I just got email from a NOVA lawyer who will handle my SMC CUE claim!

"I can tell you, at this jucture, that if you are still interested in having us represent you, we will certainly do so."

I wasnt sure what to expect-until I just got this-

then again he asked me by phone when I first contacted him -why I even needed him-he thought the claim was so well prepared-

I said I need him because the VA will actually read my evidence whe they see a lawyer on the POA.

Last week I revoked that part of my POA that covers this CUE claim (actually both CUEs)

although my POA NYSDVA revoked the POA themselves last October, the OGC agreed this was illegal-what they did- so just to cover my bases I sent priority mail to NYSDVA to revoke their POA solely on my CUE claims so I could give it to a lawyer-

and that my POA has continued with them for the other claims.

(I will determine when to revoke my full POA from these idiots-not them-they couldnt even do that right per 38 CFR)

I wonder if you file an amended NOD or a new one if you could get a lawyer?

Veterans deserve real choice for their health care.

Pete- if we claimants who are stuck in limbo at ROs could do that- we could all get lawyers- it wouldnt make sense though-

the year for filing NOD passed years ago in my AO claim case- and I had to file the NOD then.

The main problem with my AO claim is that I had lousy representation.

The rep I got in 2003 asked me -at our first meeting-if I would help him with some claims-

I said sure-with the vets permission-

then he made sure that he had no paper trail on me (he said to send my claims and evidence directly to the RO.Although this was different from when his boss was there-during my past claims-he told a vet I helped to do the same thing-then the director, in a letter in response to one of my complaints- said I had not been to their office since 2001.

He told the Sec I never needed any appointments- and she should just send me right into his office.

But I proved to the OGC I had been there many times and apparently he wanted to make sure my claim had problems and that I would continue to help him with his claims.

The lawyer for my CUEs just called me-we talked for about an hour-they want the whole story on the OGC complaint as well as on ALL of my other stuff-

Lots to get together for them-I never dreamed they would need it all.

Great News, Berta! Please do keep us all updated, as I know you will.

I have a pending claim on the books, if a NOD is needed this time and I file one and things don't go in my favor and I have to appeal, I am eligible to get an attorney, right?

At least I think that is what you are saying (after June 21, 2007), right?
