Dear Mom:

In an earlier post you said the award was back to onset of 01. 29 months although substantial is not all that you are entitled to get. You might consider an appeal.

Good Luck and I know that 29 months back pay is a nice lick after all the time you waited. Just don't leave a nickle on the table.

I'm finding out backpay is a confusing issue and I really do not know why some people seem to get what others do not. From everything I have read and from what I was told by a couple of lawyers and SSA, you can be paid retro to your onset date, but no more than 12 months prior to the application date. I have checked on the SSA Policy Information website, and it says the same thing. Your onset date can preceed your application date, but you will only get backpay 12 months prior to your application date. They can reopen a claim that is no more than 4 years old, according to their website. They reopened a claim i filed in 08, but not the one in 05 because it was more than 4 years. I think only a few months, though. Could I appeal that? Maybe, but you know what I'm going to just let things be. What I got is way more than I expected and besides, I don't really think I would win on appeal. I just hadn't seen or heard enough to make me believe otherwise. Now, if I thought I had a good chance of winning on appeal, that might be a different story.

Only and Admin Judge can pay you back past what you got. I would talk to a lawyer about it that does Social Security.

I knew a guy who got 8 years back pay so it can happen

Bonzai - Medicare will go back but you need to pay the back premiums.

My wife recently won her SSI case, but we found out that that Medicare/Medicaid doesn't cover anything more than 6 months prior to her award date. Effective date has no meaning to Medicare/Medicaid, which leaves us with hospital and clinic bills we can not pay for the uncovered time period. ;)

But at least now she has coverage, while we wait & wait for my cases to go through. :)

mom24 - if your disability is for mental issues they will waive the 4 yr deadline and you could go back to the original claim date.

Thank you. As I have mentioned earlier I personally know a man with blood cancer that Admin Judge paid back for 8 years. I am afraid that GruntDaddy is giving advice that could cost you money Mom.

It is important very important that posters be very careful about advice given on this Board.Most of the time someone will step in when someone is wrong and correct them. I appreciate it when it is done.
