  2. Thanks. I just filed for service connection for residuals, left ankle sprain secondary to SC bi-latteral plantar fasciitis. Long story short . . . I was walking down some stairs, and felt a very painful stab of pain in the arch of my foot. To escape the pain, I rolled my ankle blowing out the tendion. To me, it's a really easy connection for the VA to make, but with my luck, it'll take a year for service connection.
  3. Thanks for the replies. Hopefully they take into account that the anterior talofibular ligament is totally ruptured, and needs to be surgically repaired. Sorry, I forgot that I will have to spell it out for them.

  5. Thanks Sharon! I found the section, but have no idea what dx the injury would fall under. Basicaly it's a grade 3 sprain (total rupture) have to wear ankle braces or my ankle will fold under. Any Ideas?
  6. Quick question, How is the Ankle rated? I can't find where it is rated in 38 CFR. Here are the results of a recent MRI of my ankle: 1. Findings present consistent with a stenosing tenosynovitis in region peroneal ligaments cephalad to tip of lateral malleolus. 2. Findings present consistent with degenerative changes/possible tendinitis involving segments of peroneal tendons distal to tip of lateral malleolus. 3. Normal anterior talofibular ligament not identified. This may be reflective of a chronic disruption. The podiatrist says the talofibular ligament was ruptured, and I will need to have it rebuilt. I will be filing a claim, but I don't know how it's rated. Any help would be appreciated. Thanks in advance!
  7. Got mine from the Buffalo VARO, all information is correct. I have one claim opened in Oct, but nothing else going on. Is this VA wide? Or is it a Buffalo thing?

  9. Yes, I am asking for advice on trying to establish the earlier effective back to the date of the original claim. 1. I filed a claim for my back & neck Oct 2008 due too a car accident I was in while on active duty. I had forgotten that I filed a claim for my back & neck in 1995. 2. I got my "C" file early Mid November & noticed a lot of missing documents, including ALL the medical evidence I had sent in the origional claim. Also missing are selected records from my SMR's, especially ALL the physical therapy notes for my back & neck treatments. (I have contacted MPR to have my SMR's replaced.) Also missing is an INFORMAL CLAIM I filed earlier this year for PTSD & TBI from this accident. 3. In the "C" file were: a. the origional claim that was filed on 8/11/95. b. Request from RO for medical evidence dated on 7/9/96. (I recieved this, and sent requested Info) c. Request from RO to obtain info from Chiropractor dated 9/4/96. (I recieved this, and sent requested Info). d. Denial letter dated 12/9/96 (which I never recieved) reason for denial was no evidence being submitted. Note: the denial letters are in duplicate in the "C" file. 4. I sent the RO the following information, but NONE of it appears in my "C" file a. A letter from my chiropractor, stating "more likely than not, back & neck issues caused by MVA in military"
  10. Thanks for the help. The only evidence I have are the copies of the 4 letters I sent back then. I didn't know back then to send the letters by registerd mail, also didn't have a service officer to help me. Does
  11. Great point SouthernBelle! Award the raters for doing their job correctly, and not award them for the number of cases cleared. The big problem is when you give management HUGE bonuses for their employees' work. They make a lot of money if they can show their bosses in Washington their office closes a lot of cases. They push their employees for quantity instead of quality.
  12. I got a copy of my "C" file and viewed it for the first time, and found that It was missing important documents. In 1995 I filed a claim for back, neck & head conditions due to 2 car accidents that I was involved in while on active duty. I had had recieved a letter from the RO asking for more information, to which I responded with the requested evidence. I had never recieved another response from the RO. I sent the RO 4 letters in the two years after sending the evidence but never got a response. I eventually gaveup & forgot about the claim. In my "C" file I found a denial letter for the claim, but I didn't find any of the letters that I sent the RO. I also found letters they sent to me to an address that I never lived at. I never recieved the denial letter, or even got a C&P exam. I had forgotten all about the claim until I viewed my "C" file. Do I have any options? I ask because I filed the claim for my back & neck again this last October. Any advice would be greatly appreciated. Thanks!

  14. Purple, Your preaching to the choir. I've been sseing the chiropractor since '92. When I have flareups, there is nothing better! Unfortunately as I get older, the flareups are more frequent, more often and more painful!
  15. Thanks for the advice rental guy! I will try and see my PCP. The rehab doc didn't seem to believe me about the pain when she examined me, now she might. I need to convince her that I need mri's for the rest of my back, but she seems to want to take everything slowly. As far as the SC, I'm gathering evidence now. I was given P.T. in the base clinic, and I have been seeing chiropractors ever since. Any idea what the potential rating would be based on the MRI? Thanks!
