Dro Review

Question

Two years ago, I appealed the VA's decision against my claim of depression secondary to service connected disability (chronic shoulder pain). I elected the DRO review, believing that it would be faster. Recently, I have acquired some additional evidence that would support my claim. However, I am hesitant to send it because I fear that it would deny my claims further. The evidence consists of progress notes and a research article entitled " Depression is caused by chronic pain". Should I send this info? Thanks, Bill

I am interested in taking my paperwork to the VARO in Cleveland. If I did, who would I submit it to in order to get it date stamped? Will this increase the likelihood of the paperwork getting to my file which is with DRO.

I think that the VA will have a reception area and they can help you get what you need. I know in Waco after you go through the metal detectors and a couple of security huards that the reception and wainint area is just to the left.

Veterans deserve real choice for their health care.

I met with my VA-Rep there at the VARO,and there I pointed out the SMR's that were in the file that they didn't have or use until I, found them.He the VA Rep had an office there at the RO, I would think I could have submitted new evidence or whatever there,then.As I remember he did ask if I had anything to submitt.He also did put the SMR's on the top of the pile,in my file.before the DRO hearing!

.boy he earned his money then...lol.. how can a rep have an office their at the

RO and get paid there... but work for the veterans ???????

Pete is right - there will be a reception area. All you need to do is take them copies of your additional medical evidence, tell them you are there to submit some evidence and you would like

a date stamped copy. Usually when I do this, the receptionist just makes me a copy of the top page and goes to the little machine that puts the date stamp on my copy.

Now I do know of a veteran who was fortunate enough in that the receptionist made a copy

of each page and date stamped each page, but I feel this veteran was lucky the receptionist

did that much.

One of the reasons I suggested the cover page of a 21-4138, Statement in Support is

that on that page you can make a very simple numerical list of the evidence;

Example:

In reference to VA correspondence dated xx/xx/xxxx

I am submitting:

1) Progress Notes dated xx/xx/xxxx, Dr. xxxxxx, medical opinion providing nexus for

depression due to pain of service connected disability.

2) Pharmacy print out dated xx/xx/xxxx showing RX medications for depression or

pain meds or meds for SC'd disability.

3) Letter from my employer dated xx/xx/xxxx HR department records showing time

missed from work.

Name_________ Date________ Claim or SS # ____________ Signature ________

I'm sure you understand what I am saying here.

Anyway, by doing this on the 21-4138 cover page - you have proof of what you have submitted

and the basics of each piece of additional evidence that should be NOW of record.

Also,

Yes, this should help get the evidence there.

In your NOD did you request a HEARING with the DRO or just a DRO Review.

These are two different things.

I,would be sure to have a personal hearing with the DRO

You have gotten some really good information in this thread about preparing for a

DRO hearing, I hope that you have already requested this.

Thanks to everyone. I will be going to the federal building in Cleveland tomorrow. I will definitely follow all of the advice given. Thanks for your time and concern. I will keep you posted. I originally requested a DRO review. Should I request a DRO hearing? It has been two years since the review was requested. Thanks, Bill

Two years is a long time to wait for a DRO to review your claim. You better look into that and ask questions.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
