  1. Thanks for all the replies, everyone. I'm sorry to see that my daughter isn't the only one going through this.

    Yep, we know she has the choice of my retro date or the date of notification; I have the letter in front of me as I type.

    My VSO said to send them a letter saying essentially "hey, pay attention! Eligibility date is 2009. That date was chosen. School verified enrollment" and that would settle it.

    The VA rep from the regular VARO said that the only way to clear it up is to go to the Education office. Lucky for us, it's only 600 miles round trip... It could be a lot farther, because there are only 4 offices that handle DEA in the whole country. And there isn't even a phone number to call to make an appointment.

    What a great way to discourage vets from trying to get their due benefits....

    Before you spend the $ for gasoline, try sending in an IRIS about this issue and also call the 1-800 line, I know, I know .... you don't always get the same answer at the 1-800 BUT all you want is a phone number. I bet most of this can be taken

    care of (if needed) by FAX. Unfortunately, it doesn't happen overnight. I just went through the DEA enrollment process and today is actually Day 1 of the quarter, I started the DEA claim as soon after we received my husbands new rating and

    a trip to to local community college and speaking with the VA Rep there helped out alot. She gave me a list of things to do, file the claim through VONAPP, etc. Did you daughter go to school locally ? You might start with the VA Svcs office

    at the school first.

    I'd tell ya not to give up but it sounds like you have no plans to.

    There is an obvious mistake someplace. DEA is started either 1.) the date you became eligible to receive it or 2.) the date you choose, so long as it's completed within 10 years from the date you were notified.

    Your daughter has a choice which date to use. Was she full or part time student ? FT = a higher rate of assistance, in our state, 12 credits = FT @ $936.00 a month. Rates for 3/4 and 1/2 time are options as well,

    perhaps all states are different BUT your DEA date is the date you choose as it was outlined in your award letter.

  3. WOW, all that in 2 hours on Ebenefits. The letter generator on Ebenefits shows me to be combined 100%. I just don't know much more. I have no idea what the 100% benefits are yet. I don't even know if its P&T or what. Considering I've never been 100% I'm clueless.

    Thanks for all the help. I learned everything from reading these forums. I submitted my claim myself and WON!

  4. Envelope arrived today! Deposit was made last week, but now it seems I have everything I need. A nice letter from the VA saying that my 100% is P&T, and a little chunk of change in the bank. Most of all though, I had all of your support through all of this. Thank you again Hadit.com members! I look forward to helping other vets as you have all done for me. Thank you again!

  5. For some reason I can access any of that on ebenefits, I have full access to myhealthevet and did an update under DOD, can link through there but can not access anything. Got my brown envelope today. I have a call in to the authorization lady to get full access.

    You have to have an "in person verification" process completed. Either by way of your local Regional Office or, as my husbands case (and I just found out this today)

    since he is 100% we had gone to the local base to receive his MSW card and they did an in person verification, even though he was already in the DEERS system having

    been active duty (years ago), they still did an in person verification for him to receive his MSW card. Lo and behold, I decided to give a shot today and was issued a

    verification number and went right into the ebenefits site, no problem.

    Maybe and I'm not 100% sure, but perhaps this is the reason you can't access anything ?

  6. Many do not understand what some veteran's spouses have to go through. (Sometimes it seems like they're worse off than the vets) Without my spouse, I honestly do not think I would have made it through all of this. :biggrin:

    A sweet sentiment ..... for certain.

    My guy says the same thing. The times it really hits me in the heart is when I hear from friends or family

    that he tells he could not or would not have made it through with me.

    I know he would do the same for me as you would for your spouse....

  7. Wonderful - Wonderful, with P&T come a slew of benefits, DEA and ChampVA, base privileges, etc.

    As Carlie mentioned, check your State benefits also. And, a National Park pass, and ..... so on and so on.

    I ask everywhere we go, movies, etc. if they offer a discount for military.

