Question

I'VE BEEN DENIED TWICE BY SSA AND NOW I'M WAITING FOR HEARING BEFORE A ALJ. I'VE BEEN DIAGNOSED BY THE VA WITH PANIC DISORDER WITH AGORAPHOBIA, PTSD, MAJOR DEPRESSION RECURRENT, DYSTHYMIA, MOOD DISORDER IN CONDITIONS CLASSIFIED ELSEWHERE, HERNIATED NUCLEUS PULPOSUS, OSTEOARTHRITIS, DJD (BACK,NECK,SHOULDERS,FEET,ANKLES), HIGH CHOLESTEROL, GERD, MORBID OBESITY AND I WAS ISSUED A HD ROLLATER (WALKER) FOR AMBULATION.

THE CE EXAMINER STATED I WAS DO ANYTHING THAT REQUIRED ANY WALKING, LIFTING, STOOPING OR BENDING.

I ALSO HAVE MANY GAF SCORES OF (40-50) FOR THE LAST PAST 4 YEARS. DO ANYONE THINK I HAVE A GOOD CASE WHEN I ATTEND MY HEARING? ALSO I'M WAITING TO HEAR ANYDAY DID I GET DIAGNOSED WITH SLEEP APNEA.

OSA will only help in SSD if it is rated as cor pumonole or right sided heart failure.

That is the level you have to meet for it to be considered a listing level impairment.

A person who has that condition related to sleep apnea also has severe Pulmonary hypertension that causes the failure.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

MY LAWYER TELLS ME I SHOULD BE GETTING A LETTER VERY SOON FROM ODAR ABOUT MY HEARING BEFORE THE ALJ. NEXT MONTH ON FEB 14TH WILL BE 2 YEARS SINCE HE TURNED IN MY PAPERWORK FOR A HEARING. I DON'T KNOW WHETHER TO BELEIVE HIM OR NOT.

The attorney usually gets a list of cases going before the ALJ like a schedule so he will know when it is getting close. He will call you in to go over the info at the 2 week mark so he can prepare his brief.

Anyway, Your wait is almost over.

JBASSER,

HE TOLD BEFORE THE NEW YEAR THAT HE SPOKE WITH MY CASE WORKER AND HE SAID THAT BY THE MIDDLE OF JANUARY I SHOULD RECEIVE MY HEARING PACKET AND THAT WOULD LET ME KNOW THE EXACT DATE OF MY HEARING OR IF THE JUDGE WAS GOING TO HAVE ONE BASED ON MY MEDICAL EVIDENCE IN MY FILE. THEY SAID IT USUALLY TAKES 20 DAYS FROM THE DAY YOU RECEIVE THIS LETTER TO HAVE YOUR HEARING. I'M STILL TRYING TO GET MY LAWYER TO TURN IN SOME MORE OF MY RECORDS FROM 06 THRU 08 THAT I THINK WILL HELP MY CASE EVEN MORE.

You are allowed to submit evidence right up to the hearing. If he dont, Take it with you.
