  1. Found out today that my appeal is finally in the hands of a VLJ, not sitting in some inbox somewhere. Ironically, I was in Washington DC yesterday catching a connecting flight back home.
  2. Yes, that is correct Dean. I read another post on here earlier, that was about the DAV and how the Service member lived near the VARO and could keep a very watchful eye, and hand carry claims,Nods and appeals to them. He stated he caught them trying to send an NOD to BVA after he asked for a DRO. It sounded so familiar. Guess thats why I am still at the BVA today. I also asked for a DE Novo Review. Never happened.
  3. This is what I got from Ebenefits today.....and it still waiting to go to the VLJ per BVA ombudsmen. Does this sound right? My Timeline... Date of Progress Progress Progress Office 08/29/2008 Local VA Office Decision RO 12/09/2008 Notice of Disagreement (NOD) RO 02/18/2009 Appeal Pending BVA 09/18/2009 Statement of the Case (SOC) RO 10/14/2009 Substantive Appeal (Form 9) RO 01/22/2010 Certification of Appeal RO 01/29/2010 Received by BVA BVA 01/29/2010 Administrative Case Processing BVA 02/03/2010 With VSO BVA 04/26/2010 With VSO BVA 08/20/2010 With VSO BVA 06/01/2011 With VSO BVA 04/26/2012 With VSO BVA 04/27/2012 With VSO BVA 04/27/2012 With VLJ BVA 04/27/2012 With VLJ BVA
  4. John999 this exact thing happened to me at ST pete. I asked for a DRO and the next thing I know My NOD is with the DAV in D.C. at BVA. Been there awhile... till I dumped the DAV, now I am just waiting for the VLJ to pick it up and work it. Got a somewhat older docket number. Thanks DAV.
  5. FYI , I had a very bad experience with the DAV sitting on a De Novo Review to DRO that never made it to DRO. It ended up at BVA > I revoked my POA and am going it alone. It actually sped up my appeal at BVA by cutting the VSO loose.
  6. Has anyone or does anyone have experience with filing a brand new claim while an older unrelated claim is at BVA. Will filing a new unrelated claim, slow down my other claim at BVA?
  7. How long can a claim sit in the "Inbox" for a VLJ to adjudicate? My docket number is 0940****. It has been with the VLJ since 27 April. Every time I call BVA i get the same answer, "it is in the Inbox for the VLJ to get. It has not been looked at yet. Just curious and anxiously waiting to get this done.
  8. I called that number, was given the same explanation. Just in another line, waiting...tic toc
  9. it says"Date of current progress" 5/9/2012, "current progress" With VLJ Docket number is 0940***. It was kind of strange as benefits has it listed with the VLJ, but no VLJ has been assigned yet.
  10. Another update...I called BVA ombudsmen and was told that my appeal, even though it states with VLJ on Ebenefits, has not been assigned a VLJ yet. I was told because I did not request a hearing, that it has to be assigned a Veterans law judge, VLJ. Tic Toc...
  11. I sure hope this doesn't happen to me when my appeal is granted. I have a very optimistic attitude about it getting granted, but dang. sorry you guys are having such a time!
  12. No, everything looks the same on ebenefits. It is still with VLJ, no new claims files either. as far as correspondence, its the same, I sent in a DBQ that my pcp at va filled out for me. It says received on 5/14/2012. Yes, I am service connected, I just never have gotten one of these before. It makes me paranoid. I don't trust VA.
  13. I received in the mail today a brown envelope from VA. I looked at the post mark, and it said Claysburg,Pa. I thought that to be weird, but I opened it and it was a Veterans Health Benefit Handbook, a letter from Va telling me how pleased they were to be able to present me a personalized Veterans Benefits Handbook, also a form 4107VHA, (something to do about my rights to appeal our decision). So anyway, I checked benefits and my appeal is still with the VLJ. Has anyone else received this in the mail???or am I paranoid?
  14. Yes, i actually downloaded the form I needed and let my Primary care Physician, (VA DOC) fill it out. I then submitted it.
  15. Well, I can only hope things progress along qwiker now, that I don't have a POA. I just sent in a DBQ from my primary care Doc at VA. He did a real good job on it!!
  16. Just sent BVA my dbq from my primary care physician. Thank you all
  17. Update from ebenefits. it is still with the VLJ, but now I have no POA :)
  18. Thank you Carlie, that was what I was going to ask my VA PCP, since he knows more than anyone else about my condition.
  19. Thank you for the replays. I tried to make an appointment with my PCP today, maybe will get one this week and ask.
  20. Can or has anybody done this...Ask your Primary Care Physician for an IMO. Also, has anyone had there Primary care Physician fill out C&P worksheet? I have had the same Dr. since 2005 (my first visit with the VA) so I would think he would know better than a physicians assistant that doesn't speak english. Any suggestions would be appreciated. Ok, I realize that some of this question should have been posted in C&P exam, apologies.
  21. DAV never got my DE Novo review to the DRO. or VA never acknowledged my DRO request. I ended up in the "traditional appeals process". so......its been awhile since my NOD. Its been at BVA , well DAV near BVA since 1/29/2010 Thank you Hoppy and Deanbrt
  22. I know, isn't this guy awesome ....he has got a very nice sharp skill set!!!!
  23. This is what I am submitting to BVA. Thank you Hoppy!! POSITION PAPER.pdf
  24. I think your right Dean, with that paper, I can't see how it can be denied? I just was wondering who assigns the rating level (10%, 20%..ect) thanks for your positive thoughts!! The VARO???
