  1. Go to release of records at the VAMC-they print off what is in the system, so it shouldn't slow your claim down at all. The official ruling is that you shouldn't be able to get your C&P results until your claim is done, but it seems that as many RO's and VAMC's follow that as don't. If your C&P was done by a contractor you'll have to go through them to get your exam results.

  2. Honestly? Depending on where your RO is in the country, and how complex your claim is, and how much evidence you submitted-as long as it takes. I'm not being snarky, that's just the facts. You can look up your local RO's caseload by googleing "Monday morning workload reports" and then clicking on the most recent week. This will take you to a spreadsheet. Once there, look at the Aggregate totals tab and find your RO-this will tell you how many other claims and of what type that they have backed up.

    What I mean is you may have the same basic symptoms, but if you can work you get 30%-50% for depression. If you can't work you may get 70% or even 100%. I started at 10% then 30% and when I could not work anymore I got 70% TDIU for symptoms I had had for years except I was able to keep working. What separates those with MH issues from getting 30-50% and those who get TDIU or 100% is the ability to work.

  4. +1 getting your service records! This cannot be underestimated in importance. Also get any civilian treatment records if they exist from your duty time. Were there injuries with witnesses? Sometimes their statements can be integral in establishing time, place, and duration.

    As for the VA rating from 30% upwards, that depends on a lot of things. They could assign 0%, as VA looks at the functional deficiency of you vs. your disability and it's effect on you. If a disability renders you unfit for duty in the Navy, it may still not cause a function impairment from the POV of the VA.

    For example, I was discharged from the Army with 0% for a low back trauma injury that resulted in having 2 discs ruptured at L5-S1 and L3-4 with fragmentation and some nerve damage. The VA looked at it and it's residual effects and I am rated 60% for those things combined. I'm currently appealing my discharge percentage of 0% to the Army. While any retirement that I would receive would be negligible to none (I was only in for a year and I was an E3) I still feel the 0% was something that should have been a little higher.

  5. You have 30 days to request a hearing, or 60 days to furnish evidence. If you can't furnish evidence within 60 days, they will reduce the rating, but it takes at least another 60 days or so for that to happen, so you still can provide evidence within that period or NOD it from there. Cruiser (one of the posters) used to be a rater and is a VSO now.

  6. My wife and I bought our first house kind of like that. He held the note, we got the deed, we did a three year balloon where we paid his note, plus a little, and in two years we refinanced out of it and got it all in our name. That was there was full credit for payments made up to that point from us.

    Im assuming that you mean 30% for MH could be the line between working and not for some people, while not for others. Am I on the right track?

    The only real difference between a 30% rating for a MH condition and a 70-100% rating is your ability to work.

    It could be any day and should probably only be 3 months, for 7/1, 8/1 and 9/1 checks. Award date 5/18, w/no money for May. VA pays starting the first full month after the award date. So payment starts June 1st but you don't get June's payment until 7/1. Hope I explained that well enough.

  9. that's what I meant-deed, not mortgage, sorry. Either way, in a community property state whether she is on there or not doesn't really matter since, worst case scenario, she'd be entitled to half of it anyway, depending on the wording of the decree and the laws of your state.

    Why would she want to be added to the mortgage, period, yet alone later??? Makes no sense. Usually a second person is on the mortgage just to make it easier to secure. She can be added to the deed, at anytime, subject to any existing mortgages.

  10. My ebenefits letter has been updated since this weekend, and I got my unofficial DAV notification on Saturday. My award grant goes back to May 18th of this year, so I think I would have 4 months of retro pay coming at the difference between 50 percent and 70 percent.

    The burning question is, when? I have direct deposit and thus far haven't seen anything. The soon it could get here, the better it would be (like always).

  11. 4 months worth, I think-effective date is May 18th.

    My dependents are already included. This puts me at 70%, but I still have an OSA exam coming up, though I don't know that it's service connected. I'm in pain, overweight, and depressed, and 2 of the 3 are service connected, but I don't think I can tie apnea to overweight because of inactivity due to pain. That is probably a stretch.

  12. The Ne RO is pretty quick, all things considered, but I found out , unofficially on Saturday, that my MDD claim has been approved at 30%. Im not appealing or anything, since I feel it is the correct adjudication.

    Now on to PDRB, and then to figure out if OSA is somehow tied to my depression and/or increased weight.

  13. You were injured on active duty, you were in +180 days, and you have an honorable. Sounds to me like you have a go for VA disability, or at least medical. Duty personnel don't really know the ins and outs of VA-i found this out in 2002 when I was discharged and discovered that most of what the well meaning CO and NCOs told me was BS. I am not:set for life, as one told me I would be, but I don't have to worry about medical for me, either. *shrug*

  14. Sort of. The convalescence period is dependent on what your doctor says your recovery time will be, and its not always going to be 12 months, probably more like 'up to' 12 months. In order to get it youd have to apply for it after the fact, I think, though you might be able to get the wheels going while you are still in the hospital. Make sure you get a copy of all your records from your surgery so you have them rather than waiting for VARO to get a hold of them. Good luck with your surgery.

  15. My subsistence payments came the same way that my compensation did. My VA/Voc Rehab rep handled some things, like, if I needed a computer, or extra supplies for class that were outside of the supplies allowance per term. I never had to 'set up' direct deposit-it was already in the system because of my compensation. Your Voc counselor should be the one that can answer any question you have, that is their job.

  16. My MH c&P had a section of subjective (my complaints) and objective, and then a separate section on his MH observations where, at he end he gave me my GAF and Axis. I would look in there for any word derived of the work "Employment" or "Employability". If the didn't come right out and say it, it will be tough to find, though. I use google a lot to look up terms in my C&P's, too.
