  2. Got exam appointments set up for Feb. 3rd, rolling along fairly quickly. Guess they are doing this for current level of disability right? Any advice would be great.

Yeah two issues, Kubrick, your VARO actually called you, that is amazing to me, great though, anytime I call Pittsburgh it is like you are interupting their day, now and then you get a nice one that will give you more information. Congrats, Congrats, hope to see you post some more good news, will be watching.
  4. awesome news, I just got word that I have to go for two C&P exams on two Bva appeals that were recently granted service connection. Not sure on effective dates yet.

  6. Well the VA sent out a letter to me that they are setting up two comp and pension exams for the two issues that the BVA granted. Seems like they are moving along pretty quickly on it now. I am still a little confused on the wording in my decision, I apologize in advance if you feel you have already answered this but if anyone could give me clarification on what they thinks this means, please let me know. The wording is this. "The RO previously denied service connection for PTSD in March 2003 and November 2005. The instant claim for service connection for an acquired psychiatric disorder is based on additional psychiatric diagnoses that were not considered in March 2003 and November 2005 RO decisions. This issue must be adjudicated without regard to prior denials that did not consider the additional psychiatric diagnoses. Boggs v. Peake, 520 F.3d 1330 (Fed. Cir. 2008: Ephraim v Brown, 82 F.3d 399(Fed.Cir.1996) Hence, the instant claim for service connection for an acquired psychiatric disorder must be decided without regard to prior denial of service connection for PTSD. " I guess my question is, do you think they will go retro to 2003, or 2005. The BVA granted, PTSD, obsessive compulsive disorder and major depression as service connected. What does the "without regard to prior denials of service connection" mean, are they counting that time frame or not. They should according the way it reads, but it may be wishful thinking.
  7. Thanks for the reply Carlie, I check back here quite a bit, this is such an anxious phase, like the waiting is almost over. I know they may set up another exam, thats okay, I have been going to the VA on a regular basis, about every three months so when they do the examiner will see current records anyway.
  8. 800 number says 52 days from Jan 5th, called them to find out why I can not see and follow on ebenfits and was told this. So hoping by Feb. 27th.
  9. Found out today that it is back in Regional office, awaiting a rating specialist, then it has to go to notification once this person is done with it. Wonder how long this will all take? I deal with the Pittsburgh Regional office.
  10. halos, Yes, I have to work to pay the bills, will take a look at not working later, for sure if I get PT, I probably should not be working and would be justified in not, I use a lot of sick time. I got my yellow envelope today, it is good to see it all in writing. They did state that mine is not a remand, it is only going back to local office for rating purposes. What was your issues and how far did they go back for retro?

  12. Hey Carlie, Looks like everything is closed up at the BVA on my case and it is headed back to the RO in Pittsburgh, YUCK, hopefully, they will treat it with kindness once it gets back there. I was reading through some of your posts and was wondering, in your oppinion, how long do you think it will take for mine to be completely done? I know it is on its way back to local office, but will they sit on it or will it move once it is there? I can kind of figure out the gyneocological on, based on the date of my hysterectomy but the anxiety and PTSD one is tricky for me, I had some rough times dealing, but I am sure they will not acknowledge when I had my head in a bottle for years. Who knows? Anyways, how long do you think it will take in your oppinion for me to be done and the $$ to be in my account? I see you went through a long term claim that is why I am asking. thanks
  13. Case is officially closed and is back to the RO.

Letter was prepared on 12/16/11, however I found out today that both of my issues that were service connected now have to go back to regional office for rating purposes, that the BVA does not do any of this. The DAV told me that this is about a three month process at our local office. He said that the BVA found that I submitted credible evidence on both claims and that these need to be considered without any credit to past denials. what ever that means, I am hoping it means that they will pay the back pay to the initial filing dates of 2001 on one and 2006 on the other.

  17. Thank you Carlie for the response, I guess I will have to wait and see then what comes out of it. Since there are two issues, and I am currently at 80%, I am thinking that maybe this may put me in the 100% window or close to it. I was wondering about how far they would go back. . I have given them all the documentation, I guess what is so frustrating is that every issue that I have had service connected has had to go through the appeals process, I am wondering what is up with the RO staff in our local office, I have sent hard evidence, backed up by military records and medical records on the civilian side.

So I am told that both my gynecological and my anxiety issues are considered service connected, I have not recieved official word yet, ebenefits says it is "pending dispatch" The DAV tells me that now it will be sent back to the RO and I will have to have exams to figure out what the severity is to rate both of these. Anxiety/PTSD was initially filed in 2002, I was denied during this claim and appealed it, will they go back to this date? Gyno was filed in 2006. But I had information in my service record well before this, which date is relevant here??
  19. I think the problem is seeing it's status, leads to a lot more questions, LOL. This is an old claim, the DAV can't see anything in their system yet, they just said that they only see disposition approved, that could mean anything. They thought that since there was no remand that was a good thing also. I am not sure, guess I will have to wait and see, should not be long now.
  20. I do have access but what letter are you talking about? When I looked at the benefit letter it still said the old rating, is there another letter I should look at? I think I am missing something on ebenefits, I have seen people on here before talking about the letter generator, but I am not sure I am looking at the right thing?
  21. Well decision is made, it is pending dispatch, DAV says in their computer it just says "Disposition approved", nothing else is in there yet, but he also said that they did not remand it and that is a good thing, any thoughts, does disposition approved mean good news???
  22. thanks for the reply, what you say makes sense, I was just watching it bounce back and forth. Hope it is a positive outcome
