Iam real tired of the wait Ican not understand why it take so long to hear from

this people if the veterans coming home are being treat like this I feel very sorry

for them. IS anyone looking out for Us.Where the big shot that talk the talk. I have been wait

two years to hear from the appeal management center I feel for the one's wait be for me. I ask again how long to

it takes to hear from the appeal managetment center.

I do know that my claims file was sent back to the Regional Office April 24, 2007, but was immediately returned back to The Appeals Management Center April 25, 2007, acknowledging that I had placed a waiver against the Regional Office making any decisions on my claim.

I was told by the Supervisor at the Appeals Management Center that when you claims file does actually reach the Rating Specialist Section that they have 90 - 120 days to give you an answer.

If the file is not completed in that time frame that a red flag is placed on it and it must be worked immediately.

Seems like your claims file spends most of its time going around in a circle for someone to decide if it is finally ready to rate.

How several people can look at your file and decide that it is ready to rate and then it travels to the rater for them to locate a tiny useless piece of paper is lacking from the file and then it goes around the Mulberry Bush again.

As far as I know I have made sure that The Management Center has everything that they need to give me a yes or a no.

Yes, I've had several. I would rather have due process.

Heres something I went through last week that is odd.

When I called the Appeals center, the operator said my claim has sat too long without someone working it, & that I needed to send in a signed letter to them, telling the appeals center to process it.

I can't tell you how upset I was, when I heard this. I had to have my wife call them back & see if this guy was flipping me crap like i've gotten before from VA operators. But he told her the same thing.

They should recieve the request tomarrow.

I will post if anything happens from it. Claim has been at the Appeals center for 13 months this time around, collecting dust with absolutly, "no" action taken on it. In a "ready to wait status.

When they have to work them fast, it takes hardly no time at all to deny it.

rthomas- why was your claim with the General Counsel?

Mine was with regional counsel for a week or so but I know exactly why-and I am glad it went to him-

he had to verify statements I made in the AO death claim that referred to statements in the wrongful death award.

I have 3 IMos and considerable other evidence to medically support my AO death claim.

But I sure raised the important and well documented fact that VA had committed malpractice by failure to diagnose and treat CVAs, CAD, and HBP in Rod's case so how could they possibly have been able to diagnose and treatment diabetes as the cause of the disabilities that "hastened" his death . (as Sec 1998 award letter states)

It is 'more than likely' if numerous VA medical doctors didnt know what a heart attack was , and CVAs were, as well as could not interpret all clinical data for proper diagnosis-they most likely lacked the skill to diagnose the true etiology of all that- diabetes mellitus.

The RO certainly had to check with the RC for the VACO report on all that.They didnt have it.

But in your case- this surprised me when you mentioned it.

In January of this year, I was told to send a letter stating the same thing. I did it, but don't know what any of this is about.

I had to word it that I had no more information to send and to rate my claim.

Maybe this is what they are waiting for on your claim. When you talk to Ms Dunlap ask her if that is what they need.

This is such a disgusting situation. I was told that on April 24th that my claims file went to Huntington Regional Office for them to sign the waiver that I placed against them.

Seems like the Management Center requested this a year earlier.

I went to the AMC April 2006 and now it has been 16 months. As soon as I hear anything, I will post it on line.

I appreciate your voicing your opinion of the treatment that you received from the VA doctor. I think that we need to stand up for our rights, for no one is going to do this for us.

I am another one that is also fed up with the entire system.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
