  1. How often does the VA reduce VA ratings. From what I have read it does happen but not very often.
  2. Hello my fellow family members. Need some advice on getting my prescriptions filled. I take a total of 10 different medications and will not have a problem having most of them filled and sent to me. However my oxycodone refills are a real hard one. We are going to be traveling for the next two years and will only be home ten weeks of the year. We will be traveling around the world but need to get our refills. Any advice would be great. We have no family members who can forward the medication.
  3. Thanks for the heads up on potential VA delays. We don't have any problem with delays as long as we are told something. We check eBenefits weekly and have sent a letter to the VA office in Reno and got a standard letter back. We are busy but we will get to your case ASAP. There was no mention of working on old VA related cases. I checked again today and still in status 2 on eBenefits.
  4. My wife has been waiting in the Decision phase for almost 10 months on her current claim. We have been checking in with ebenefits for the last 9 months and there does not seem to be any movement. According to ebenefits web site she is in level 2 and they have all the information they need and simply are waiting on her file to be rated. This is direct from ebenefits: Next Steps: Your claim is currently located with our rating activity. We will review it to make sure we have everything we need to make an informed decision. If we have everything we need, we will prepare a proposed decision on your claim. The length of time it takes to complete the Decision Phase depends on several factors, such as the type of claim filed, complexity of your disability(ies), the number of disabilities you claim, and the availability of evidence needed to decide your claim. The Decision Phase is completed on most claims between 16 and 28 days. The number of days provided is a national average of time claims spend in the Decision phase based on data at the end of May 2010. Please be advised that a claim may take longer in this phase based on the specifics of your claim.
  5. IRIS is still not working, i wonder if it has to do with the region you select.
  6. Still not able to get a response from IRIS.( 2 plus months and still not working) I get the following error code: va iris cgi error. I have tried 6 different computers; Apple/PC/ and Phone with the same response each time. I have followed all the IRIS instructions and have used IRIS in the past with no problems.
  7. The last C&P report stated: VA Examination was conducted and results show an increased severeity of your lumbar spine condition that would warrant an evaluation of 40 percent disabling. However, VA revealed regional weakness or sensory changes which deviate from accepted meuranatomy. We requested VA examiner to clarify the findings and examiner respnded that the range of motion findings are not reliable and that further examinations are not expected to bring forth a different outcome. That is why we asked for another C&P to be accomplished with a range of motion examination completed. The last Doctor never did a range of motion. My wife is currently rated for her back, however it is at zero percent. Based on all of the finding she should be at 40 percent. The VA Doctor even stated that in his report. Hopefully with the Range of motion completed she will be rated correctly at 40 percent.
  8. My wife was medically discharged from the USAF 15 years ago and rated at zero percent from the VA. We were young and did not know what to do so we simply took the rating and moved on with our lives. My wifes condition has become severe and she can hardly get out of bed. We found this great site and started our quest for justice and we really owe so much to everyone; Thank you , thank you , thank you. My wife finally received a 20 percent rating from her knees but she is still rated zero percent for her back because the last C&P did not have a Range of Motion completed. We notified the VA through our DAV office, the VA has done a great job getting my wife another appointment to have her ROM completed. We have found many helpful people along the way to include the VA, the DAV, the Doctors and nurses at the VA, and of course the great group of people on hadit. My wifes last C&P clearly stated she should be at 40 percent for her back, however there was not a ROM test completed. The Doctor even put the words that she should be at 40 percent. My wife recent C&P was only 5 minutes long and it was simply for Range of Motion. Can someone please look at the report below and give us a opinion? Again Thank you all so much. Objective abnormalities of Thoracic Sacrospinalysis Spasm Left: Yes Right: Yes Atrophy: Left: No Right: No Guarding Left: No Right: No Pain with Motion Left: Yes Right: Yes Tenderness Left: Yes Right: Yes Weakness Left: No Right: No Is the muscle spasm, Localized Tenderness or guarding severe enough to be responsible for abnormal Gait or abnormal spinal contour: NO CERVICAL SPINE RANGE OF MOTION- (Thoraco-lumbar spine range of motion) Active Motion Flexion: 0-30 Degrees Extension: 0-8 Degrees Left Lateral Flexion: 0-15 Left Lateral Rotation: 0-15 Right Lateral Flexion: 0-15 Right Lateral Rotation:0-15 Is there objective evidence of pain on active ROM: YES Additional Limitation with Repetitive motion Is there objectvice evidence of pain following repetitive motion? 9. I called the VA today to request a commisary letter and they filled one out and faxed it to me. I received two separate faxes one said I would have another evaluation in March 2013. Is this normal? The other letter simply said that I could have another exam in the future. How often do they complete these exam, is it every three years? When I was rated 50 percent I don't believe I ever had a re-evaluaton. Does anyone know?
