Ss Turned Me Down....

Question

Hi All,

I received my Social Security denial letter on yesterday and of course they said "You are not disabled by our rules". They told me that they used evidence from Nov. & Dec. 2004 as well as VA Medical Report from March 2008?

Are they kidding me? From 2004? Anyway, I spoke with my attorney and he had already told me that they probably would deny it the first time and they probably will deny me the 2nd time. So, I guess I'm in it for the long haul. My attorney said that they will file an appeal for me.

Still no word on TDIU. Had my C & P Exam on April 30. Wonder what they are going to say.

I'll keep you all posted.

I am sorry to hear you lost on the first try. Most people do unless they are over 55 or they are highly educated.

You'll get it in the end. While the money will help you now, at least you'll get back pay when you win.

Thanks everyone for your support. My attorney did for warn me and he also said that they will probably deny it the 2nd time too. But he made it clear that they have been very successful in winning social security claims,(as a matter of fact, they helped my mom win her ssd claim) and if they didn't feel sure that they could win my claim, they wouldn't have taken it on. So, I am trying to stay optimistic. Anyway, I am looking to see what the VA is going to do. I am hoping that they will grant me the TDIU. I haven't worked in such a long time, and I couldn't complete my Vocational Rehab program, as my counselor deemed me "Unemployable", and put me in the Independent Living Program.

Anyway, I'll keep you all posted.

Cherie33, The SSA turns down 60 percent of applicants the first 2 times.

At the ALJ level, 80 percent of those 60 percent are awarded.

My attorney told me that he had 2 clients that were tuirned down and had to go to the ALJ.

Both had terminal Cancer. One died before the claim was resloved, The other one collected one or 2 checks then died.

Talk about injustice.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.
