Hey ladies and gents,

Well I got word, no where near what I expected. Bva Judge said in the decision that there was a

clear an unmistakeable error in my claim. RO's all screwed up. But they only granted 70% back to 2002.

I think they are just jerking me around again. Don't think the Ro even read the decision.m SSD say's I'm 100%.

Anyway, is there a way to check and see if my retro has even been mailed yet? I'm

not sure where to go from here. HELP!!! Please.

Absolutely ask them to reconsider the award %-

they will state why they denied TDIU in the decision-

they probably overlooked your SSA evidence-

The reconsideration request doesnt stop the NOD clock-that will still have to be filed within one year after their decision on the 70% but a Recon request could make this go faster- especially of they totally disregarded your medical evidence for higher rating-

Ron -you did good - but they still owe you- in my opinion-

your vet ep might want to consider this too-

I am suggesting in light of SHreddergate that if the VA failed to address and acknowledge probative evidencve (like an SSA award, buddy statement, IMO whatever) in the SOC- then the vet should ask the VA to CUE their decision- and re-do it-

however I sure would not want that to muck up a pending award----

Maybe in your case the Reconsideration Request would be much more helpful to you.

Every time I got an award I felt tremendous relief and even joy- and then the depression kicked in-due to the years of fighting that the award took.

The fatigue alone of fighting the VA for what is ours can cause depression-it passes of course-

I sure hope you arent experiencing this-

Once a vet gets any award at all- it is a very big foot in the door-COngrats ------

it is psychologically much easier to fight them with some comp in the bank-already

and give uyourself a Big treat- you did good-and will inspire many more here-

and if the rating was wrong-they will pay up at some point.

Did thewy acknowledge the TDIU form at all?
