Question

How long after C&P before we hear something??? And should we call and see what is happening?

How do you get a copy of C-File Thank you............. :lol:

Do you have a web link to any reg that says the RO has 20

days to comply in providing a copy of a claimant's c-file?

I have never seen this anywhere.

I know many claimants that have waited for many, many months

(six and more) for a copy of their c-file.

FOIA request processing time

Once the right agency (or component of an agency) has received a complete and perfected request, it has 20 working days to respond with its determination of whether to grant the request. If information is denied in full or in part, the agency must give the reasons for the denial by this deadline. If granted, it does not have to deliver the applicable documents within the timeframe, but must do so promptly thereafter.

someone else wrong, just trying to get to the facts.

Now this may be the part where VA comes in with their computerized letter

that says, "We have received your request for etc...".

But they are not going to move in high gear to get a c-file copied and mailed out.

As far as if the VA will adhere to the reg as required would probaly depend on each RO BUT the law or reg is if you request per the FOIA act the agency has 20 days to comply. If the vet were to contact the RO in question and qoute the FOIA they may get them to move quicker. I know for a fact when I sent into the RO at Roanoke there was a seperate office that I was directed to send my request to.

I believe that the organization has 20 days to respond. That does not mean you will get what you want.

My C-File took Eight months to get with FOIA via VARO (same law).

If there is classified information that has to be declassified, in SMR, this is a reason for a stale. Sometimes they don't know where the C-File is.

Pete53, said it best. If you are close to a decision leave it alone, at least until after a decision has been made. You will have plenty of time if the decision is unfavorable.

Or request an appointment to see your C-File. The VA will let you go through it, without disturbing your place in line.

well I asked IRIS where the claim is at this point and it is done at the raters and has gone

to ghe post determanation bored? Thanks for all the great info and help, I am sure our

fight is just beginning,,,
