Got A Copy Of My C&p Exam Yesterday- Mad!

Rate this question

Question

I am very easy going and very few things in life can set me off, but dealing with the VA fires me up! I know others are going thru the same or worst.

This is a followup to my situation and from the previous postings.

I am in the midst of gathering information to file an NOD against a decision after a C&P evaluation that was done a couple of months ago. The decision by the VA was that my PTSD should " REMAIN THE SAME" at 30%.

Folks, that statement alone is definitely a low ball tactic.

When I showed up early for my TBI exam yesterday, I decided to go down and get my medical records, to include the C&P report, which I've never seen.

To my anger and amazement, the report sites NUMEROUS AND BLATANT summary on how bad my PTSD has WORSEN, 6 pages of it!!

Doctor's summary categorized the symptoms as " SEVERE"!!

Is there anything else I should know that is worse than that?

How could the raters have missed their own doctor's evaluations? The only positives which the VA countered on the letter with in keeping the rating the same are-

1- His answers were logical, well groomed

2- He is holding a job

3- He seems to be doing ok

What a joke!!

Two tours in Iraq , all the horror, pain, sickness, suffering , sacrifices, and this is what I get??

welcome aboard iraq2, i know the frustration and the anger you feel about the va that is after all what got me to start this site some 11 years ago.

if you are not see a therapist get one, try the local veterans center, i like going there better than going to the va hospital. if you need to get into any other support groups aa, na, ga whatever get to the meeting. you can get through this even if it's just 15 minutes at a time, lots of us been there, find an outlet for your anger, personally i broke a lot of phones, used a baseball bat on sturdy work table and screaming at the top of my lungs while driving, let it out, move on to the next 15 minutes, try to use your military training your mission is to get the all the compensation you are entitled to, and stay mission focused as much as possible. brother it's a hard road to walk, but it is not impossible and you are not alone. welcome home

I am writing my memoirs and would love it if you could help a shipmate out and look at it.

I've had a few challenges, perhaps the same as you. I relate them here to demonstrate that we can learn, overcome, and find purpose in life.

The stories can be harrowing to read; they were challenging to live. Remember that each story taught me something I would need once I found my purpose, and my purpose was and is HadIt.com Veterans.

I'm in agreement with John999, if your working it will be very hard to get an increase in your award for more than the 30%.

My husband was denied his PTSD claim because he was self-employed (because he couldn't work for anyone else) but that didn't matter the fact that he worked, the C+P examiner said he didn't meet ALL the criteria to be Diagnosed with PTSD. Which is a crock.

This seems to be the latest reason for denials. The PTSD system is really a mess, but no matter what.... file your NOD's and appeal and appeal. You deserve the help and we are right here supporting you in your efforts. We have all gone through or are going through many major battles with our claims, so many here truly understand your anger and frustration.

You deserve the best care and unwavering support, don't give up, plan out your claims, and work your plan, remember you will find help on even those down days from your Hadit fambly.

Thank you for your service, my family and I value your sacrafice and we're glad your home.

and, if too much time hasn't passed, you might request a "reconsideration" from the Regional Office, and send in THEIR C&P examiner's report....just take a BRIGHT YELLOW hi-lighter and point out the pertinent facts as per THEIR C&P examiner.

Sometimes they will ACTUALLY read stuff if you MAKE them. Even their own stuff.

Glad to have you around. Bless you.

"It is cold and we have no blankets.

The little children are freezing to death.

My people, some of them, have run away to the hills, and have no blankets, no food; no one knows where they are-perhaps freezing to death.

I want to have time to look for my children and see how many of them I can find.

Maybe I shall find them among the dead.

Hear me, my chiefs! I am tired; my heart is sick and sad.

From where the sun now stands, I will fight no more forever."

The RO will tell you at some point that the VA compensation is based on the amount of income your service connected disability costs you in earnings capacity.

I know several 100 P&T Vets who go to work every day.

It happens every day.Lowballed ratings because you are working.

Good luck

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

J Basser the people you know working that are 100% I imagine are not SC for PTSD one of the requirements for 100% PTSD or TDIU 70% PTSD is being unemployable now there are other reasons to be 100% and still able to hold jobs I know a few double amputees that work, even a quad there ratings do not prevent them from holding a job and still getting the compensation but mental ratings require NO employment for the 100% rating

100% SC P&T PTSD 100% CAD 10% Hypertension and A&A = SMC L, SSD
