  1. Don't want to hi-jack your thread but I made a call to DFAS this week to inquire IF they completed their audit for my retired pay adjustment?...Answer:YES, on Sept 28, 2012. Next question...When was the audit sent to the VA?...Answer: Oct 19, 2012 !!

Today's date is Dec 12, 2013 last time I checked...Do the math and it's coming up on 14 MONTHS! DFAS said the VA owes me upwards of 25k but I'll believe it when I see it...and there is't a damn thing I can do is wait. Meanwhile, the whole time it has simply been displayed in eBenefits as "CLAIM RECEIVED"...If I had that kind of $$ in a bank earning intrest, anyone want to guess how much I'd have now?

Wait...don't answer that 'cause I'd probably start cryin!!!! Just sayin' what's allready been said...but nobody listens at the VA...FIX THE BACKLOG PLEASE!

    LC (a very frustrated LC)

Great question which I have not gotten an answer from anyone on how long it takes.

My CRSC was approved in Aug 2012 and Audit worksheet was sent to VA in Nov 2012 dating back to Aug 2010. I'm still waiting after having DFAS transmit it again in Oct 2013 because VA stated they did not receive it. I also had DFAS mail me a copy of the Audit Worksheet and the VA will not accept it, either by email or regular mail. They must get it from DFAS. I also contacted my Congressman and My Senator in Feb 2013 and have not gotten any help from them. I really feel no one cares. Sure they say, thanks for your service and then do nothing to help. I have the same issue with my Dependent claim and can't seem to get any help on that subject. I have contacted the VA by phone, IRIS, local VSO and have not gotten any help on either issue. I feel that DFAS has done their job properly.

I feel if you have an insider or know the right people you will get help but if not, no one cares. I guess another to get help would be to hire a Lawyer but you would have to give up a lot of your funds. GOOD LUCK.

  2. I submitted my dependency claim three times over a period of 1 1/2 years. First time it was lost; second time it was closed without a reason. The current claim that is posted on eBenefits indicates it is past settlement date of Oct 30, 2013. When you click on the link, "Learn More"', the site locked up with no results. I sent an email via IRIS one week ago with no results. I am having the same NO RESULTS from the VA on receiving my re-tro pay from 2010. I have also forwarded many documents to the VA and they have been lost. I have no faith that I will receive anything from the VA.

  3. I have been waiting for 13 months for Retro Pay and 11 months on Dependent Pay. All they seems to do it lose what I send or upload to eBenefits and close the case when they say they have not received my data. My Dependent claim data has been sent six times. I contacted my Congressman in March 2013 and never heard anything from them but one letter saying they are checking. Three weeks ago I contacted my Senator and have got one letter saying they forward it to the VA and will keep checking on my claim.

Yes I have contacted IRIS and My Pay but still have no money. I even found out from My Pay the amount of Retro Pay and the web site to look at but they would not contact the VA for me.

Good luck but I am happy I contacted them.

  4. Today I went to eBenefits site like I do everyday and found my Dependency claim has been re-opened and under REVIEW with a settlement date between 9/9/2013 and 10/30/2013. I also found when I open the claim I find the phase Contentions:vbms(New)

google the term if you don't know what it means but it will still take another 100-140 days to complete.

  5. You can not appeal until you receive a rating decision from the VA.

Don't always rely on e-benefits, it's very seldom up to date, even uploading documents, which the VA conveniently misplaces.

contact a veteran service officer at the VARO in your state. They have the capability of finding out the disposition of your claim. It might even do yourself well to take a day, bring all documents with you and head to the VARO.

once you find out the status, then you can take the next step. About 3 years ago the VA started working the dependency issues as an additional duty. The longest I have seen a dependency claim is 20 months.

Many thanks for your input. The decision is "the case is closed". The letter says I have one year to Appeal or provide information. I have provided information several times since the case has been closed without it being posted on the web site.

  6. In July 2012 I submitted my Dependent claim. In October, eBenefits site showed the claim was closed but no letter sent. Since I have never heard from the VA, I submitted info to IRIS in January 2013 and the VA reported claim was closed by mistake and they will re-open it. They started new claim, April 24, 2013, stating something was missing, giving me 30 days to provide missing data. I re-submitted in writing April 25 the requested information, plus uploaded same data via the web site on the same date. Nothing appeared on web site so I submitted same data on May 11, 2013 and uploaded to the site again.

