Still Being Paid W/o Dependents

Rate this question

Question

I sent in the form 21-686c with initial award and now being awarded rest of appeal without dependents...still.

How long does it take for VA to process this form adding dependents?

Do I get the retro for them, also?

Got SOC...not award letter, yet. But on Friday I did get call from accounting about "substantially large" retro check and they were needing my direct deposit info. I already sent that into to them when I filed.

My main concerns now are about getting dependents added.

What other benefits come along with a 100% P&T benefit award?

Thanks, in advance, for your responses!

How long it takes for dependents depends on your regional office, and if they are still shredding documents or not.

I have been trying to get dependents benefits since 2002, and have been unable to do so in spite of multiple requests.

If your Regional Office does not shred documents, then you may get them in a couple of years.

The VA moves like a glacier..a couple inches per year.

have you provided V.A. with a Declaration of Status of Dependents form and certified copies of your marriage certficate and certified copies of your children's birth certificate. If not, get this done right away. I think this was the mistake my husband and I made years ago on his claim.

No, I didnt put it on that form, but I found my original 21-526 form listing my dependents back in 2002. I have not been paid for dependents from 2002-2006, but I am appealing this.

bronco,

Having the dependents listed on the 21-526 is not sufficient for

VA purposes of granting an increase for dependent pay.

To my knowledge claimants must submit a 21-686c and whatever additional evidence

requested, marriage cert., birth cert.,etc...

I think I had to file the 21-686c with my initial claim. I had to file it again a few months later--they weren't including my daugher who was still in school at the time. That was a one month turnaround and required a letter from the school.

For initial, I would use the form and include the documentation it requires (birth certs, marriage licence, etc.). After they get this fixed, any changes can be requested with a letter or 21-4138 and appropriate documenation--say for over 18 still in school.

should be fairly quick and should go back to original date of claim.

I believe this info (21-686c etc by some reg out) there is supposed to be

submitted within one year of eligibility or you can't get the dependent payment

for it retro'd back prior to that, unless there is a c&ue.

Hopefully someone will post the reg, I'm feeling really rotten and worn out today,

barely hanging in.
