thank god I revoked the POA from DAV. That is not anywhere near an argument.
  4. Ketchup, I feel your pain, as mine was denied at the AMC level as well, oh and Majically the DAV appeared back on my appeal as POA. No one has explained that to me yet. Howevewr, after calling BVA last week to check on my appeal status" With the VLJ" the operator told me that the BVA needed clarifacation as to who was my pow. I told them I had sent in a revocation last year before it went to the VLJ, and it was taken off as I had no poa, according to ebennies. It was remanded to AMC and denied,went back to BVA before I got the SSOC, and what do you know, DAV was placed back as my POA. So, I sent in another request to revoke DAV again. So basically DAV keeps wasted my time, as I have to wait on some paper work from BVA to tell them who my representation is. Again, it is not the DAV, just me and my evidence, (with mr. Hoppy's Letter).
  5. I got a packet in the mail yesterday from the DAV asking me to join. All I could do is laugh. After the DAV botched my claim...I think not.
  6. Update: I called BVA today to find out the status of my appeal. Unfortunately, BVA sent me a letter requesting I clarify who represents me. They recieved my 2nd request revoking the DAV as my poa in January. The first one was sent last year around May. In between those two dates, my appeal has went from BVA to AMC to BVA. At AMC, some jerk obviously didnt read the entire file (typical) and inserted the DAV as my POA when it was returned to the BVA. So, with that being said, it looks like I revoked the POA, then re instated the POA, then revoked the POA again. When I recieve the clarifacation letter next week from BVA, I am going to explain it like I would to a 5 year old, so that someone can wrap their head around this concept. I revoked my poa from DAV May 2012 and have not, nor will I ever re instate DAV as my POA. I dont understand how much clearer i can be. The day it was remanded back to BVA, I mailed evidence against the Crappy C&P that was performed (or NOT), along with the waiver of regional office consideration along with the second revocation. I sent the second revocation because it showed that DAV was my pow on ebenefits. I called AMC and BVA to verify the F up. Has anyone ever had so much trouble revoking a poa before. Its like a bad cold I cant get rid of!!!
  7. Sounds so familiar Franks. DAV has been fired (revoked) twice on the same claim for me. Yet, they are still listed as my Representation at BVA. I, like you called and the lazy Bastards said my file was in a room after it came back from Remand (AMC), that they could only handle 300 claims at a time in their office. I told them please leave claim 301 (My claim) alone as I had revoked their representation, AGAIN, yet they still are listed, and I am in front of the VLJ now. I surely hope they take no credit for winning or losing my claim. They have done Absolutely nothing on my behalf!!!!! Hoppy has done everything on my behalf. So I pray they do not send me a letter telling me how they helped.
  8. Ebenefits show i am now with a VLJ, but...even after I revoked my POA Again!, it shows I still have the DAV as my poa. I have tried calling and checking the web all day to find out my status. I could never get through on the phone, and the appeals status kept giving me an error until just now. I will try again tomarrow to revoke my POA. I revoked it before it went to the vlj last year, then it was remanded, then magically the DAV appeared again as my POA. I sent a waiver of consideration along with another "revoke my POA" beginning of January.
  9. I concur 71M. I did the VA home study last october. They issued me a clap without going in to a overnite slumber party. I went to a private Dr. and had a "real" sleep study done. had to go two different nites. They issued me another cpap machine with the correct pressures. The Tech could not believe the VA issued me a cpap with such wide range of pressures. I started with the VA full face mask, but after I got the real study done, i found that the nose pillow mask was good, except if you happen to open your mouth if feels like a hurricane blowing out your mouth. It wakes me up sometimes.
  10. Ok, so I sent out my evidence, Thank you HOPPY!!!!, my question is, did I need to include a 21-4138 with it? I sent it Fed Ex, with signature required. I did not think to include a 21-4138. I did include another waiver of regional office consideration, a waiver for BVA to wait the 30 days, Another "revoke my POA" DAV, 2nd time.
  11. Very funny story today. DAV from Wash D.C. called me. Wnated to know about the POA situation. Wanted to know when I re assigned them as my POA. I told the guy, I didn't that the AMC did. He told me they must not of paid attention when they were filling out the paperwork to send back to the BVA. I told him I was used to it, It seems NOBODY read or pays attention to evidence, poa's you name it. Just rubber stamp it and send it on. i asked him if he had seen my file, my black binder of evidence. He told me no, your file is locked up in a store room right now, we dont have room for it. We can only hold 300 files at anytime. I told him not to worry about file 301, as I was going to submit, once again, a revokation of POA. He told me he seen where I revoked it in April, but I told him I would resubmit, just in case!! he did tell me that if I had more evidence, I could submit it, but to submit a waiver of consideration, otherwise it would go back to AMC. No Problem sir, evidence, revokation and waiver would come very soon.
  12. Well, tomorrow I have an appointment with my PCCP at the VA. I am thankful he filled out the DBQ for me. I am bringing in the last C&P and the descision by the AMC for him to look at. I would really like a letter or something from him to rebut that report. Does anyone think that would be too much to ask for?
  13. I called the BVA again today to ask about the situation with the POA, and was given a number to the DAV in washington. To my surprise, the AMC,DAV and BVA are all in the same building....So that may explain the SNAFU in washington. I just hope I get a fair shake. I asked the DAV if they had my binder and the guy said yes, so I asked what color binder did he have. He didnt know, which tells me he dont know if it is there are not. "WE got everything that the AMC sent us", which still doesnt answer the question if everything in the binder is still there.
  14. Yes i can reconstruct the binder as i made copies of all the evidence. I was advised by hoppy not to resubmit things that i have already submitted with the exception of the amended dbq, dr. Denby letter. But to refrence the other alredy submitted evidence in a letter/paper.
  15. Lets compare the SOC with the SSOC, Does anyone see anything wrong between the two? I think I will include the first SOC since the VA and the last C&P examiner said i have no diagnosis of GERD
  16. Berta, this is for you..The SOC from 2009 and my so called exit exam. Notice, how they admit I have GERD here, but not in 2012. BTW, this other paper was my exit exam. I wasn't discharged until 20 mar 2005
  17. What is RRR?? Yea, i will I am waiting on my advocate, Hoppy, As soon as he gets the "paper" together, I am sending..Maybe another binder, tabbed, and in chronological order....AGAIN. Thats exactly what the AMC got.

  19. Thats what I am talking about. How do I know they didnt just rip it up and throw it away at AMC? So that it wont make it to BVA How can I get proof of mailing a binder of evidence to them. I have the fed ex slip, but other than that how do i make proof they got it, and not ignoring it?
  20. No, they have not cited anything from him. If they did, that would be admitting I have a service connection. All the evidence I posted was in the "Binder" along with Dr. Counselmans dbq/opinion/statement. They read his, i wonder why they didnt read Dr. Denby's letter? There is more evidence in that binder than just what I posted. I just posted the most glaring evidence. The other evidence was VA medical treatment records/endoscopy reports with pictures from 2 different VA Gastro Doctors, and 1 from Dr. Denby (board certified Gastroentologist) my private gastro doc. I have wondered about the binder evidence. Does anyone think it will make it to the BVA in one piece, or, could it possibly be missing some important evidence when It gets there.
  21. Here is what I recieved from the AMC on Monday, 1-7-13. I am aSSuming that I have from the 20th of December to return something. That was the day of the descsion. It was mailed to me on the 31st Of December 12. Maybe someone can chime in as to the suspense date.