On May 31, they closed the case stating I had not sent the required data. I mailed it to them again on May 31, 2013 and uploaded to the site again. Still nothing appears on the eBenefits site. On June 17, 2013 I mailed same info again. Nothing appears on eBenefits site as of today.

My question is "What is my required next step". Should I now appeal the claim or allow more time? If I appeal, what form and how do I do it?

It appears to me that the VA tosses paperwork in file 13 as I have now sent it seven times and received nothing. Yes I the letters have been signed for.

    Thank You.

  7. I mailed the dependent claim form today along with a letter stating that I had sent it to them three times plus uploading twice and that they need to look into their procedure of processing claims. I tried to be kind. When I took it to the post office the clerk stated that he has heard the same story as I said many times.

  8. Received my brown envelope today with my denial for Dependent allowance since they did not receive my form 21-626c. I mailed it to them three times and uploaded it twice by the E-Benefits site in the thirty days they gave me. They misplaced the first form that was sent 11 months again so they gave me 30 days to send it to them again. They have a problem.

Will mail it to them again tomorrow.

  9. My question is if you are awarded Dependent pay does the amount show up immediately on the A8 letter generated from the E Benefits site or not show at all? How can you tell if approved?

Yesterday, May 31, 2013 my dependent case was closed and it states appeal is possible (does not show if approved or disapproved) and a letter will be sent. They requested information from me in April which I uploaded to the site in addition to mailing it. In mid May they stated on the site that they had not received the information. I uploaded it the second time plus mailing them the requested information. Toward the end of May, I noticed that they still stated they had not received it and it was past due, so I uploaded it again and mailing for the third time. Today, June 1, I see case is closed and letter sent. Guess I will just have to wait and see what the letter says if I receive it as I see no change on A8 letter. The dependent process started on July 24, 2012.

    Thanks for your input.

  10. I submitted my claim for dependents in July 2012 and it appears that it was settled today and from what I see it seems that it has been disapproved and I must appeal. No other infomation is available on the web site. Guess I must wait until I get a letter of some sort. The Va has many ways to determine dependent status (wife); Deers, IRS, yet they take three months tosay no, if I understand it properly.

I submitted via IRIS for an answer to my claim for dependent and today (nearly 4 months later) I received the following email answer from IRIS.

"Good morning Kenneth, after reviewing your claim folder they located your claim for dependency. The claim will be processed and your dependents will be added to your award back to where they were eligible. If applicable, a retro check will be processed and you will be notified. They apologize for the inconvenience."

I first submitted my request in August 2012 for dependents and guess it will take another 6 months to get it. Who knows.

In addition I also requested information on when I will received re-tro pay for my 30% claim after filing for CRSC with approval. I got CRSC portion, but they stated that the VA will give big amount. IRIS stated they could not answer the question on the retro pay so I am still waiting. I really do not know who to contact to get my re-tro pay back to 2010.

  11. Many thanks to all that have reponsed to this thread.

Unless I am wrong, VA form 21-960A-1 must be Faxed to the VA by the Doctor. I guess you could attach a copy of the Faxed document. Reading page 3 of the instructions of VA forrm 526EZ leads you to think an amendment to your claim can indeed to submitted by the EZ form.

I feel with my latest heath setback that I must submit to increase my claim rating. Eveything you read about IHD talks about going from 30% to 60%. What happen to 40 and 50%.

I appreciate all your help. I have learned so much from this site. Thank You

  12. I was awarded 30% for CAD and Agent Orange/Vietnam in July 2012.In the last few months I have experienced three episodes of passing out, one Aug 31, 2012; one Feb 3, 2013; one Mar 11, 2013 when my heart stopped, blood pressure dropped, passed out and had to be transported to Hospital. On the second event a “Loop Recorder” was implanted and on Mar 11, 2013 when I passed out again the recorder indicated heart stoppage at more than one time period when I passed out. A Pace Maker was implanted on Mar 12, 2013

I need to report this to VA and am trying to figure out proper procedures. I feel I should get my Dr. to complete VA form 21-0960A-1 and Fax results to the VA. Is that the proper procedure to provide more information or must I appeal my previous award? Do I appeal or just provide additional medical history that occurs after the award? What form(s) do I need to use if not VA form 21-960A-1? Do I mail it to the local district office or upload to Fast Track or what?