    Lucky for me, we live in a state that a 100% sc Veteran does not pay for their license tabs on vehicles and

    dependents are eligible for waiver on State colleges, whether it's community or university. And, the VA will

    help with costs of books, etc, depending on if your dependent goes full or part time.

    Breathe deep and revel in the reality, soak it all in .... the retro doesn't come around often.

    And, if they gave you an earlier effective date of the 100%, you could be entitled to a refund from ChampVA

    for any out of pocket covered medical expenses you paid for your spouse, eligible children, etc. back to the

    date of eligibility at the 100% rate .....

  8. I have been 100% P/T and SMC-s since September of 09. While I don't tell many folks I am SSDI also I do tell a few and I almost always come away with the "well you look great" from most.

    Kind of makes me feel like I should be working, but I know I can't this tends to add to my PTSD/depression and just wondered if other vets out there get the same thing? I mean I do not walk with a cane or ride a scooter BUT I do have a bad heart and shy away from doing anything to strenuous yet the statement you look great still kind of upsets me.

    Oh Well i worked for 50 years and I deserve a break I guess.

    If you met my husband today, you would never know he is as sick of a man as he is. Other than losing weight, which actually made him look younger and pretty dang fit,

    he doesn't look ill at all. But, folks don't see the behind the scenes things that go on that I do ...... between the two of us, we make light of it knowing that if he were turned inside

    out, he might not look as well as he does ! When someone remarks in a saracastic way (and you know there are some who do) he just tell them " Oh I might look good on the

    outside but you should see the inside !" ....... usually it shuts them up in a polite way.

    Please don't ever let the feeling of being uncomfortable last any longer than 60 seconds, let it come and then let it go. A disability is an inability to perform or do things the way you once could

    or the way others can do. YOU are a whole and total human being as you are. Let your light shine Stillhere .... Let it shine brightly to pave the way for those following in your footsteps.

  9. I just did the "numbers" and I am including this in my contention of CUE to the VA:

    Had Congress wanted all ratings in excess of 100% would be combined using the combined rating schedule. Since combined rating is determined by remaining "efficiency"…ie. According to combined rating table 99% disability leaves an "efficiency" of 1%, any additional disability ratings would have to be deducted by percentage from that 1%, thus a person with an "efficiency" of 1% who is further rated at 90% + 90% would have an "efficiency" of 0.81%. Theorically, no one would ever be entitled to SMC 100% plus 60% .

    Ah, I think it's a home run!!!! Congrats to everyone!

    This would be correct as a the recent rating my husband received was 100% for one condition and SMC at the HB rate because he is rated at 100% for a single condition, with

    and additional 60% or more rating for one or more conditions (verbatim from the rating decision) .....

    I read this as stating they didn't use a "combined" rating schedule for the SMC award. It also stated that "they do not add the individual percentages of each condition to determine a combined rating" (after the 100% mark was reached on one condition standing on its own)

    Go for it !

    and, thank you for sharing your finds with the rest so they too can follow-up on their claim.

  10. Got good news on Tuesday that I have been approved for SSD.

    Today I got the brown envelope from the VA.

    For November 23, 2009

    30% Coronary artery disease (Nehmer granted) associated with agent orange

    Tinnitus 10%

    Bilateral pes planus 10%

    Hearing loss right ear 0%

    added to PTSD 50%

    back disorders 20%

    for 80%

    Then on October 26, 2010

    60% Coronary artery disease

    for 90%

    They have defered for additional medical evidence

    Aoritic aneurysm associated with coronary artery disease

    Diabetes mellitus type II ( I am on metforman)

    Periphal neuropathy, bilateral upper extremities associated with type II

    Periphal neuropathy, bilateral lower extremities associated with type II

    And denied COPD and hearing loss left ear.

    At least I got some answers and when the check is in the bank I can take my sweetheart out to eat, she deserves it after being with me for 42 years.