  10. Thank you so much for all the kind words. I was awarded 100 percent not TDIU. I really wish it would have been P& T. I think I will leave it alone I do not want my 100 percent taken away or reduced. I figure with one million claims in the VA que I will try to fly low and slow and enjoy this huge victory. Again thank you all.
  11. I also wanted to thank the folks at the VA, all of my VA Doctors and their support staff have been great.
  12. It has been a long road and a crazy journey. I was so happy I think I moved my hip out of wack. I wonder if I can claim the hip on my VA claim? I really would Luke to thank my hadit family for all the help and information I needed to get my claim awarded. It has been a long emotional road and the thousands od stories on this site kept me fighting. I lost several battles but I have won the war. My only concern is they did not make it permanent. Doctor Bash was a great help along with my DAV representatives. Thank you everyone
  13. We have caught the C&P Doctors in lie after lie. When we approach the DAV they tell us it is okay. We don't want to rock the boat is what we are told. I believe our DAV reps hands are tied and they have to be careful of thebattles they chose. My wife is in really bad shape and can barely walk due to her neck and back and both are service connected. She needs both knees replaced and can not even wipe her self when she goes to the bathroom. She currently is rated at 20 percent. She was medically discharged from the military back in 1995.
  14. I hired an Attorney and he saaid it would take between 18-24 months for approval. So I guess I will wait.
  15. Yes I applied for TDIU back in October, I followed the advice of my Hadit family. I noticed on all three of my C&P evals it mentioned both an increase and TDIU. All three of my C&P's went very well, I had some good VA doctors and contract doctors. My last C&P was on 17 February. Hopefully I hear something by June or July.
  16. Currently 40%back 10% Neck 0% billateral tinnitus and hearing Recent Mri show severe DDD and two bulging disk and two herniated disk in my neck.
  17. Can anyone tell me what level 40 means. Is it my GAF score. Any input would help. Carlie do you know?
  18. I have applied for social security. I am working with an Attorney to get approval, I was denied on my initial try. My attorney said that is the norm and most of his clients win when they go before the judge. His estimate was around 18-24 months until approval. I did let the VA know I had applied for social security.
  19. Thanks again for the good words, it is very hard dealing with the VA. Yes I applied for migranes, my other C&P exam the doctor said: Vets migraine headaches with associated dizziness and loss of balance are as likely as not the result of his service connected cervical spine condition. Migraines happen 8 times a month lasting for 1 day, Tension headaches are daily. I also applied for fibromyalgia and the same VA doctor agreed with my private Doctor that I had fibromyalgia and it both connected the fibromyalgia with my service connected conditions. I did not know you could file for sleep apnea when I got out of the service. I was diagnosed with sleep apnea 18 months after leaving active duty. I had two major operations to relieve the problems. I have not applied for sleep apnea at this time.
  20. Hi, thank you for your quick response. It is so awesome to have a great hadit support group. I applied for major depression and have a private Doctor who wrote several letters to the VA. This report was a VA contract Doctor, there was no GAF score on his report. His words to describe my prognosis was: GRAVE. He said I got depressed during my time in the service after my accident. He also wrote that the patient does not help with cooking or cleaning. He occasionally but rarely drives he does not do the shopping. He does not see his friends or relatives. He does not read. He has no hobbies. He is in pain all day and spends most of the day in bed.
  21. I received a copy of my mental C&P today and do not understand. Guidance and support wouldbe great. Axis I. Bipolar 2 disorder, depressed without psychotic features, level 40 2. Obsessive compulsive disorder, level 50 Axis II. 1. NOS Axis III 1. Back injury in the service 2. Fibromyalgia 3. Sleep apnea Axis IV 1. Back injury, the patient fell and injured his back while he was in the service, level marked Axis V. 40/40
  22. Got my denial from social security, I will be calling a lawyer tomorrow.
  23. Have someone in your C&P every time is what I have read on sever hadit forums. We try our best to make sure this happens.
  24. I would love to have this Doctor no longer in business. He is a fraud and several really sick people are not getting approved because of his lies. He was called to testify in California and on the stand he said he would not say anything unless he was paid. I am more bothered with the social security folks. They know the reports are false, but they have another tool to deny. Yes I plan on hiring a lawyer if I am denied. I would go to the medical board, however they are worthless. The medical board is a group of Doctors who protect each other. It really makes a person feel powerless to the system. People are losing their homes, families, and their lives waiting years to be approved. It is criminal in my mind, social security is a right that we all pay into. Both my reports went into social security 9 days ago so I should here back soon.
