Question

:D :D :D what can i do if they reduce my rating on hearing from 50% to 40%. thank you for all your help. i applied for an increase because of my back going down real bad and a tkr also, the vso had me apply for iu in late feb do you think this can drag out till 1 nov ? and thanks again 11b/13b nam 68-69 9th id, 70-71 101st abn :D :D :)

sharon i am 591/2 yrs and when i received my c&p and the audio person said my speech rec. was good . ha ha what a joke infantry and artillery . i go to augusta and not charleston for all my audio testing and aids and currently 50%will va get all my records for augusta and charleston before they decide my case? thanks for your help :P B) :rolleyes: :D :rolleyes:

Don't mean to get personal but there are some questions.

When was your service connection, for hearing, granted to you claim?

Are there other claims you are SC for and what were the dates of grant?

70% total SC with 50% hearing included.

If you are unemployable you are elgible for TDIU. Even with the 10% reduction on your hearing you still have the 60%, that you need to apply for TDIU.

1. If you have received a letter from the VA proposing a rating reduction, then you need to write the VA and tell them why your hearing has not gotten better.

2. If you have NOT recieved a letter from the VA, make sure they have your current address as if they send that notice to your last address and you dont respond, your rating will likely be reduced. You have 60 days to tell the VA why they should not reduce your rating, but I would not wait until the last day. Hearing loss is measurable, and your audiologist will provide you with a chart of your current hearing loss. Compare that with your older charts to see if there has been any improvement. If it does look like your hearing improved, tell the VA its a mistake because permanent hearing loss almost never improves. (You can have temporary hearing loss..such as if you have an ear infection...however, temporary hearing loss can become permanent).

My guess is that your hearing probably did not really improve, and you should be able to prove it with the numbers from your audiology reports.

Frankly I think the VA are idiots to even try to reduce your hearing loss rating, as hearing loss almost always gets worse by about 2.5% per year, and never better.