    GREAT news Flatbroke ! Now that you have at least 1 condition at 60%, you should be eligible for IU or, you may end up with 100% once the

    deferred issues are decided. DM2 on medication is 20% -- got to have the restricted activities to bump up to 40%. You might be in that ballpark

    with the heart issues.

    Either way, I am a very proud VetsLady of a Marine Corp Veteran !

    Congratulations and enjoy the feeling of taking your lovely sweetheart of 42 years out to eat. Splurge on a little dessert, just a little .... (wink)

  11. Well done Bill. Congratulations on the well deserved and earned award.

    The Chapter 35 benefits for DEA and ChampVA will be part of the IU ....

    and, ChampVA will reimburse for all of your dependents out of pocket medical expenses (minus any premiums)

    back to the date of the 100% award.

    As Carlie mentioned, check on those State benefits as well.

  12. Just got back from seeing a Neurologist, as my hands were shaking out of control, and I have been falling down and hurting myself, and other issues. He did a bunch of test, and I did not do well at all. He Dx me with Parkinsons, and said my tremors masked the Parkinsons. He gave me medication for Parkinsons and I will go back for further test. Life just does not seem fair sometimes.

    Awww, Papa --- sorry for this new diagnosis. I'm sending you positive vibes for positive treatment.

    I'm sure you know P is on the presumed AO exposure list. Hopefully, this medication will help ease some

    of the trials and tribulations of the symptoms.

  13. It's a Huge Victory to have your claim granted benefits the 1st time in ..... Don't beat yourself up too bad, it's an odd feeling being finally recognized, it was for my husband.

    Have felt like we'd fought tooth and nail for too many years (he actually filed his claim 8 years ago) it was a HUGE relief to finally receive his justified rating. He had a moment

    of a depressed feeling and then it went away. For us, it was years of haggling, evidence, fighting for his benefits .... and then, wham ... all within a 2 month period it was done.

    So, in our situation we were doing the Happy Dance that the major issues were sc now, the benefits are in place and we can move forward from this point.

    This is a new phase of your life. Spring forward from here. Use the knowledge you gained to help someone help themselves. These fine folks here on HADIT are amazing,

    all of them .....! Including YOU !

  14. yes sir...the only thinkg i know is that my claim has been at the rating board since Oct. 20th and that I have been at the decision stage ever since then!! please advise

    I know, just as many Veterans and their family members here do also, that it's very hard to wait and wait and wait. You already have the hardship request in, you can verify with IRIS that "hardship" has been attached to your claim file. Not sure if you have a VSO helping you out or not, but they may be able to find out where the claim is at. You can also contact your Congressman or Senators office and speak with their liasion person about the situation, they can put in an Inquiry for you, it should not hold your claim up since it's at the RO level and each RO has liasions who work with the Senators and Congressman on behalf of their States Veterans.

    It seems like a long time when you are on the waiting end of a decision, many here have been doing just that for years. Having a hardship involved, whether it's financial or medical makes the wait even harder. It's like watching grass grow at a ski resort in winter. We filed my husbands claim 8 years ago and it took 6 of those to get him any sc and another 2 to finalize the rest as his claim ended up at the Board of Veterans Appeals. We had medical and financial hardship attached, the VSO we began with 8 years ago filed the claim and filed the appeal but in our case that was it. We elected to go solo and released the POA of the VSO. Many VSO's do a fine job, some not so fine. Ultimately it's your claim and you have to be involved as much as possible or, your spouse. After waiting 5 years for "something" I called our Congressman's office who saw my husband hadn't even had a C&P exam and that got the ball rolling .... but it took a very long time and just about took us to the outer limits. Believe me, the folks here on Hadit threw a life vest out to me more than once.

    It appears that claims are moving through and if all of your evidence is in and solid, then hopefully there will be a decision very soon.

    I hope these words help in any little way, no Veteran should have to wait and wait and wait.