Help; how should this be handled during the one year period after an award? Is there any chance that this opening of the claim for them to downgrade my award?

    Thanking you in advance.

    Ken

  13. I submitted an email to IRIS back in November requesting what has happened to my Dependent Status form that was settled on ebenefits in October 2012 with no written response from the VA. I also included that no written repsonce or money was received from the VA on the Re-tro pay approved by CRSC back in September. To date I have not received any Dependent funds or re-tro pay.

Today I received a response from my IRIS question submitted in early November. It said nothing to help anwer my questions on where is the funds. They are not too slow and still provided no help.

Also, I have also been unable to obtain any of my military records and my only award has been from the Agent Orange connection for IHD.

Two weeks ago, I went to my Congressman and they are looking into the lack of military records; lack of dependent status and lack of re-tro pay. Maybe I will get some help there but have my doubts.

  14. I am so sorry to hear about your husband and Pancreatic Cancer as it is a terrible disase.
Congratulations on your disabilty award to 100%. I wish you and your husband the best.

I also had Pancreatic Cancer but do not Diabetes and have been denied under Agent Orange for PC.

My Claim for Dependent (wfe) was ruled on Oct 30, 2012 as indicated above. Here it is November 23, 2012 and after checking Ab8 letter every couple of days with no change in date of ruling or amount, nor have I received any letter from the postal service and am still waiting to determine if ruling is favorable or negative. The E-Benefits web site seems worthless as it has provided nothing. What would my next step be, just keep on waiting or what?

    Thank you

  16. What you posted in no way indicates a denial. WIth a date of 10/30/2012 it will not show on the Nov 1 check (it can't move through finance that fast).

Give it a week or two.

Last fall VA sent me a letter telling me my son would turn 18 in December and come off the award unless I filled out the school attendance form. So I filled the form out sent it right back within the 60Days I had to keep benefits un-interrupted. When I filled out the form I did one for his high school, one for his college included the college acceptance letter, enrollment deposit payment and ist term schedule. They dropped him from the award, It took them until May of this year to put him back on the award. Then they dropped him in June, I called to ask why and they said they can only process one school form at a time. I asked them to act on the form they received in Oct 11, they stated since he was off the system again I had to send in another form. Been waiting since 6/25/12 the projected completion is 12-7-12 to May 2013. The status remains Received (first step).

    Best regards,

Ok will keep checking. I just figured "Appeal is Possible" meant it was denied. Live and learn but that is a strange way of posting by the VA. As I stated earlier the more I am on this board the more I learn. 71M10, rdawd and others, I really appreciate you for providing helpful information.

The AB8 has strange meaning also and leads you to think that you are sending them a letter, when actually you receive from them.

    Thanks again.

  17. you show a sc disability of 30%. If your dependants are added you will get more money. That is what I meant when I said "see if your rate went up".

do you have an ab8 letter available under the letter generator? it will show how much you get and an effective date. if the effective date is recent and your amount did not go up then you were denied.

The more I post on the forum the more I learn. I did not know about the letters (AB8) option, so I downloaded it and it says 30%, no change in dollar amount, effective August 1, 2012 and the letter is dated November 1, 2012. I do not see any other letter with any information about the denial. I can only assume that they will mail me a letter and then I will provide what they need.

You have been very helpful and I am still learning about this site since I just registered one week ago. Thank You.

  18. Thanks for your reply. From eveything I read now, mine will be also denied. Of course you never know what will happen in the future. I did not apply for CAD in 2001 when it first happened and as a result I missed out on lots of back money, some nine years. I also had Pancreatic Cancer in 2005 which is not covered by Agent Orange but you never know down the road what may happen.

Thanks to all that share information on this great forum. It has been a learning experience.
