Va Claim Closed Out ? On A No Brainer ?

Question

I just got off the phone with the NYC office and I was told that my claim was closed out? A year and a half later of waiting and they cut me off?. They said waiting for my info? Are they on crack here??? I am horrified by this and in shock. I have done everything they asked and more. The VA has dirrect knowledge of my VA treatment and I have had 29 medical appointments this year alone. they have put me in TBI/ brain injury clinics ? I am on 16 medications for my daily life what kind of BS is this. I have submitted book binders of documents to them. I was evlauated and treated a year at Walter Reed ? I am on social security and Army disbaility this is just wrong. My claim is legit What is the deal here anyone have any suggestions. What do I do now ? What does Closed out mean ?

I think you nailed it right there. My family jumped on the congress and senator e-mail and letter writing band wagon as you guys said ":"Holy S--t, I ain't getting tied down with this mess." I called the OIF coordinator at the VA who oversees OIF cases and she informed me that the Regional Office will be showing up in the am for a Veterans support fair and it would be a good idea to show up with documents in hand. You are so right the anxiety attack is here for sure. I am just tired of being screwed over wish me luck ..

I just hope you saved the originals and sent them copies.

This looks like a case where somebody has not met their quota, saw how extensive your claims are and said;

Then they send you something stupid that makes no sense at all, knowing that the file will go to someone else when it comes back.

In the meantime, you get an anxiety attack, they get praised for pushing more paper and the Senator gets to score points for helping a combat vet.

The stats look great, what's the problem?

Don't get your congress critter involved too fast. After reading your reply, it sounds like the VA may have recently made a decision on your claim. You said;

I'm wondering if the VA just made a decision on your claim and that whoever you spoke to misused the word "closed out" as to mean that they finished the rating on your claim. And then when they said you need to send a letter, they meant a Notice of Disagreement (NOD) to iniate the appeals process if you didn't agree with the rating the provided.

If I were you I would send a message to the VA through the IRIS inquiry system and ask them for the status of your claim. The IRIS inquiry gives much more accurate information. Also I would hang tight the next couple of weeks and maybe you'll get a rating decision in the mail. Normally, when a decision is made by the Rating Activity on a claim, it can take a minimum of at least 2-3 weeks for them to get the decision out to the veteran. It takes even longer if the retro is over $25,000.00 because the claim needs a third signature.

You need to put it back in their hands as soon as possible.

Request a local hearing. At the hearing, explain your situation, write down you never recieved the notice & sign it. Give it to the hearing officer.

Don't get into another writing campain. THey will likely bury your claim in a pile.

Claim? What claim?

You can expect some type of retaliation & possibly sitting here with me 10 years from now, wondering when it will be finalized.

Its a two year wait, once you write the congressperson. Do not expect, anything to come of it, except the passing of time.

It a good idea to get a script for .

Two side effects from doing bussiness with such a seamless & smooth operating agency of such high quality, is anxiety & depression.

They care so much about your mental status, they will load the gun & tape it to your head.

If your wife & family members don't back off, its likely to dig you a hugh hole. I know vets are encouraged to & need to try to put a stop to this stuff. But the truth is, If you don't have an attorney & a team of news agents trampling all over the VA, asking questions, it's not likely to help you. But it is likely to delay your claims process. The more heat you bring them, the more they will be determined to keep you quite.

The only thing Nicholson is focused on, is the bad rap the people are giving him for such an "outstanding" effort on his part. He will do all he can for the decider. Keeping the whiners heads down & the noise from the media down is going to be a new goal.

I watched Nicholson on TV the other day. You could see he had absolutely no interest in what Vets need. His reputation & what all these liers are saying about him is where his thoughts are. He looks to me like he turns in all this stuff to the prez, & thats as far as his skills take him.

Im not trying to say everyone needs to keep their mouths shut. But its ot going to hurt anyone to bite their lip & get into a hearing & try to get the "claims" issues resolved first.

PS.......nothing at the VA is a slam dunk. Except the sound of your evidence hitting the round file.

Do you have a VSO (Veteran Service Organization)? Did the VSO file claims on all of your illness's?

Did you personnaly write up your claims or did someone help you in sending them to the VA? Do you have a C-file?

It is hard for me to see if you are still working for the DoD or retired, with the VA as a civilian now, or caught between the two with treatment being done at the VA.

Yeah- after I read Vikes post I realised -how could a claim be "closed" 4 months after a C & P-

Sometimes it takes them 4 months to prepare a SOC after a C & P-

Vike is right-try the Iris page- as a regular inquery-

I have been given wrong 800# info many times-

follow the menu stuff and ask them for the exact status of your claim.

Tell them when the last C & P occurred. and where.

I believe it is only fair to comliment the good stuff that I have experienced from the VA.

The same day that my claim was finally approved I received a letter

continuing the previous denial

on the claim that had just been awarded.

Those that need help the most are the ones least likely to receive help from the VA.

It's up to us to help each other.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
