Secondary Claims

Question

Secondary claims of service connection arise out of a service connected disability causing an additional ratable disability.

Veterans should not hesitate to claim direct service connection as well as secondary service connection for many additional disabilities.

For example:

Medication used to treat a SC disability could cause secondary disability.

Wanner V. Principi.

Mr. Wanner was a WWII vet who had service connected tuberculosis. The meds he received for the TB caused a hearing loss. The hearing loss was service connected.

Secondary due to aggravation of a SC disability-

Dyess V. Derwinski.

Mr. Dyess proved that his SC flat feet aggravated his knee condition.

PTSD as causing heart disease as secondary to PTSD-

Example:

BVA case at this link- –PTSD contributing to heart disease-granted.

Secondary disabilities as complications of initial SC disability:

ORDER

Service connection for hypertension secondary to service-

connected type II diabetes mellitus is granted.

Secondary conditions that might sound implausible yet medical evidence warrants the grant of benefits:

“ORDER

Service connection for a right wrist disability, secondary to

the veteran's service-connected knee disability, is granted”

Service connection for low back disability, secondary to the

VBM says that when you file for a secondary condition you should always submit a medical report to make the connection between the original SC condition and the secondary condition. You must make the case for the secondary condition using medical evidence. I was granted SC for arteriosceloris secondary to DMII using a medical report from my VA primary care doctor. I had other evidence but without the report it would have died on the vine.

Speaking of disabilities secondary to a service connected disability.

I have Ulcerative Colitis, and, as noted in my primary care physician's report, it is caused by the NSAIDs that I have had to take for the last 20+ years due to my pain from my service connected ankle.

Did I file a claim.

Yup. As soon as I read my medical records.

Probably wouldn't have known about his linking (nexus) of my gut problem to my SC'd disability if I hadn't gone to the FOIA/Medical records window at the VAMC and asked for my med recs.

I'm not including anything with my claim, other than the fact that it's documented in my VAMC medical records from my PCP. That should be enough, don't you think?

I m not service connected yet for low back disorder, but I have a secondary issue. My left leg goes out on me about once a week and now my right leg goes out on me about once a month. Should I claim this secondary issue now or wait till I m SC. My reopened claim is at AMC.
