Need Advice (ro Informed Me That They Now Lost My 1151 Claim)

Greetings,

I just talked to my VARO and was informed that my 1151 claim in not in there data base and has been lost.

I had a claim with many issues for increase (SMC) that was rated on Feb 02, 2006 and was told it was in authorization and then would go to finance. I filed a 1151 claim on Jan 24, 2006 after our meeting with the VAMC Medical Director. I was told a few days ago that my claim for increase had been pulled and sent back to developement to be joined with my 1151 claim (I have been waiting for 15 months for the rating on the claim for increase).

I took Berta's advice and did not withdraw my 1151 claim. I was told by the VARO that I probally would not receive the ratings decison for both claims for a year or more.

I did not sleep last night due to this foolishness. I once again callled them about 20 min ago, and now they are telling me that my 1151 claim is lost and not even in the VA database. I was asked when I sent it in. I informed this person of this ordeal and I was put on hold for over 1/2 hour until I get another supervisior that told me the same thing and that my increase claim is back at the rating office, I explained that my claim had already been rated. I was then informed is there anything else I can do for you. I hung up I don't know what to do. I know that the VAMC admitted fault in reguards to my 1151 claim. I am blown away. Just when you think you have seen or heard it all from the VA.

I dont see how it can be "joined"

They might need to separate SC issue from the 1151 and then combine them for an overall rating-

I would write them a letter and ask them point blank what they mean- if just some vet rep said it at 800#-I would either write to VA for clarification or email them an inquery at the VA web site.

I raised hell 2 weeks ago and the VSM had a meeting with my vet rep to clarify my issues-

Yet the letter I received from the VARO on that meeting didn't make much sense at all so I sent it back and asked some specifics on the VSM response-

There is nothing wrong with asking them to clarify what they say-

They said- for example- that my Bonny V Principi claim is on appeal- yet I have never received a decision on it- they only said twice that "this claim will receive an administratuve decision"

and then 3 years later they still have not made this decision- I told them it should have been given to Regional Counsel long ago- it is an unusual legal issue-

2 other claims I have they said they would attempt tp re-open direct SC death with them as CUES-

It is a ridiculous suggestion- they cant even handle the 2 CUES I have now-

well- they say one is being worked on but the other one they want to change into something else-

I sure do not mind responding to their letters to clarify my issues because I again enclosed my IMOs and reminded them for the 10th time that I am in Relative Equipoise.

You have every reason to get them to explain their 'rationale'.

And I say Hard Copy via email or snail mail is MUCH better than phone calls.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
