Need Some Help With Form 9

Well my NOD came back after 18 months and my sleep apnea was denied again. I am going to write up the form 9 and get in line. I have an idea of what I want to say, but am not sure how to start it out. I want to cite a few BVA cases that mirror mine in the form 9. Any help with some examples would be awesome!! thanks in advance

I say hit them hard on page one of the I-9 right away with the reason they are wrong!

I had a claim turn around in the late 1990s when they got my I-9 form.The I-9 never got to the BVA.

These days the VA fills out a 1-8 form that suggests they have read the appeal and there is check list for what they are supposed to do regarding the i-9.

Dont know what happened here-I wasnt done answering and posting this but have gotten 2 error messages today that I made too many posts in short time frame.

My time is limited and I type fast to reply to as many posts as I can=when I have time to get here- but will refrain from posting too much as it might be compromising the site somehow

Have you asked for a DRO Hearing? A DRO can do anything the BVA can do if they want to do it.

Yes, John. I did request a DRO hearing and it came back still denied with a statement of case.

Berta, thanks for the INFO, but am not sure if that statement is relevent in my case. I do not want to accuse them of not using the regs, when I do not know if they did or not.

well i will tell you joey I sent in my form 9 in June of 09 and it still has not been certified by the RO and sent to the BVA. Just want to warn you that you are in for a wait.
