Hello All,

I am new to this and have read many posts on this forum. There appears to be excellent advice here. Can the experienced help me unravel and provide some guidance and insight on my claim?

I have reopened a old claim (Jan 1980 not appealed) after learning the VA has likely shortchanged millions of veterans in 5 states and is drafting a letter to reach all these veterans. I recently completed a c & p exam for my hand and hope members can shed light on what may lay ahead and when. the main points are summarized below.

1. diagnosed cavernous hemangioma in service

2. c & p exam clearly points out incurred in-service

3. left dominant hand affected with 2 scars

4. multiple "active" masses found on examination

I have reopened a old claim (Jan 1980 not appealed) after learning the VA has likely shortchanged millions of veterans in 5 states and is drafting a letter to reach all these veterans. I recently completed a c & p exam for my hand and hope members can shed light on what may lay ahead and when. the main points are summarized below.

1. diagnosed cavernous hemangioma in service

2. c & p exam clearly points out incurred in-service

3. left dominant hand affected with 2 scars

4. multiple "active" masses found on examination

5. pain mentioned 23 times in exam report

6. nerve damage in 2 places

7. "structual limitation" in all flexions of more than 60%

8. allowed to remain in service despite documented pain for last 90 days

9. DAV signed up late november, c & p exam in system mid november

10. weakness noted 40% and tissue loss.

11. prolonged in-service hospitalization of approx 4 months.

12. denied as not incurred or aggravated

Any info will be greatly appreciated!!

Welcome to hadit. Someone will come along, it is the holidays and a Merry Xmas, Happy Holliday to ALL!!!!!

I am relatively new compared to so many members at hadit. Know a little, but not a lot!! You did a great job at laying out your predicament.

Did you ask for DRO review? DRO is Like a head huncho review (director of the Regional Office) before going to the BVA. Some people here state that you should ask for"... a DRO review and if not satisifactory rating for the Veterans to send on the to BVA"..., that is when they send the paperwork, #9 for you to complete to send to the BVA.

Wish I knew exactly what to tell you, BUT we are in the same position with Joe's knees!!! All in the record, 20 yrs aggravated!! we finally got the new VA ortho doc who absolutely says, S/C, but we will see!! Outside Dr. to give us a ltr!! He claimed this from l990!! Lots of BS. We also have (at my insistence) a MRI, much better than a xray, shows, Severe/Moderate/l/r!! ROM, Pain/Arithritis.

We also have sleep apnea/mixed to file, and a couple of other things they ignored. I sent in an informal claim while we were waiting on the PTSD and they chose to C&P some on the informal claim and ignore others!! I also think he should be given a EED for his 70% PTSD, and staged from l990. Delta says, if he did not get a C&P and was decreased in a rating, then that was against the Law!! Illegal!! Definitely work for a CUE!!!

I am continually absolutely appalled at what the VA does and continues to get away with. SO's who weren't a tinker's dann were handling Joe's claim. Could they all be that ignorant of the regs and laws!!!

I am interested to see what fambly tells you.

Oh, by the way...the VAMC said, "your tests come back fine with your blood sugar!" GTT is not a good test...Well, we had one done on the outside!! Joe is hypolglycemic (more likely than not insulin resistant).

Really first stage of diabetes 11. Make sure you insist on getting that GTT!! Act like you have DM11 and do the Diet/exercise, etc. It is doing damage to your organs before it shows on the VAMC test!!

We plan on connecting his SMR's/VAMC records, X[rays, MRI's, SOC's,. It should be a CUE (VA SCREW UP) and it should go back to when he first filed in l990 when he retired. Anone, like Delta have anything to say. I remember Delta saying, you have only one NOD and if you don't include everything, you are out of luck!! So we have to get the ducks done as flying season is February!! That is the one year!!! Certified RR Mail

PS. How did they shortchange the Vets in 5 states, is it the states that came out low ratings? Interesting to see how that letter will read!! I believe it was Equal Opportunity to all vets; some of the stories are unbelievable. Terry Higgins's story sounds so bizarre; it is hard not to believe he is cerifitiable, but it is the system that is certifiable!! He is just being honest and justifable angry!!!

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:
