  1. If the veteran with AO IHD claim, it might be interesting to know a couple of things.

    Remember, the VA may decide to change the rules at anytime, and use different scales and even change the Federal

    registary if they indeed post the new AO proposed rules.

    1. a vet with a ICD cannot be made to have certain EF tests. The regulation forbids the use of many of the invasive

    and dangerous tests.

    2. If the veteran has a ICD, the federal regulations for IHD for service connection grant the veteran 100%

    (AO IHD maybe different, who knows for sure..)

    will the VA get off it's butt and publish the proposed rules today is the dealind may groups have set.

    We all need to remember that the types of test or t he determining factors for Heart Disease. The Criteria states on EF rateings that the measurememnt of EF is based on either of 2 tests.

    A Heart Echo or a Cardiac Cath.

    A Heart Echo is a fine test if the Veteran is of normal size. If the Veteran is a bigger person with a big chest then it becomes a guess as the Ultrasound waves have to pulsate through a thick walled chest and the image becomes somewhat distorted.

    Cardiac Cath is the Mac Daddy when it comes to measuring EF as it is an actual measurement taken with the Naked Eye. It is a little more risky but it cant be questioned.

    If you have had several MI's then you obviously havce had a few Caths in your day. These out weigh the old echo my a mile.

    Request that Mr. Loiacono e-mail or fax you his "authorization letter" from the VA's office of General Counsel.

    In the meantime, I'll look to see if he or any other such animal has been entered into the database for VA reps.

  3. The vet's records are lost so the VA says they can't make a correct determination of his ptsd rate. If he has any records of combat from WWII why should he not get benefit of doubt? I bet thousands of older vets have died while the VA played these games.

    gee, I am so surprised they dragged their feet, and let tens of thousands of WW11 guys die off, who'd thunk that?

    REMAND

    When an appellate court sends an appealed case back to the trial court for further action, the case is said to be remanded. This usually happens if the trial judge has made an error which requires a new trial or hearing. For example, assume that a trial court refuses to allow a party to introduce certain evidence (believing it to be inadmissible under the hearsay rule). If the appellate court decides that the evidence should have been admitted and that the exclusion of the evidence was prejudicial to the party offering it, the appellate court would likely remand the case for new trial and order the evidence introduced

    Guess that means another hearing ? will the Vet survive ?

  5. In my case when the denial is given, I know what to do, and what to say, but the wait for an appeal award is not my idea of

    a good time........

    But we all try to think about more sunny things, like.......... now what was I saying ?

    My AO exam was fun.... poking me in various places, and asking stupid questions that must have been asked by the VA 20 times in lat year. Urine & blood.... no mention of e-ray or anything......nor interested in my IHD one bit... strange as that may sound.. or never asked about type 2...... but I did get travel pay... and I read a few pages in a magizine that was 5 years old, and a new picture of your fearless leader on the wall.

    Hey Papa,

    If you get the exam or already have, let us know how it turned out. They take plenty of blood and I also got a chest x-ray after being asked if I wanted one. The corn ball doc said it didn't matter one way or the other if i did. The touchy - feely part of the exam was a joke. Doctor - Does this hurt? Patient - Gee, did you actually touch me? :blink:

  7. Wall I just wanta get evneone up on what's happening with me. I invested half of my retro in a mutual fund and the rest I paid off bills. I was goin to go out and buy a car but shiot mine runs jsut fine and it's paid for.

    anyway thanks for all the suggetsions and advise. greaat site.

    plenty of people here that actually know 10,000% more than me, I just read the posts, goto the CFR's, try to find out my stuff and accidental stumble across other stuff... with the help of people that are experts....

  8. Vperl, no thank you. I have my own, but if you wish to borrow some, I can arrange it. Do you work at the post office? I am sure Testvet does & looks like billy2 does also. I also have trouble getting my direct deposit to show up at the bank. I use Regions bank & I think alot of the delay is with them, even tho they deny it. I get my SS check in the mail on the 4th Wed. for the last 2 months I get it on the following thursday. I get my va check in the mail & it was late last month, did not get it today, but it's not the first. I think with the change in mail truck routes that it just takes longer for the mail to reach it destanation. My CS check is direct deposit & it is usually a few days late. I hate it when the 1st is on or around the weekend.

    Well, actually I worked as a 90 day temp one XMas season in '74..... damn I know that the job can be tuff, I can not remember my name let alone 900 or more and case that mail....and flats

    yup and if you die in a car accident tonight the government will ding the bank to send the deposit back to them as it wasn't supposed to be deposited until the 1st that was one of the things I hated about the Post Office we use to get fax lists from the SS on the 2nd or 3rd of every month telling our bosses which SS checks they were supposed to pull out of the bundles we got it seems that they get an updated death list and send it to all post offices between the date the checks were actually printed and the date of distribution and we had to go thru and pull the checks out of the names the feds sent us so we would have widows standing at the mail box wondering where their SS check was dirty business government checks and death

    Two of my best Boot Camp Buddies are retired carriers, and are they screwd up....make me look like I'm fine and dandy....

    I have to remind them they are OK, just take their meds, and be OK.... thier wives feed them thier meds...

    dang since my lawyer fired me I guess they will take me off the sensitive 7 list rofl she sent all my files back to me with a letter explaining that since she had finished the work on my pro bono case that she was returning my files so that if I found another rep they would be able to review my C File and the letters she had generated during the time she represented me

    I am 55 this year I hope they leave me alone between the PTSD and the CAD I think they would have a hard time claiming I got better....

  12. The 10-% was for SC Malaria while in Da Nang on tour there 69/70

    now I underestand that the 10% is now 0% becase they said i dont have a current case that i have it later in life. But I cant give blood as my white blood cells are bad and I cant give blood to any body from having Malaria.

  13. SC diseases free drugs

    In my experience the PH was all I needed not to have to pay co-pays for SC ( never filled out forms on income) ...... been doing it several years only Co-Pay were non

    SC diseases...... with AO type 2... free drugs SC heart disease.... free drugs......

    If you have PH and did not pay any co-pays except for SC diseases..... you say the office visits have co-pays one should have paid, if they wee not SC ?
